US citizen parents sponsoring over 21 son..

Hi,

I'm single, over 21 living in Brasil...my father is a USC and i was wondering if i could get my CG through him...or what is the best way for me to obtain a Visa or a greencard...

Also...My parents started my legalization process a long time ago but it was never finished...

Can anyone help me out? thanx
 
Did your father ever file an I-130 for you?

Please elaborate ... what papers were filed for you, and was either of them a US citizen at the time it was filed? Did they withdraw the application?
 
im sorry i really dont know what the I30 is for...and i really dontknow what papers where filled out for me...no neither of em was citizen but my mom had remarried and my step father is a citizen...i dont know if that helps....

Is this stepfather the same "father" you mentioned at the top of this thread? If yes, did he marry your mother before you turned 18?
 
ok...lte me see if i can explain this right, Im sorry i know very little about the paper work...
I went to the US legally when i was 11 and just recently in 2008 came to brasil due to a familiy issue...and my visa had expired...

My Mother Married my stepfather(who is an american) when i was 11 and they Begin the process and im not sure where it stopped at (i know it was approved for some next step)...but later they ended up getting divorced when i was 19...and the paper work was never finished

Now my real father is in the US is now a US citizen... Both of my parents were legal there before i was 18

The thing is im now 26 and i want to go back to the US... Can any of that help me, or am i screwed?
 
You need to find out the details of the paperwork that was filed and what stage it reached. Find out if an I-485 was filed for you, when it was filed, and what is the status. Otherwise, it appears that you will be banned from entering the US for 10 years as a result of overstaying your visa for such a long time.
 
Funny thing is when i left no one asked for the form nor there was any info on who i should give it to...neither in the US or in Brasil...
 
OK guys yeas the form was a I-30 form...my dad has been in touch with a lawyer and the lawyer claims i have to pay a 2.100 dollar fine plus the lawyer fee....any advice? before i start paying this?

The fine is $1000 but you are too late ... you would have had to take advantage of 245(i) before you left the US, and remained in the US until your green card is approved. Now that you have left the US, all you can do now is wait out your 10 year banishment.
 
its an immigration lawyer...and i dont understand how they could ban me if they dont have any records of me leaving...for all they know i couldve left before it expired

So you plan to lie and tell the consulate you left years ago? You expect them to believe you, after there are records of you attending school in the US, and both your parents have been living in the US for years? How will you produce documentation of what you've been doing supposedly outside the US for the last several years? And don't think that they don't have records of your departure. Airlines share passenger information with the immigration authorities, so they probably do know the date you left.

Be careful. If they catch you in this lie, you will be permanently barred from re-entering the US for any reason. Do you feel lucky?
 
no i dont plan to lie...as i said it was question i was wondering....but im also questioning ur knowledge to the lawyer thats advising my father...U say one thing hes saying another...thats why im confused...I wanna know if what hes saying is legit
