China does not move at all either. This below is what immigration-law.com has to say (emphasis mine). It just doesn't sound really good. I have colleagues from China who have been waiting for their PDs to become current, and we are very concerned. Meanwhile the situation for worldwide is far better than India and China, but I'm worried about my spouse's case.

* Visa numbers for March 2007 are disastrous.
* EB cases: For all categories and all countries, not a single day has changed from February bulltin. It predicts that little, if any, forward movement in the EB-3 is expected in the near future. It also predicts that according to their recent discussions with both USCIS and DOL, the demand for numbers with pre-August 2002 priority dates is likely to be extremely high in the coming months as both agencies continue to work on their backlogs. This could easily cause a retrogression of the current EB-3 cut-off dates, should that demand begin to materialize at USCIS duringthe spring and summer months. Alas!
* For family cases, Mexico FB-3 retrogressed from 01/01/95 to 08/01/1994, and Philippines FB-3 retrogressed from 02/08/1991 to 09/01/1990. It predicts that further retrogression or unavailability in future months cannot be ruled out.
 
File WOM

Why don't you file WOM? I know someone with only 45 days past current processing date and he filed WOM and got it approved within days. This happened earlier this month. I am also thinking of WOM as I am almost 90 days past due now.

I think you are wasting your time by not filing WOM. Just like I wasted my time stuck in Philly BEC and not filing PERM. A year later I realized to go for PERM.

Online EAD renewal

My lawyer charges $200 per EAD application - so $400 for my wife and myself. I am thinking to file EAD renewal online. It seems really simple. Anyone wants to share the online EAD renewal experience? DO you have to do FP again?

This is what is happening now. Me and wife just went through it. You will get approval next day after FP. MSC sends the FP notice but the approval will come through your service center (TSC?).

In my case the EAD start date was much before the FP date. Although in end I do not need to use EAD due to my GC approval.

So, do not panic. Get the FP done and you are all set.

Hi,
I contacted the local congreeman office and provided all the documents to initiate inquiry for the name check pending.

Do you guys know whom should they contact first?. I mean do they need to send the inquiries to FBI or TSC?.

The congressman office people they are not sure about it.
Any help is appreciated.

Just saw an LUD on my case, nothing changed on my wife's case. Hope this is what we have been desparately waiting for.

maybe the lettet that u sent to ur congressman and his interference with USCIS had its effect. he was maybe right when he said in the letter that u may hear something from uscis between 3 to 60 days. u will know the right answer tomorow or after tomorow. good luck.
 
Don't file online

Even if you file online, you still have to mail documents to them. Sometime they are not able to match the documents and will issue RFEs. I know two people had the same problem.

On the other hand, I filed my EAD myself through mail and got it approved without any issue. Don't pay your lawyer and file before fee increase in April. Only bad thing is that you have to wait for your receipt number. If you write personal check and your bank shows you image online, you will be able to get the receipt number that way. So my personal advice to you is to file the application through mail.

I am also past their processing dates and stuck in name check. My friend in FBI gave me advice to wait for 1 year past processing dates.

what kind of advice is that?

I'd expect something different from an 'internal' guy.

Wait one more year past processing date... then what?

As someone above recommended, I would not recommend filing I-765 online. I personally filed 5 I-765 applications (2 for myself, 2 for my wife, 1 for other). Whenever I filed I-765 online, it caused some issues. I think this has something to do with matching the online information and the mailed supporting documents.

I would ABSOLUTELY file a I-765 application via mail. Applying via mail is not difficult at all, either. You also can check whether your application is accpeted by TSC or not by seeing your check cleared. This online filing only benefits USCIS staffs with reducing typing and, still, they are not doing good. So, no reason to help them for nothing.

One more reason not to file online, you need to do FP even if you already did a FP for your I-485. For mail application, you don't need to.

Infopass and follow on

1. During the Infopass appt, does the immigration officer log the concern you bring up or just reviews the current state of the case?

2. Does this meeting in any way, trigger a check within the process to request for an update from the other agencies. More specifically, does the immigration officer send a note to the FBI asking for a status update? Any experience to share?
 
If its a renewal, do you still have to send documents and/or pictures and do a FP?

I remember someone here mentioned a similar thing quite recently. If I recall, to make your WOM effective, wait one year, meaning half year past the processin date (my dim damn memory remembers NOT one more year past processing date, but I need to dig out the post to be 100% positive...) or something like that. The point sounded like filing WOM immediately 30 days or so after the processing date is not a good idea. But I too would like to know if that's true and if that means there is any unwritten, internal rule or anything like that which is unknown to us.

traffic violation

is traffic violation get NC name hit.
I had a speeding ticket for 75$ and i nearly got a ticket for traffic violation however officer did not give me a ticket.
