USCIS "questioned" my friend's trips!!!!

Hello everybody,

I am posting on behalf of a friend, and I hope somebody can help me. I am not sure if this specific issue was mentioned anywhere (I looked and I couldn't find any), but if it was I apologize for asking the question again.

A friend of mine who applied GC based on her father's case has been waiting for an answer since 2002. They said it's name check that was holding her case. Meanwhile, she traveled about 4 times (3 times to London and once to Djibouti). Now she received a letter from USCIS asking her to explain her "many" travels. Has anybody experienced this? Does she need to worry? Is there a "quota' on how many times you can travel? What kind of explanation for they need? And how much detail does she need to provide them with?

Please let me know if you know anything about this.

Just answer the query honestly.

They have the right to ask for this information--they can terminate asylum and deny the I-485 if the person has resettled in a third country. Also it goes without saying that if the person went to or near the country of origin there is a serious issue that needs to be dealt with.

Thankful, Thanks for the quick answer. I will let her know to be honest. She has not resettled anywhere else. She just needed to go on trips. She has been in the US since 1995 and her case was taking too long. 4 trips since 1995 does not seem excessive too me. She was admitted in the US through her father's asylum case, but because she turned 18 or 21 (I don't know which one), she had to file nunc pro tunc and all that process took very long. Anyway, I am just surprised that they felt that 4 trips were too many trips.

In addition, when she went to Djibouti, yes it was close to her COP, but she needed to visit her Grandmother and mother and they met her in the country outside her COP. How can she prove that she didn't go to her COP? Does that mean that just because she went close to her COP that she is going to jeopardize her case?

same case here
asylum granted in 1997 tru my dad
i 485 nunc pro tunc filed in 2006 sill pending
our cases take long time from what i learned from this great forum ... ,unfortunatly.... but on the end it should be all good
i never traveled outside us so i never got a letter like this but i would put it as thankful said .... tell ur friend to be honest because i also heard that our cases are also very sensetive ....
any false info could cost you ( her ) everything ....
 
USCIS may at it's discretion request information from applicants regarding their travel related history if questions arise during adjudication. However, this is solely at the discretion of the adjudication officer. These days such applications go through scrutiny. Remember when you provide a response you have to tell CIS where you visited becuase they have information on your departure/arrival in and out of the U.S. Especially if you flew from the U.S to a country close to your COP, CIS will receive APIS (Advance Passenger Information System) from the airline and this could raise a flag during adjudication becuase the officer might want to know what your trips were about.

All in all, your case is about to be decided. This is a good sign but provide a very precise and honest response. If you can't do it or don't have an attorney. Let me know or send me a message on PM and we will go from there.

When I was being adjusted, they did ask for all my travels including copies of I-94's. Since I travel at least 10 times per year, I had all that and it wasnot a problem since I had every I-94 of my trip. and I listed the reason for the trip and how long etc. However most of my trips were to Germany & europe etc.

I'm curious about the Advance Passenger Infornation System. Does this mean that despite the fact that there is no passport control on the way out, immigration gets this information anyway? That's quite creepy...

They exist. They are very poorly organized and it takes forever for someone to find the record pertaining to an individual.
 
Tell your friend not to panic. She/he has the right to travel. The USCIS system still suffering and it will takes time to be near perfect
