Updates:Did you file your 140&485 before Sept 30th 2005 retro deadline?

Confused abt FP!!

Hi, sorry for being here so late as I just came to know abt this room.

Pls read below :), and kindly clarify my question.

Mine is a substitute labor that has priority date sometime in 2000. My employer has filed 140, 485, EAD, and AP all together on 27th of Sept 2005 for my wife, 2 kids and myself in VSC.

So far the news is my employer has received receipts for 485 and AP (for 4 of us), EAD(for my wife and myself) and we have been sent the copies of the same. WE are not given the copies of 140, my employer says they wont send them to employees as they are confidential(!!!), this was on 1st Nov.

Based on the "text" we saw on the 485 receipts I called the 1-800 number and got the appointments for 4 of us at nearest service ctr for 8th Nov, and we got FP done.

I have received an email notification that EADs (my wife and myself) got approved and the cards will be mailed soon on 16th Of Nov.

Today when I checked my mail box, I saw EAD cards and FP notices for 6th Dec for my wife and myself.
** My question is do we need to go for FP again or just call 1-800 number and seek their advice. If we need to go for FP again why dint we receive FP notices for my minor kids??...hmmmm lots of confusion..

And we have not received our AP receipts yet..any idea??

Do you have any updates? It is more than 3 weeks now after my application has been resent. So far, I have not heard any news from my attorney.

Thanks for the reply. I think attorney is right with the amounts because 315+70(finger print fee) = 385, 165, 175. As per unitednations they should definitely accept our 485s and send us receipts because it was mistake on them to expect the new fee for app filed in Sept. I will again wait with that hope

Hi wheremylc,
I just finished up the call on that 1800 number just to see if anything got on to the system for our 485s. Nothing was there. May be they came back again, who knows if the attorney is even tellingm e stuff or not. I gave up on this

For I-140 There should not be any problem as there is no retrogession associated with it. You can send it back anytime. You said 'My Application had been denied' Does this mean only your 140 had come back? If your 485 is still with them Then Everything should be ok for you, i think.

Thank you babuhere.. for courage but my bad luck.

The Attorney have Resent the application on 02-Nov-2005 but its being sent back with other doucments and checks I mean everything,as the check amount was not correct. He Resent the check as per rules as off 30-Sep-2005, they sent entire package to resend the correct amount to I 140.
He still say he is going to try, he got no proof saying weather he included the check or not for the first time.
The Attorney says he is 200% sure he included the check,and i never gave the check nor my employer,its a misscommunication, my employer sent me an email what checks i need to give and he never mentioned about I 140 check, and my attorney clearly said that he is going to collect the check from my employer, and even said that with out right amounts or checks,application will be sent back.

My attorney told me that the forms came back again. So no hope.

Badluck Guys. I am sorry for you guys. May be if S1932 bill gets passed on Dec 6th by Congress, then, should be able to see some light at the end of tunnel. How come attorneys be so irresponsible?

Wheremylc, whats the reason they said this time for you?

FP for EAD

Hi everyone,

I had my FP Code 3 for 485 on 12/01/2005. I got my EAD card on 11/25/2005 but it does not have a finger print. In the place of a finger print, it just says finger print not available.

I spoke to my lawyer, she said you will get a separate notice for FP for EAD. Is that the way it happens? If there is a sepeate FP for EAD, then will they issue a new EAD with the FP.

I am a bit confused on this.
 
Floyd: U had multiple LUDs on 485 bcoz of FP. I have one after my FP as well and then nothing. Let me know if there is any after this one. As for EAD, I received mine before FP and my lawyer did not mention getting another one with FP on them. How does that matter. We have EAD...thats all that matters...

What about the LUDs on I-140. Does FP mean there are LUDs on I-140 as well? There were LUDs on 485 before FP and after FP as well.

Any thoughts.

Not sure abt 140. Maybe you'll soon be hearing some good news! :) I think 140 and 1485 are processed by separate p'ple and therefore LUDs should not be related. Lets see when u see a msg change for 485. Not happened for me so far and many others whose file is with NSC.

Hi Floyd,

I am not a guru, but you may be right, I got a RFE on I-140. (140-LUD: 10/17, 11/16, 12/01, 12/05)

On December 5, 2005, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283.

I will update soon as I hear from my lawyer.

I also noticed LUDs on all of my petitions (I-140, 485, AP,EAD). They all have 12/01/05 except the I-485. My I-485 has LUD of 12/02/05.

did you get your EAD? mine is EB2. How about yours?

I applied on 9/29. My ND is 09/30/05, EB2 VSC.

My EAD has not yet been approved.

does anyone know the current EAD approval timelines?
