TSC Consolidated 485 Tracker

Hello Gurus,
I need your help with this, my labor was filed on June 22 2002 (EB3, other countries), approved on 10/25/2006. my I765, I131, I140 (regular filing), I485 filed on 11/16/2006. I131/I765 approved on 12/14/2006, EAD card recieved on 12/08/06 valid till 12/08/07. I140 approval notice received on 04/20/2007. my questions are:
1- when should I file to renew my EAD and AP?
2- when can I change job?

any input is highly appreciated.

1. You should file your renewal application for EAD or AP at least 90 days before the expiration date. Previously, if 90 days passed from the filing date and the EAD application was not processed, you could go to the local USCIS office and get an interim EAD but since a few month ago, they don't issue interim EADs any more. Therefore, if you are on EAD, in order to make sure you will always have a valid EAD, file the renewal application earlier than 90days to the deadline.

2. If you have an approved I-140, you can change your job 6 month after your I485 has been pending. You can do this through AC-21 (some act which was passed by the congress in 2000). Look for AC-21 in this thread. I posted some links to the actual USCIS memorandum on this a while ago.

When did you get your REF
 
10/27/06, I have all my info in my signature. :)

Hmm. That ruins my theory that REF comes only after everything is cleared.
My assumption is that they wanted to preadjudicate your file and during that they raise the REF. So you will hear from them only after NC is cleared.
Is there a way you can find out if they have already preadjudicated your case?

Hi,

It has been preadjudicated. The TSC officer that I talked to on the phone told me that my application was processed but they were waiting for my security clearances which were not received by that time. I wonder why they don't reply to any of my official inquiries!
 
What could be the expectaion?

My PD is dec 13 2002.

I140 Approval Date : 4.28.2005
I485 receipt Date:Oct 26 2004
Originally filled with Vermont.
Later Moved to Texas.

I am very new to this forums...Can any one help me how to analyse trend?
When can I expect my 485 Approval?

Reddy, I have the same pattern as you, applied in 2004, case transferred to TX in march and did FP code 1 2 months ago, they sent me a notice 4 days ago and when I called they could not tell me what's in that notice and the website still reflects the status that my application has been transferred to TSC

What notice you received from USCIS? I-485 approval??

Your company should transfer your H1-B, there is a routine process for that which I am not fully aware of. There is also a premium processing option for that. Again I emphasize that in order to keep your old I-485 going, your I-140 has to be approved and the 485 has to be pending for at least 6 month.
 
What notice you received from USCIS? I-485 approval??

I still don't know, didn't get anything in the mail today yet. I am hoping it's the approval otherwise i am gonna start packing
 
Does anybody know how many times we need to take finger printing? What is the meaning of CODE 1, 2, 3 for FP? Do i have to take another FP after CODE 3 then, CODE 2 and CODE 1?

How long i have to wait to get GC after giving FP CODE 3?

Received Green Cards yesterday. Three days after receiving e-mail from CIS about mailing of my cards. But the approval letters are still in the mail.

Congrats ! Seems ( based on a few posts in forums ) applicants from Bangladesh get faster I-485 processing. Do you guys in general have very unique names ?

It doesn't matter..The name doesn't make sense for FBI checks, even people from Pakistan get faster approvals once filed 485 (within 6 months) and they do not have the names which FBI should not be worried about!!!!

FBI spends more time 1-4 years of India and China for Name check, No reasoning at all, eventually FBI name check is an excuse to delay the approvals of 485 for few countries; Look at recent statistics... EB3 which are almost 2 years later than EB2 are being cleared, I should have not added myself to EB2 (waste of 2 years doing Masters in USA), if it was EB3 then they use to clear the labor within one year (most of them) and for EB2 they took 3 years to clear the labor...

now add another 3 after labor for FBI name check

conditional welcome notice

My husband and I finally got our GC approvals last week (EB-3 category). Our PD was Dec 2002 and the I-485 was filed in March 2004.

However, when we received our welcome notice yesterday, I found to my surprise that it says something about our GC being "conditional" and that it is valid only for 2 years after which we have to apply to remove the so called "conditions".

From what I understand, "conditional GC" is issued only to investors or family based applicants. So, it appears to be either a clerical error or just a generic message. Has anyone else encountered this for employment based cases. We have not received our GCs yet, so we are hoping that it is a clerical error.

Here is the verbiage from the notice:

Welcome to the USA...blah..blah..

"your new card will expire two years from when you became permanent resident. By law your resident status is conditional, and you must apply to remove those conditions before your card expires."

We are employement based applicants and from what I've heard the "conditional" stuff is not applicable to us.

Havent yet received my FP notice for me and my wife. I received my son's FP a couple of days back. The appt is scheduled on June 27th 2007. Anyway I need to take my son for FP appt. In the mean time if I dont get my FP notice, can I take my 485 Receipt notice and also do the FP for me and my wife at the same time.
 
'Conditional GC'

Now, some employers won't like what i propose below ( how many employers like the employee getting bargaining power ).
What about a "conditional/restricted" GC to applicants who don't have any other issues other than being stuck in background check. This type of GC should enable the applicants

1. To freely change the employer ( any location)
2. No restrictions on travel

Once the security check is cleared , the "full blown/ripened" GC is awarded.
How do you guys feel about this proposal ?
