I am glad to see someone who has blind faith in lawyers, who can ignore the directive as issued by the Administrative Manual of USCIS. Jayao, you are an unscrupulous attorney's dream client. It is very clear from your initial posting on this thread that you are high on something, and you need help coming down from the high moon you are riding to misinformation land...lol!!! Bob is correct in his posting, not because he has a million posting, but because he takes the time to read and understand the guidelines. I read as much, but I can't claim to know it all and I mind you, being through law school, I find myself trying to double check my facts on these immigration stuff. I am not ashamed to come on the board for correction or verify something, because unless you are willing to learn, development or growth isn't in your future.

I am sure your attorney is going to tell you that crimes of moral turpitude don't affect your naturalization, because USCIS is staffed by dolts... and you are going to believe him, as he cashes your check smilling...

Believe me, I have forgotten more about immigration laws than many people will ever know know simply because I used to make it a task to read them as well as various immigration cases. And while I may seem like I depend too much on an attorney, I do read these things and bring things to his attention that he may otherwise have skipped, in the process keeping him honest and aware that his client is not to be toyed with. All that moral turpitude, aggravated felony, crime of violence, etc I am well aware of so I really do not need an attorney to read it to me. As much as people depend on me to keep their businesses running on the IT side, I believe even though I do my research to be on the safe side, I apparently have to leave the rest to my attorney. I rest my case at this point, we all have our opinions of processes which is why when I am not clear I call USCIS for clarity or my other resources as well as discuss with my attorney.

Khan, here's what you need to do:

1. If your move to TX from NY is a permanent one, you and your wife both need to get TX driver's licenses first. You cannot continue to drive in TX with NY driver's licenses so take care of that first.
2. Then wait until you have lived in TX for three months before you submit your N-400 applications. This is because you need to have stayed in the state you are applying from for at least three months before you can apply from that state. Your application will ask you to submit details about where all you have lived in the last five years and so you will need to enter the date that you started living at your new TX address. Therefore it is important that you have your driver's license address updated to reflect the new TX address so you have proof you live there.

As someone pointed out above, why would you want to risk your application processing, money and time over such a small, easy detail like a driver's license? Good luck.

Completely agree...

San,

How are you doing? Hope your situation was resolved completely to your satisfaction. Jayao is going to meet one thuggish lawyer to ever graduate from law school. As much as he might read the immigration law, he might have to consult a lawyer specializing in real estate, but also want advise on estate planning, which appear similar but are governed by completely different laws. It will be then that this lawyer do harm to him while smiling with him at every meeting...lol!!! NYC seems to have a corner on the market for lawyers who drink from the same poison well of dishonesty...

Ok, so you have to wait 90 days to apply for naturalization once you move to Texas, and by that time, you will have had to get a Texas DL, so what's the problem? If the OP had waited the 90 days then he should have got a Texas DL and won't have a problem at the interview.

Part of the argument was that jayoa did not believe one had to reside in a state for 90 days first before applying for naturalization from that state. I provide further documented proof that you do need to be resident for at least 90 days: See question 6 on page 5 of this Naturalization Eligibility Worksheet

Now this is the real deal, I guess most people (except JPBoston) do not read that far down the instructions. Good eye.
It's the same worksheet that is part of the naturalization guide that was referenced earlier and that you refuse to follow.

Yeah, I know. Just that this one is actually on the N400 instruction document and does not seem suspiciously old like the handbook. It is the same though so kudos.
