It will become a total disaster if it is true....

And it was started after this 9/11 anniversary.

I was also told that this week _F_ _B_ _I_ and _U_S_C_I_S_ have asked all congressmen not to initiate any inquiries about _F_ _B_ _I_ name check on behalf of applicants.

Let's hope for the best but ...

It means that people who's stuck with NC will not be able to do anything here. So, no meaning to file EAD. No work for several years. Practically it is ridiculous. USCIS should just prohibit filing I-765, then. Accepting applications and not allowing I-765 for the same reason (NC) of I-485 is totally ridiculous!

The reason of recent delay for I-765 was expected. Everyone is getting their approvals around or later than 90 days (as you can see from my renewal case). However, if what you're saying turns out to be true, it would force a lot of people here to leave this country. It will become a total disaster..... I personally don't want to believe it...:(
 
Document Mailed to applicant

Can anyone advice what this means ? My 485 has been pending since Aug 2005 and my status also changed on Sep 11 from pending to Document mailed to applicant. Does it mean the case got approved or something else. I have already done FP 2 times, and my address has not changed. I have been checking my mail daily and till today saturday i do not see anything in mail. what could this be ? i m goping nuts, anyone, please advice if they got in similar position. thanks
 
Change job before 180 days - need advise

I have received my EAD card in June '07 and my H1B will expire on 10/20/07.

My I-140 was approved in May '07.

My I-485 was submitted on 6/14/07 and according to CIS the RD is 7/13/07.

Now, I'm thinking of changing my job in November '07.

I know I have not passed 180 days yet after submitting my I-485, am I at any risk?

Please advise.

I think if your employer withdraws the I-140 you will be at risk of getting the I-485 denied. If 180 days passed you can benefits of AC21 .

I agree I should not switch before 180 days, but if I-140 is approved, can my employer still withdraw after the fact?

Also, how should I count my 180 days? Should I count from the RD per CIS or the submission date?

I don't have more info. The safest thing is to wait for 180 days ( and also I-140 must be approved before switching ) . I think the 180 days starts counting from RD. I haven't researched much about this. You may visit some AC21 threads.
 
I-485 approved

I-485 was approved almost an year's wait.
The card was also received.

Hope it works out fine for everyone waiting.
 
So, let me ask. From a security perspective what kind of jobs are not not offered to EAD holders ? I wish the USCIS give GCs if all other security checks are OK and let the namecheck investigation go in parallel. If the namecheck investigation reveals something serious, cancel the GC and apprehend/deport the applicant. I don't think canceling of GC is complicated ( compared to revoking the citizenship ). This will obviously mean revenue loss to USCIS ( because no more the multi-year need for EADs, APs etc) , but they should not wish for blood money as part of their revenue ? Shall we write to Ombudsman with this terrific idea ?

I think if they are going to scrutinize EAD, they will do it for H1B as well. Because both allow to work for temporary period of time. I hope the new check is some other fully automated check and not the namecheck.

In just one year the problem of the backlog will be solved, since every one stuck in the name check will have to leave
 
Dear fellow long-time GC waiters,
I believe many of us want to know if our NC's are considered for processing at all or if a decision has been made to force people out by not processing their cases and not renewing their EADs at the same time, and this is how to reduce the backlog. I suggest that anyone who (himself or knows someone) had been stuck in the NC for, say, more than 24 months or so let the community kindly know if he/she have recently, say after September 1, been cleared and approved. So that the rest of us could get a clue on where is this situaton heading.

That is the case for last 1 year for Muslim countries and Muslim names (male). It practically takes 1 month to 2 years. USCIS Official time is 1m to 6m. But my friend is stuck for almost 2 years when he went to home country last year for getting married.

Maybe I didn't express myself clearly. The US consulate have statrted to initiate NCs on people who'd like to go to US for sightseeing, for a week or so. That's how I was told. and this is NOT a muslim country

In the last conference call to Ombudsman, one did mentioned that the Consulate processing cases name check gets cleared with in 60 days irrespective of country limitation. Mr. Kathri seems to agree with that point and said that is discriminatory.

This is absolutely wrong the consulate NC takes 2months max. I know 100s from murthy and other visa renew group who got their visa stamping after 3 months even 6 months in different conulate at Canada(H1B stamping). NC has no connection with visa type. They can initiate for 1 week tourist visa or H1B or L1 etc. What i'm understanding here is it is becoming mandatory.

Well, again, it get's cleared in 60 days if ONLY it gets cleared but not gets stuck. if it's stuck the 60 days may well become 60 months.
