Updates:Did you file your 140&485 before Sept 30th 2005 retro deadline?

The original amounts (before the fee changed) which is what I think you are asking are:

I 485 - $315
I 131 - $165
I 140 - $190
I 765 - $175
Finger Printing Fees - $70

Thanks for the reply. I think attorney is right with the amounts because 315+70(finger print fee) = 385, 165, 175. As per unitednations they should definitely accept our 485s and send us receipts because it was mistake on them to expect the new fee for app filed in Sept. I will again wait with that hope

I do not have any updates. Looks like VSC sent back our applications for the same reason. Not sure whether they will accept the resent application.

For FP, you will only need to bring your FP notice and driver license.

For FP appointment, you'd need...
1. Driver's license
2. FP appointment notice
3. I-485 receipt notice
4. Passport (Optional... but you should take it for good measure if someone insists on two photo IDs)
 
Are you sure we need I-485 receipt. I've only a copy of it, my original is with the attorney. Can you please comment if we need the orginal one?

Answer: Generally, using the AP to travel and reenter should not automatically cancel the H1B extension pending. Although there is a lot of gray area in this field, the Legacy INS memos of March and May 2000 seem to allow flexibility and allow a person to be able to enjoy both statuses while on H1B or L-1 or for the dependents. The last action of the USCIS will usually govern under the last action rule, so that if the last action is the entry on AP, then one is a parolee and not on H1B, but future extensions of H status are still permitted.



Question: Good evening. Will my H1B be invalid if I return from India using advance parole?

Answer: As mentioned above, the general rule is that, if one is still working for the same employer on H1B status, merely travel abroad and reentry to the U.S. on AP does not prevent such a person from applying through the employer, for the H1B extension/s within the U.S.

Question: Does one lose H-1 status if s/he used advance parole for returning to the USA?

Answer: A person is allowed to use AP to reenter the U.S. and is also allowed to file an H1B extension soon after reentering on AP, and then revert to H1B status. Review the March and May 2000 Legacy INS Memos, which we have written about on our website and posted summaries of those articles.

Answer: The USCIS memos are not entirely clear on this issue, but this scenario may be possible, especially since the USCIS / Legacy INS agreed, in the May 2000 INS Memo, that the H1B extension may be approved for a person who had entered on the AP but continues to work with the H1B-sponsoring employer and intends to continue to do so.



Question: Is it okay to go out of the country after fingerprinting? If your I-485 gets approved when you are out of the country, can you come back on advance parole? Basically, is the AP still valid?

Answer: Yes, the AP is still valid since the CBP Inspector generally paroles the person into the U.S. and then the person goes to the local USCIS District Office to obtain the PP stamping with the temporary evidence of lawful permanent residence status or the GC stamp. There is a Legacy INS Memo that specifically allows such a procedure except that the CBP is not necessarily bound by prior INS Memos, but, generally there has been consistency in the interpretations among the three agencies comprising DHS and dealing with immigration matters.

No EAD, no AP, no FP done (FP notice is for 12/01/2005).

No LUDs since ND

VSC, EB2, RD: 09/30/2005, ND: 10/24/2005 (all except EAD), ND: 10/25/2005 (EAD).

Today(11/17), the Advance Parole for me and my wife were approved.

ND ->10/06

I dont know how much of a help AP is without EAD though.

Congrats,
Advanced parol and EAD are for two different purposes.
If you have travel plans you can use Advanced parol to reenter USA.
