Hi...I was convicted of "no proof of insurance" in 2004. I went to court and was ordered to pay $300. This happened again in 09/2010, but this time I just paid the fine with the citation along with a speeding ticket. I believe they're both misdemeanor convictions, though 5 years have passed since the initial conviction. I would like your opinions as whether I should file the N-400, and what my chances of approval are, also do immigrations look beyond 5 years...thnx in advance

thnx bigjoe

No, this will not prevent naturalization. Read 8 CFR 316.10 on GMC.

thnx bigjoe....should I disclose the one from 2004 as well? its been over 5 years since the first offense, and it doesnt show up on my driving record.

Yes, you must disclose both convictions. Question 18 in part 10D of N-400 asks about ALL convictions, not just the ones in the last 5 years.

Do I just need proof that I paid these fines, or do I need more than that? they were both under $500. Iam just concerned that they deem it as a "pattern", since it happen twice. Anyone have experienced such as having more than one conviction and still being approved? Also should submitt any proof with the application, or if and when Iam questioned about it? thnx in advance for any input

Since these were criminal rather than just administrative convictions, you need to provide proof of court disposition for both cases (even though the fines were under $500). You can get that from the court(s) where those convictions occurred: go there and ask for certified copies of court records for both cases - this is a standard service that all courts provide for a small fee.
Whether or not you are concerned about the incidents showing some pattern, you absolutely must fully disclose both of them in your N-400. Lying or trying to conceal one of those incidents is a much bigger and more serious offense than those convictions themselves.

thnx

thanks much for your input. I will obtain those dispositions on monday insha'allah.

help!! I called the court for my first "no proof of insurance" ticket, turns out I did have insurance submitted to them in 2004, they recieved it and dismissed the charge. I insisted that she send me certified docs stating that's the case, her response was there was no case and no disposition, since this never went to court. Iam not sure as to what I should submit with my application, I provided proof of insurance at the time and that was the end of it.......any input would be nice...thnx

correction: this was a citation for no proof of insurance in 2003, which I was never convicted as I had provided proof of insurance to them and they dismissed the citation(charge).

Since the matter never went to court and you were never convicted, don't disclose it.

Hmm, I don't think that's correct. Question 16 in part 10D of N-400 asks to disclose all citations issued to the applicant by the police, regardless of their eventual disposition. I think it is more prudent to disclose that 2003 citation and to attach documentation showing that the citation charges were dismissed.

A couple of posts below, the OP stated that the court was unable to provide him with a disposition, as the citation was dismissed without going to court. As such, he has no proof/documentation to provide. In this situation, it would definitely be more prudent to keep mum about it and not overcomplicate the case unnecessarily.

hi guys,,,
As the matter haven't yet gone to the court i better advice you to keep it to you and not to disclose it.
In case they came to know about it hey can penalized you for this with fine of range from 100 dollar or above.

This is a non issue for naturalization since they are relatively minor offenses and have occurred outside statutory period. Don't drive yourself crazy about it.

Thnx bobsmyth...I've already filed my n-400 and another matter just occured to me. I was beat up and stabbed by a group of guys back in 2002 or so, I dont remember the exact year. I was rushed to the hospital and after I got out, the police came and took me to their station to get my testimony or something to that affect, I just remember they were recording my story and how everything went down. I wasnt arrested or anything like that, I dont remember being fingerprinted. I just dont know if that's something I need to disclose at the interview or not, that's the only time I've ever been to a police station......thanx for your help in advance
