this is not true. an indian guy here last week got his green card quickly. his pririoty date is very new. it is all about namecheck, but the problem that many indians and chinese get stuck in this trap. so your theory is not very true. once ur namechekc is cleared, you are done.

Are you from Indian or China? If you are from Indian then your situation may a little bit worse than Chinese. Also, the trend is all the approvals from cases with PD in 2002 or earlier, but vis-a-vis may not be true. The reason I say 'scary' is back log center will be cleared this fall, then all the mass will be dumped to CIS and all of them with very old PD.

I hope you are right, but you should not use only one or two cases to judge the rule in general.

honestly, the biggest problem now is the namecheck. it is an open ended tunnel. u can get it in 1 day or in 4 years. the uscis are fast nowadays in approving i485 as long as the namechek is clear, but the question when it will be cleared? it is a mess.

No intention to aganist you. However, I saw those cases from non-regressive contries get approval much faster than the cases from regressive contries. It is not uncommon to see the case from non-regressive contries get approved with Pd in 2005 or 2006. We only saw very very few lucky guys from regressive contries got approved in one or two months and among them a very very very very few with pd in 2005 or 2006. So this is the reason I think the people from Indian/China may have double problem -- waiting in the que for the name check and then waiting for the name check itself. I do not want my thinking to be proven as a true situation, that will be a holy nightmare. However, this is my worry..

i'm from a non retrogressed country and my namechek is stuck. i know other people from such countries and they were waiting for namecheck to be cleared for 2 years. so there is no rule my friend. it is a matter of luck.

Hi guys,
I don't see any light. I guess my question is not appropriate for this group. My I485 is pending but I131 AP is approved. I didn't apply for EAD. Have you heard of any issue travelling with I131? Didn't visit native country for 3 years. If you guys assure i'll forget about I485 for few months and will travel using I131. Please let me know. And one more thing ..if by chance I485 get approved when I'm outside USA, will the AP still be valid to return to USA?

This is not true. I observed significant cases with PD around 2004-2005 were approved recently. However, almost all of these cases had early RD (before sept, 2005).
I believe that the biggest problem for Chinese/Indian is the backlog of the FBI name check (too many applicants). The manpower in FBI for India and China case specialist were far from enough. No matter how simple and clear for our background, we have to wait a long time before a FBI agent pick-up our case to review. If certain concern is found, another long waiting …… What’s a nightmare.

it is not that there are fbi agents dedicated just for indians and chinese. they process namecheck from all over the world. so even if u r from a nonretrossed country and ur name is stuck then u r screwed. what a mess!
 
RFE on EAD

Finally, almost after 3 months of applying 485, 765, 131, someone touched one of my case, I 765.


Got an REF regarding special regestration... as I am from one of those countries whose citizen were required for that...

At least things have started to move...

sam2010 - could you specify what exactly your RFE states? Also, what is your RD for the I-765. I'm afraid there is a delay in my case, which hasn't been touched, for this very same special registration issue. It's really frustrating - you think they keep track of all the departures/arrivals on this issue since we have to register everytime.
 
My RD for 485, 765, 131 is 10/10/2006, two weeks before you... so you should also get an update soon... within the next week or so... I hope...

Since I am from an Asian Muslim country, I was required for special registration (NSEERS), which I did in 2002. They want a proof of that, although they have stopped it now.

Now I will send them copies of my old I-94s as they have a proof of that.

Thanks. I had to go through NSEERS myself which is why I asked. Have you left and entered the country since you registered in 2002? Meaning, are they only asking for proof of the last time you were registered or for all the times since they instituted the rule back in late 01/02. They have to register you at the airport and did for me when I last entered the country. At least they are looking at your case, which is good.

Has your I-140 been approved?

Indians,Chinese get stuck in security checks . Plus, out of the 140 k EB immigrant applications, how much given to china,India - 15% ?
So, when agencies say majority gets cleared fast they are talking about the 140 K applicants and not the 15% alone. If the agencies speak only of India,China it might turn out that 80% of them get stuck in security checks for more than 6 months.

the numbers that they give don;t make sense simply. fbi says they clear 90 % in 60 days . whereas uscis say it takes 6 months to clear almost 99%. but most the people i know who r not indians or chinese r also stuck in the name check. so these 90% numbers r nonsense. i would say 50 to 60 % r cleared in 6 months no more.

FBI name check is mainly checking the background in your home country. The investigators should be familiar with culture, political issues etc about your home country. I do believe FBI name check department may be organized by the region such as east Asia, middle east, Europe.
The understaffed investigators who are specialized in China and India caused the serious backlog.

Hi,
I visited USCIS office today morning. The officer was very kind and said that mine is "Under Review". I am not sure what does that mean.

I checked with him regarding the security clearance he said that looks fine. He didn't elaborate on that.

Thats great . Hope you will get a postive result very soon . Were you stuck in name check earliar
