questions

Hello Gurus,
I need your help with this, my labor was filed on June 22 2002 (EB3, other countries), approved on 10/25/2006. my I765, I131, I140 (regular filing), I485 filed on 11/16/2006. I131/I765 approved on 12/14/2006, EAD card recieved on 12/08/06 valid till 12/08/07. I140 approval notice received on 04/20/2007. my questions are:
1- when should I file to renew my EAD and AP?
2- when can I change job?

any input is highly appreciated.

According to USCIS online status, my (and my wife's) I-485 application is approved and cards are issued. That was quick.

I am a Pakistani national with arrest record (misdemeanor, case was dismissed). No interview. I hope this will help folks out there with similar cases.

I-140 is still pending :)

There are three security checks before getting a green card: 1. FBI name check, 2. FBI fingerprint check, and 3. USCIS background check. Everyone clears FP in a day if they don't have criminal records, so it is a non issue. So far most people who are stuck in the black hole are dragged by name check - not because how long the process takes, but how long it takes for FBI to get to the case.

Now the USCIS security check can indeed take a long time, but the probability is much less than name check. So from this perspective I'd rather be waiting in this process. As to what they do, I have no clue. But I think it is safe to assume that USCIS will check your previous visa applications, LC, income, etc.

Sometimes the FBI name checks come back and link fragments of a name with FBI files. Then USCIS will conduct additional review on your case. According to the federal codes, service center can withhold a case for up to two years. After that, USCIS can extend the withholding, 6 month each time. So, they can withhold a case indefinitely without violating any law. The federal district courts is barred to review their action under 8 USC 1252.

THere is still risk even FBI NC was finalized

... but what do you mean by "I-140 is still pending?" Are you saying you got an approval message without I-140 approval?

... but what do you mean by "I-140 is still pending?" Are you saying you got an approval message without I-140 approval?

I think his(her) 140 was approved for sure. However, online status may not be changed sometime. My 140 online status was changed after one month of the approval.
 
Stuck in Name Check

I did a InfoPass on my pending I-485 petition and came to know that my Name Check by FBI has not been cleared since USCIS initially initiated it in Sep'2005 (after I-485 filing in Aug'2005). So I guess for my self no luck this time (Jul-Aug) with my PD being current to get my GC.
 
Case pending at the transfered center

Does this message mean the application is stuck and waiting/pending due to Name Check/Background check? I am seeing many people with the same msg and name check issues. Some people have msg just "Case is now transfered to XXX service center" and no mention of Pending.

Am I reading too much from these msgs? Just a thought... Anybody to negate/strike my guess here.

awaaz, Congratulations on your approval. I would double and triple check the status of your I-140. An employment based AOS cannot be approved without the 140 being approved first. If that is the case, I am sorry to say that this might be an error on their part and instead of having them rescind the decision at a later time, its best to alert them to the fact.
They may actually have approved your 140 but for some reason or the other, the system did not reflect this. I'd suggest to ascertain this sooner than later.

What made you take an InfoPass appointment! I mean did you take the appointment just to know the status on your application or do you have any other reason!
Because I want to ensure that I am not struck in the name check.
 
Just a word of caution. In your infopass, never mention that you have contacted your local congressman/senetor for help, unless asked. They may refuse to talk to you about your case. I just wanted to share this experience of one of my freind. Thought it might help

Don't worry! I have seen many people getting their EAD and AP approved before their I-140. If you don't go with premium processing for I-140, it takes a few month. USCIS gives you the option to file concurrently in order to get EAD and AP but if 140 is rejected, you will loose those. If you have a solid 140 application from a good stable company, don't worry, otherwise, you might want to go thru PP and get it approved faster

Yes, I did InfoPass to know my I-485 currebt status, but mainly for Name-Check. I think if you are worried about NC then go for InfoPass.

Yes of course...EAD and AP approvals are independent of the status of the 140 (as long as its not denied), but the awaaz mentioned that he has his I-485 approved (not the EAD/AP) and 140 still pending. That is not possible. 485 approval is integrally tied into the 140 for employment AOS cases.

That is serious then ! He should look into it.
