TSC Consolidated 485 Tracker

I think a major issue is that policy makers (i.e. those working in US Congress or high rank USCIS officials) interact with business leaders and understand the needs and benefits of immigrants, especially EB with high skills. So I think the current laws are reasonable (of course there are rooms for improvements). HOWEVER, those who enforce the immigration rules (i.e. the people who read your applications in different Service Centers) think otherwise and make the supposingly straight forward and welcoming policies difficult and hostile to foreign nationals who are making significant contributions.

This is my feeling.
 
Nobody is denying the need to have stringent security measures in place to ensure the right people are being welcomed into the country. But fed_up makes the important point that while the measures are in good faith, the execution is poor and mired in randomness and bureaucracy. Why have legal aliens wait for years and years to get their applications processed while they are still in the country for the sole purposes of doing security checks? These checks should have been done before they entered the country. What amazes me is that people get stuck in namecheck for the citizenship phase - I mean, these people have already been made permanent residents and are valid, contributing, legal members of society - why plunge them into another waiting hole? The namecheck may reveal some bad apples eventually, but the fact that it takes 2-3 years to clear means that those bad apples are still able to stay in the country, which makes absolutely no sense. That does not mean they should do away with the checks, just that there are obvious ways to use technology to make it go quicker.

I guess, in the end, I'm just preaching to the choir here. I simply cannot imagine what will happen once the illegals are legalized (sorry, "put on a path to citizenship") and USCIS/FBI are flooded with 11 million additional applications/namechecks to process using the same technology.

Title is important and don't take any risk to jeapordize your 485, I want to move on also, since my company will merge sometime in 2007, willing to wait for 485....

If you wait you may jeapordize your 485 too because you do not know how long it will take to get approval and how long your job will be still secure.

I made appointment by infopass to see immigration official this Friday. I also asked my attorney send a query to TSC, which will be taken about 45 days for a reply

I called today about my case status. The lady is nice and helped me to put a query. I do not how much it will help on my case. She told me call back if I do not get anything within 30 days.

Good. You are lucky in sense, that your case has passed processing dates, and *officially* contact TSC, infopass etc..., so bottom line is you need to exhaust all options before considering changing jobs, risk exist in both scenarios, just pick up a scenario less risky, hope that makes sense.

My today's experience with infopass appointment was disappointed. THe local immigration offical just told me USCIS can't make final decision after the security check is clear. He can't help me anymore. I asked when the security started, the offical told me he had no idea about it. CIS had no control on the security check. He gave me paper for a note regarding national security checks. Nothing new on the note.

I too had the same experience in INFOPASS. After 4 weeks I called and another helpful lady put a case status request. But I do not think all these help. Basically the office or the phone attendant - all have very limited info. and are advised not to give much. The INFOPASS officer told me that in my case everything is fine. I doubt that they consumed all EB2-India visa numbers for the first quarter and are just waiting for more visa numbers. This is reflected in Jan. visa bulletin also where India-EB2 did not move at all. My lawyer told me this is not a good sign as the priority dates will get stuck before becoming unavailabe. I doubt by May- Jun 2007 - EB2 india will become NA. I am not from India - but in my passport place of birth is indicated as India and I am in the EB2-India queue - hindering others.
 
does transfered case have less priority?

i checked several cases before and after my receipt#.
many of them approved, lots of them not.
filed nebraska, receipt tx.

There is no movement for EB2 india in Jan. bulletin. Jan. is the new quarter and new visa numbers will be released and naturally there should be some movement. since there is no movement, this implies that there are enough pending cases which will consume these new visa quotas. Once these cases are cleared then only new cases with PD date after Jan.03 can be entertained. This is the reason, as I see, there is no movement in EB2 -India. You can expect more approvals in Jan and Feb for cases with PD in 2002. Hope this is correct.

I agree with you that the visa numbers should not be consumed all by now. However, what is happening to make them stop approve the cases? I worry if CIS sticks here for long and backlog center keeps approving those non-RIR cases which most of them are very old, and more and more cases will pile up on CIS tables, that will be another chaos! Are we going to have another nightmare?!

Hi 2getgc,

It is very disappointed. Did that officer tell you that your security checking is done? This is holly a stress situation. I really worry what is going on in the CIS now. Why there is no approval recently? How long are we going to stick here?
