but u know i was out of status and i am I 245 section case. wht would u advise? interview itself had NO problem other than stupid name checks.

Thank you for replying so quickly. Look you are so close to the finish line so dont take a risk. i am 99% sure that they will not let you return, so my advice to you would be to wait. I know it is hard but this is your only choice.

Good Luck and keep us posted. I know this is a hard time for you but like they say This too shall past.

Really this is very bad...after waiting so long this kind of incomplete results. Congrats and sorry Adnamj...I can understand your situation...
Adnamj- Still you have to apply for the next EAD or no....?

I got a reply from FBI for my wife and mine NAME CHECK couple of months back that Name Check was done for both of us last year and was sent to VSC before transfer even then our case got transferred.. Since our name check was done ... do you think still there are chances that they can ask us to wait for this even after Interview (if we get through by mistake/by chance))

Thanks

thanks woderfulboy!

my EAD is good till sep,2005.........hope i dont have to apply again.
glad to hear that FBI cleard ur name , which is pretty normal VSC dont transfer unless ur FBI give them clearance. But name check pending after the interview is a whole differnt thing that has nuthing to do with FBI , FBI is fingerpronts WITHIN the states , name check goes to secret agencies like IBIS and CIA and many many other agencies sometimes it goes to your country of birth and consulate do name check for INS. it just started after 9/11 . it can take 4 months to 15 months .
feel free to ask if u have any question.

wonderfullboy

It doesnt matter that if the name check was done earlier and clear..

The problem is that name check results are good only for 35 days.. If the officer who requested them doesnt check your file in 35 days or you have your interview in those 35 days, then its no good and then the check has to be done again.... Its a vicious cycle.. Thats why people are stuck in this for 4 months to 1yr + sometimes...

Yesterday I faxed a letter to Senator John Warner's office for initiating an inquiry on my case because as "wonderfulboy" mentioned earlier in this thread that inquiries are initiated only if case has been pending for over 7 months. I know this would be of no help but trying to shoot in the dark.

Anybody had any experience interacting with Senatory John Warner's office?? Kindly post if any.

SWaiting

this is an other intersting thing of 35 days . but my finger prints were done 7th of oct and interview on 25th , i still doubt it that FBI clearnace and name check after the interview is same thing .

wht do u think how long it can take for my approval letter to come by. any guess? and also does anyone know abt the exact date of move or i shoudl say when they gonna function in new office , i could have hopes of early letter but as she said , she was going on vacation for two weeks , means she wont touch my file for another month .
one more question , will she be the one approving my case after name checks or she already put my case in the pipeline and approved from her own end , and waiting for name checks ?

I think whatever she had to do ...already done and completed..as soon as they receive your name check report will send an approval immediately. I don't think she is going to hold it till she comes back. She would have been done on the same day to close your file with her final remarks...otheriwise she will have to remind herself to do that which she will not like and also she can forget ...

Yes 15 months. Medical 18 months. But not sure about Name check.? Some says 35, 45 days or 3 months or they do once during I-485....Thanks

Hi Friends,

People are confused about our name check process. After going through some people's experiences in the interview relatd to name check (i saw they mentioning that stamped has been delayed because name check is not cleared) last week i initiated to send email to FBI office and also called them after sending email. They asked me to send an email. I said i did that already. Then they said i have to wait till get the response back. When i asked about the time frame for feedback the representative said there is no clue how long they will take.

So what i mean to say finally is i am still not sure whether mine and my wife's name check is completed or not? Waiting for the response.

Meanwhile i am in touch with Senator George Allen's office in regards to finding the status related to my case that's being transferred to local office. The representative did send me an email yesterday that "She has sent an email to her contact in washington dc office about my case status. Will send me an email as and when she get the response".

Let's see what kind of response do i get back from the senator's office. It's already more than one month.

Regarding Senator John Warner's office i spoke to Immigration specialist initially when case has been transferred. The specialist said that usually Washington DC office will take around 6 months to schedule the interview. She asked me to contact after 6 months is completed in my case. That is what my experience is.

Did any one whose case has been transferred to washington dc office after september 2003 received interview letters?

I have attached the VA transfer spreadsheet that should tell give you the answer to your question. There are a bunch of folks who received interview letters but again there is no order in which those cases were processed.

Could you please share the email adrees of that lady from senator Allen's office. I am also in touch with Senator Allen's office about my case but I don't have her email address. I only have the phone number and the fax number. Thanks.
