Visiting Relative Refusing to Return to Home Country. What Shall I Do?

I have a relative who has been visiting me for over 6 months. Although his visa only allowed him to stay for 6 months, he refused to return to his home country after his visa expired a month ago. This causes me a lot of emotional and financial stress. I really want him to return leave ASAP.

I don't want to call the Immigration to get him deported, because I cannot do that to my own family. Without getting him deported (and having him get a bad record), what options do I have to make him leave?

FYI, I've filed immigrant petition for my other family members. Therefore, I do not want my action to have any negative impact on their chances of immigrating to the U.S. in the future. I also do not want to affect the very stubborn relative's chance of immigrating to the U.S. in the future, either.

Any advice would be appreciated!
 
I can't offer any expert or legal advice, but I would sit down with him (which I presume you might have done already) and explain to him in what kind of situation you are in because of him. If he doesn't care, then he's simply being a selfish prick and I wouldn't feel bad about calling the authorities. He obviously doesn't care that you're his family member that he's putting you at such risk and he doesn't care that his other family members might be denied visas because of him. Do not feel bad about doing the right thing, which actually might win you some credibility points with the authorities in the future. That's my $0.02.

I've already talked to him many times. He doesn't listen. He has some special needs, that's why I've been tolerant of this behavior.

I'm afraid that calling the authorities may turn me into his enemy. I also wonder if the authorities will actually take the action to get him out of the country (which is what I want), or simply put a bad comment on his record without doing anything else (which not what I want).

The best outcome is that the authorities make him go back without putting a bad record, in which case he still has the option to immigrate to the U.S. in the future with the rest of the family. Since he has special needs, he cannot survive on his own. If he is denied immigration to this country in the future because of the bad record, that will prevent other family members from coming as well because they'll have to be with him.

Then talk to his family members, and tell the same situation.
 
Sit down with him and tell him that you are about to tell the immigration people of the situation unless he voluntarily leaves. I suppose you filed the petition for his non-immigrant visa. Then you have the right to act in your best interest. You tried to reason, now try a little intimidation and eventually do the hard one - call the immigration authorities.

I do not agree with triple citizen's suggestion to call 911 and have him evacuated from home. Sound too harsh inspite of what he is doing to you. Also he may still overstay and would cause you problems. Moreover local authorities may not have jurisdiction over immigration matters.
 
Tell him post 9/11 if you overstay, FBI will come home within the next week and send you to prison.

I may sound a bit harsh but that is the way I am. I do not talk to a few cousins of mine who are present illegally in the US. I have zero tolerance for adults who knowingly break laws, and laws in my opinion include immigration regulations.
I am a democrat in the US and a liberal party member in Canada, but I agree with the GOP backed stance Arizona has taken. Being illegal is a crime in my opinion!!!

Being illegally in the country is the crime, I agree. But approving the entire legislation enacted in Arizona today would go a bit too far, especially on this forum. I, for one, would not want to be required to produce immigration papers (and detained if unable to do so) just because an Arizona cop hears my accent and decides that I am worth checking out. This topic, however, does not belong in this section.

Initially he agreed to leave before his visa expired. Then he accidentally talked to some illegal immigrants who told him that some people had paid $100K each person in order to come to the U.S. The illegal immigrants told him to stay like they did and make some money.

I said those people were low-life whose advice could not be trusted. They hide like rats in the daylight in order not to be found. Truly pitiful.

I'm relocating to a city where I have warm-hearted friends (BTW, I do not relocate because of this). I'll ask my friends to talk to him. If all efforts fail, I'll have to call the authorities.
 
You are missing the point. I am not in support of this guy illegally staying here nor do I support illegal immigration. Having followed the law and waiting 13 years to get USC, I have zero tolerance too for illegal immigration and indeed any law breakers.

Going to local authorities may end up with guy on the streets and he would simply (possibly) go underground. If they in turn contact Immigration, well and good. Instead call the Immigration authorities directly and they would take care of it. He possibly has an return ticket too, so they could put him on plane back home and bar him from coming for some time to boot.

It's a bit troubling to me how an immigrant like you can have such narrow-minded views of other immigrants, legal or not. Everyone has their struggle, even the "pitiful" illegal immigrant.

It can be argued that the people most harmed by illegal immigration are legal immigrants.
