Wonder what is the policy of the DV program on homosexual couples?

Totally agree with darkhorse, the info here and the thread may be of use to people who are gay or for someone who just likes to be informed.

I'm sure there are gay/homosexual members and guests on this forum.

TheRealCanadian Sorry, i did not know that, but anyway, it is the right-wing who are pushing this hateful agenda.

The U.S immigration system is totally unfair, especially is these two cases.

1. If a Permanent Residents marry after they get their Green Card, they are left to choose out between The US and Family(of course there are other ways, but very difficult) -- the V visa was a step in the right process, but now it has expired.

2. If a foreign national and a US Citizen are in a homosexual realtion, there is no way for them to reunite in the US on the basis of their relationship.

And there are so many other injustices, but when was life ever fair.

But, aside from the laws and politics, how can America, the most developed nation, be like that. Even Rajeev Sir agrees with that, he actually said that the US was a hundred years behind.

Darkhorse, why did you say number 1? When one gets the Green Card, if you get marrid with a non american, doesn't she/he get the green card easily? ("easily" after all the bureaucratic process). Why did you say this ways are difficult?

I am NOT, but still just curious.

Dear Darkhorse, I think already you know that, this issue especially not settled yet inside The USA Evangelical Church, How you wonder about its policy within the DV program? any respond to it yes or no, means that a decision has been taken on behalf of The Church and other main related authorities, but on the other for sure a lot of Homosexual individuals left to USA throughout DV program, and sure they got their matching mates, as well as straight ones. Dear Darkhorse please don't feel bad, if I tell you, please don't take us far away from our forum main issues, specially to the benefit of the people, who are here with real problems and confusions need to be solved.

Easily yes, quickly - NO. There's a 5-7 year wait for the priority date to become current.

OOOO!! Then, if I wanted to marry my girlfriend, would she have to wait 5 years in my country until she would be current? Does GC for wife takes so long? I thought it would be a year :S

Yes it will take that long.

Hi Taz. And does this waiting depend on my country of origin?
Meanwhile you are waiting for your wife GC, she can't work, but will she be able to stay in the States for more than 90 days? or should we wait 5 years going back and forth to our country?

THANKS

Hi Taz. And does this waiting depend on my country of origin?
Not on the country, but they have differnet regions, as your CN is EU, I think China, India or Mexico are not the right ones for you :)

No, or only if she has a B visa, but its likely that they will deny it with a husband living in the US.
or should we wait 5 years going back and forth to our country?
You cannot life outside the U.S for 5 years without loosing your GC.

Yep, I know i couldn't stay outside US for so long, but she had to be if we wanted to get her GC.

Well, I see the solution is:
· She could study in the US and stay under a student visa until we got her GC
· As she is teacher, she could apply for some J visa
· Find a job for her (less unlikely) :S

Until today I thought it was an easy because I was confused with citizens (they can get their couples' GC in less than 6 months), but it's harder for PR.
It could change my mind ...
:S

I have just found that years ago (2001) they give you visa V1 to stay in the USA while your husband or wife wait for the Green Card.

Not any more

You are right, did not read all details
The person is the principal beneficiary of a relative petition (Form I-130) that was filed by the Lawful Permanent Resident spouse/parent on or before December 21, 2000

Change your mind about what?

Changing my mind about going to the States :S. I don't want to be for so long time without my gf. I would do it if it were 1 - 2 years. But waiting outside going back and forth is not a good way of life. Moreover, now bad times are coming and USA is also involved. The migration might not deserve to make this hugh effort (waste 5 years of our life living this way)

I feel sorry for you my friend, but did you not know about this? And about the economic conditions, which country do you live and are the economic conditions there (are and going to be) better than that of the USA?

Well, a country better in economic condition than the USA would be difficult to find (well, now it could change), but life here is no bad (Spain). It's Europe and here I don't need anything but a more interesting job. Here weather is good and I don't know if i will miss it there (if I'm alone I will miss everything :S).

My interest on going to the States isn't money, it's having an interesting and productive career in which I could feel that I'm doing things.

Then, I don't know if it deserve to leave my girlfriend here :S.

I understand ronin, but what industry are you specifically trying to get in to? And if I am not mistaken, you are about to complete your Master's degree right? So what interests you.

I have a similar reason why i want to get that DV so damn bad, is that my girlfriend is going to the US to study, and the BA/BS will take 4 years and I don't wanna be away from her for that long.

And as for me, like you the thought of getting something done, and I am really interested in Finance/Inv. Banking stuff. My back up plan is going to Frankfurt to study(which would not be bad at all for Finance and stuff), but then again, afraid of the separation.

And yeah, I know the US Economy is the biggest and the baddest in terms of size and all that, but the oppurtunities are really good, I mean anyone can rise up there.

Is Europe also like that? I mean, will someone rise because they have the skills and the talent, or is it difficult if you are a foreigner to the EU?
