I think a major issue is that policy makers (i.e. those working in US Congress or high rank USCIS officials) interact with business leaders and understand the needs and benefits of immigrants, especially EB with high skills. So I think the current laws are reasonable (of course there are rooms for improvements). HOWEVER, those who enforce the immigration rules (i.e. the people who read your applications in different Service Centers) think otherwise and make the supposingly straight forward and welcoming policies difficult and hostile to foreign nationals who are making significant contributions.
