WAC-02-046 stats

WAC-02-046-5xxxx

----- FP will expire in 4/17/03. Waiting for renew notice.
----- EAD expired 3/5/03. Renew submited 2/15/03.
----- AP expired 1/12/03. Renew submited 2/15/03.

Staying at home, no EAD, can't work. In order to get me back to work, employer did a Premium H-1, it was approved a week after submission in 3/10/03. But attorney said I can't work until I go to Mexico US conculate to "activate" the premium H1. If I go to Mexico without the AP, my AOS will be voided.

So I am painfully waiting for AP renew to come. The check was cashed in 2/22/03. No receipt yet. Attorney said AP renew will take 30-60 days, which should be 4/22/03 for the 60 days.

The online status checking said it would take 120-180 days after RFE received (11/05/02) before I get final decision for AOS, which should be 5/5/03 for the 180 days.

I understand it takes 90 days to get i-EAD. If I apply i-EAD now, I should get it early July.

My question:
1. Based on all the date/numbers above, should I apply i-EAD? Can I apply i-EAD while I am renewing EAD?

2. Can I trust the number on the online status checking for AOS?

3. How long does it take to renew AP?

4. LA Mexico consulate said it will take 3 weeks to issue a Mexico Visa, but San Bernidarnio did not say so. I wonder if the 3 weeks time line was something new after the war begin?

Any advice. What should I do?

Thanks a lot!

Answer

Sorry to know your situation.
I can answer your first question. There is nothing like applying for i-EAD and waiting for 90 days. Since you applied for EAD renewal on 2/15/03, you can go 90 days after receipt date to local INS office to get i-EAD on the spot.

You can even try for i-EAD before 90 days, some people got it I think from SFO and other places. Please check the logs.

1. Based on all the date/numbers above, should I apply i-EAD? Can I apply i-EAD while I am renewing EAD?

...#1 yajiv answered it. I say try for iEAD in 90 days, thats an on the spot process, no waiting involved.

2. Can I trust the number on the online status checking for AOS?
... #2 In 95% cases it works. Online plus phone is what I do. If I do get approved, I'll get something in the mail anyway.

3. How long does it take to renew AP?
...#3 Don't know exact times, but I know AP doesn't take as long as EAD.

4. LA Mexico consulate said it will take 3 weeks to issue a Mexico Visa, but San Bernidarnio did not say so. I wonder if the 3 weeks time line was something new after the war begin?
...#4 Don't know about Mexico, never been there. Try san bernadino again I say.

3/30 Sunday night Update

2 cases changed to approved from RFE recvd and resumed. Both were around the same wac # so it could be husband and wife.

So why exactly is America called the land of Freedom, Fairness and Opportunity? Or am I missing anything here.

One good day

Yesterday we had 3 approvals. I almost had a hartattak. One was from RFE Recvd, another from resumed, and another transferee.

*WOW* what a week. We've had 8 approvals this week, and 2 RFE sent .. something we haven't seen since February, and before that November.

Here is the latest count

Code:
Approved/Completed Count	225
Denied/Withdrawn Count 4
FP sent Count 8
Misc Count 6
Received Count 55
Resumed/FP recvd Count 143
RFE recvd Count 32
RFE sent Count 8
Transferred Count 35
Grand Count 516

Though none of these cases were from earlier FP dates, which is sorta depressing.

Though there were a few approvals which came from straight Resumed status, so that is good.

Monday 4/7 Update

Code:
Approved/Completed Count	225
Denied/Withdrawn Count 4
FP sent Count 8

Resumed/FP recvd Count 141
RFE recvd Count 31

Still eventful, though today we had 3 transfers. I think INS is actively trying to reduce the cases that have never been touched yet (finally).

1/15 it was 154
2/18 it was 151
3/18 it was 149

In other words, in the last 1 week we have seen more fresh cases being touched than we did in the last 4 months .. that is something .. :)

Good luck to you all (and me).

So far so good, though the latter part of the week was slow .. I hope it picks up post Apr 25 when special registration ends completely.

I doubt it will pick up so fast after April 25th. I am sure there is going to be a period of waiting where the post processing on special registration cases will happen. Then these people will be reassigned to various departments. After which they will need to familiarize themselves with the new procedures, get files assigned to them etc. by then a new batch of special registration cases will show up and the cycle will continue. :(

140 ur prolly right, but still, currently with paksitani special regn. ending, we saw a pickup in speed, especially EADs. With this ending, and EAD's becoming ok backlog, 485s will pickup, won't happen overnight, but over the next 2-3 months it will.

Silly Man,

I am hoping you are correct. But INS has made me lose faith in everything it stands for in any case.

I was running the Status checker for WAC 03-001, I know it is being bloody optimistic and all that, but I wanted to accumulate my database, for when I run the stats scanner daily. It was a little disheartening to see 4 of the 37 AOS cases rejected. That is like 10 % right there, it has hardly been 7 months!

Can you email me the worksheet for the cases you are monitoring? Building my database slowly. I am currently running the scanner of 4 machines to accumulate the initial database ASAP. After that it will be that much easier to check for status.

Silly Man,

I ran a scan on some 3000 WAC numbers from the 03-001 series, and I must say the scan supports your view. I saw a HUGE number of approvals for EAD's filed in the October 1st week range, for the last couple of weeks. Definitely they are way ahead of the JIT in that. At this rate, in the next month they should eliminate that back log for sure. I am sure they will target 485's next, since the backlog has become ridiculous! Hopefully all the people who have been waiting for a long time will get cleared in that rush!

And you big dope! Got your message last night, too late to call back! Will send you an email today!

I guess I am in the same boat as you are, same ND. I am still waiting for EAD but interestingly my wife got it a few weeks ago.
What's your status?

AverageJoe,

My Rd for EAD is 10/01/02, WAC 03-001-5****, I was approved for EAD on April 15th. What is your RD like?

Like I mentioned earlier, I scanned some 3000 numbers in the WAC 03 001 range yesterday, will scan some more today, but the stats were very interesting, over 65 % of the cases filed around those WAC numbers have been approved, in a number of cases, the EAD card was mailed!

My advice, don't sweat it, if it hasn't been approved already, you will be receiving some good news with re: to your EAD soon! :)

Slowed down a bit. Apprx 3 case movements in 5 days .. terribly slow. Even at this picked up pace, November people should be mentally prepared for another 6 months. After November, god help you.
