will my I-485 be denied ?

I was divorced in my home country in March 2007, but when I applied F1 student visa at the US embassy in July 2007, I filled the forms as a married woman and filled out my ex’s name. I came to US in August 2007 and married my husband 3 months later (my husband was a green card holder at that time but he soon got his citizenship). During my recent green card interview, the officer said I was not being honest at 2007 visa application because my divorce certificate said I was divorced in March 2007 but my July visa application still said I was married (he has a copy of my initial visa application summary). He took my I-94 card. He said he believed in the marriage so he will approve I-130, but for I-485, he will request materials from Dept of State, he will investigate and get back to us in 3 months or so.
My questions are:
1. will he deny my I-485 ? Should I get a lawyer ? what should I do ?

2. Should he take my I-94 card at all?

your helps are very much appreciated.

The officer was under the assumption that you stated married in the F1 application just try to able to gain more chances of obtaining the visa but you wasn't married when you applying for the F1 visa so you are really dishonest and will probably be classified as giving fasle information just to gain entry to the US which can be a lifetime ban from entry. You better consult a lawyer.

really that serious ?

Thank you for your helps.

I was scared by your replies. Is it really that serious ? could they really send me back to my home country even though my husband is a US citizen ? Should I wait to hear their responses before I get a lawyer ?

Get a lawyer. If they suspect fraud (which they appear to) in your visa application, it would be useful to discuss with an attorney for $100 or so.

if they think you've made a fraud, your US citizen husband will not going to make them to change their mind. You really need to take this seriously becasue as soon as they denied your I-485, they'll put you in deportation proceedings which left you only two options: to appeal it or leave the country. Unless you have a very strong point to appeal it, otherwise winning the appeal is very slim when there's a deportation against you.

Yes this is serious. You committed perjury. In July 2007 you were divorced and yet acquired a visa under the pretense of being married. Get a good lawyer and be mentally prepared for the worst.
