As long as you want to continue to maintain renewal of your H1 and EAD, you have dual intent. Once you stop renewing H1B, you are on EAD. Once stop renewing EAD and renew your H1B, you are on H1B. Does make sense.
Even if you have valid H1B, but not restamped in the passport, it has to be restamped in the passport before you travel. Instead of restamping, AP can be used as an alternative.
AP does not/will not invalidate any document which is used for work.

so this means that coming on AP will not effect any valid H1 .
But here since we cannot go for Visa stamping on passport we can use AP as an alternative..am i right??
So My husband can still work on his H1 after coming back with AP.

actually our lawyer applied for H1 extension on Apr8 th which is 1 day before his current H1 expiration date(9th APR) .Is it o.k or do one need to get receipt dated before expiration date??

will it be a problem at the port of entry(Since H1 is not yet approved)?? and we don't know if it will get approved or not by that time we return..

Will it make him out of status ?? please let me know your views on the above ..

AP/H1B question..

Guys,

Iam planning to apply for AP tommorow because planning to travel to india in May. My question is: Do i need AP if my 485 is approved when iam in india, i have a valid H1B stamped on my passport. Can i enter US with my H1B?

If you are in India and your 485 is approved then YOU WON'T BE ABLE TO ENTER IN US with your H visa (485 cancels your H status). If the officer from port entry finds out that your 485 is approved and you don't have a valid AP then s/he will give you the ticket back. The law says that you have to be in US when your 485 is approved. The only excuse is the AP. I wouldn't take my chance.

And talk to a lawyer! The people from this forum can help you, but not all the way.
 
I dont think the law requires one to be physically present in the US at the time of I-485 approval. (It does require you to be present in the US at the time of filing I-485). Get an AP before you leave the US, and it would facilitate return to the US.

It is NOT TRUE. Both are valid to enter in US. AP is a general document & H1B is special. That's it.

In any case to be on the safe side i applied AP today... if i get it before i travel, i will take it otherwise use H1B to enter the country...
Can anyone take a guess on my case, 485 approval is pending, code on FP is "3", see signature for more details. anyone who applied in Feb 05 got the approval or it is rare to get one that fast,,iam just curious...

I am in the same boat, I have two days earlier FP than yours.
I am expecting if LUDs-I485 go normal, then adding 6 weeks would be reasonable for approval.
So thinking/guessing about 3rd-4th week of MAY -OR- First two weeks of JUNE.
But if everything goes fine, then it should not go beyond MAY.
USCIS knows better.

DEC-2001.
Then you must be celebrating anytime in MAY.
Note: Remeber sometimes multiple 'address-change' could delay cases. It is quite normal. If you are clear there is no reason to delay your FAST APPROVAL.

Hi jarkhandi,

can u please guess my 140 timings and EAD timings, when can I expect them.

My case is at vermont uder EB2.( i am BE with 7 and half years experience)

My Notice dates for 140/485/EAD/AP are 28th Feb, 2005 and receipt date is 23rd Feb, 2005.
I gave FP on 04/21/2005 and LUDs I see for me and wife on 04/21 and 04/22 without any message change.

I don’t know! What is happening?

I'm happy to let you know that my husband H1 got approved for 3 years(8 & 9 &10 )..I think now they are giving extensions for 3 years even after 6th year ..Just got a mail from our lawyer..
So my husband can now go to India and return on FP and still work on h1(since its already approved and he is still working on H1 at present) ..Please correct me if i'm wrong..

In this case, AP should primary option. Because after extension he/she has to get it stamp on the passport oversease, kind of a tough and lenghthy process now-a-days, as heard. DO NOT LINK EAD AND AP, in this situation.

He is all set...he can now travel and come back on AP and still be on H1B.

PS: We will be more happier when we hear that his I-140/I-485 (and your 485) is approved.

His I140 got approved in the last month itself..and we have finished our finger prints and mesg got updated..just waiting to get our PD date current(Feb 2003)
