Wage determination and timeline

Good morning all. Got an e-mail from the lawyers yesterday, just wanted to share with you guys. It basically said that our application is still pending but if eb3 stays current, there is a high chance that they want to file 485 as soon as PERM clears so we should go ahead and obtain necessary documents(gave a checklist but I suppose it should be there in the 485 files as well) and have a medical checkup. Personally I somehow don't believe that it can proceed so fast but it's best to be safe and the med. is valid 1 yr. after you take it. So I'll start to look into it slowly. Just wanted to share, at this point we're into about 40 days of waiting at atlanta. Take care.

Misza, thank you, we really need all the good luck we can get now :)

One last note- do we need to obtain criminal records from our country (not that there's anything there!) as one of the documents? It wasn't included in the checklist that the lawyer sent, so was just wondering. I don't want to find that down the road we need it too and spend weeks waiting for a piece of paper.

My lawyer told me not to obtain any foreign records unless you were arrested or in jail.

nazar - do you send your medical record with I-485? My lawyer told me not to do that ("if they want it they will send us a RFE"). What about pictures? Do you send any?

For the I-140: employer's latest tax return or financial statement
your 2006 tax return with W-2
your year to date earnings paystubs
employer letter from prior employers (only if you have, not
absolutely necessary)
your diploma, and translation, and academic evaluation

For the I-485: birth certificate (for both) & translation
marriage certificate & translation
valid passport & I-94
pix
medical control
 
Doody thank you- that seems to be right. Great, one less piece of paper to worry about :). I honestly don't know how the lawyer will proceed w/ med report. They just told to go and have it done and have 639 filled out by the dr and have it ready in case it's needed any time soon.

Johnny- I already have the checklists, I was only worried about the Criminal Record (which is normally required for a number of things but apparently not for the 485 appl) but thanx for the brief list.

I went to ask about medical exam. The doctor told me that I can't do the immigration medical exam at this moment. The HIV test has 1 month validity. I did only Td test. They accepted my immunization history.
 
Thanks, That is really good news. I searched a bit on exam validity and could not find anything about HIV valid only 1 month. All I read was that the exam is valid 12 months.
 
Hey ladies, thanks for the heads up re. test. I think we'll still go and have it done mid-July, just to see how the rest of it goes as well. This is really a waiting game, I'm very hopeful one hour and the next say "No way we'll be in time". So we'll see. Awaiting good news from all.

Taking the exam is a loong procedure - you first go, they draw blood and do Tb test, then you return 2 days later for the Tb test. If the Tb test looks positive you need to take an Xray. The other results would be ready three business days later. The only problem we had is that we don't have Varicella vaccination, the nurse asked for doctors report that we had it as kids (we both did have it, but I have no clue where my baby medical record is), so we ended up with one more blood test :). Cost $100 per person + $100 for the varicella. When you go, make sure you get a copy for you and that the envelopes are properly marked.

My story about immigration medical exam:

I asked my mother if she can get my medical record from the hospital. She went to the hospital, they gave her my baby medical record. What she noticed that my vaccinations are missing from my record. She went again and asked the doctors for the vaccinations. The immunization history was found in a different file: a file ONLY for immunization. The doctors wrote another records about vaccination. We received the record last week and after we translated in english.
I have done: Rubella, Varicella, PPD, BCG, Td, DTaP and Polio. I did Td again because the validity is 10 years. I will need to take another shots for: measles and mumps.
Because I have a free physical exam once a year, my doctor told me that I don't need to pay office visit for the immigration medical exam which the cost is $195 for new patient and $125 for established patient.
My suggestion is: if you have free medical exam offered by your insurance you can combine with the immigration medical exam.

Tried to post answer this morning and did not work. Yes, our PERM is certified and you are right about trackitt. I am working now to collect and make copies of all the lawyer wants - it is a slightly different list than yours. She (the lawyer) send us an email she is extremely busy now that EB3 is current and also, that she will not start preparing anything until she has all (including medicals and photos). So I am pushing to be as quick as possible, so we are not left for October.

I thought that once PERM is certified we are filing immediately and it is not happening. Hope you are going to be done soon. Take care.
