I made Congressmen inquiry, TSC comes back saying its pending. Is this valid as the primary is approved and the derivative is not adjudicated though the security check is cleared, I mean there is no reason why it should be pending.
Well, that's why this thread is running... seriously, we would expect that normally the primary/derivative(s) will be approved at the same time. But technically that does not have to be the case, because each I-485 is independent, whether it's the primary's or derivative's. They are reviewed independently, and adjudicated/denied independently (except that the derivatives' approvability depends on the primary's).
So, take my own case for example. My spouse got approved seven months after my own approval. There was no issue whatsoever with her case. Her security check got cleared last October and her case was "preadjudicated" when we checked in early March (but probably since much earlier). There was no real reason they had to hold her case. But they did. So there must be some other factors into the equation (in our specific case we suspect it had to do with DOS being stingy authorizing numbers first half of the fiscal year).
I know derivatives waiting longer than my spouse.
I went to info pass the lady says she has no idea why mine is not approved and she sent a email/inquiry to TSC to look into the matter where the primary is approved and the derivate not. So the info pass is useless?
I am not sure what you mean by "useless." Infopass officers don't have power to expedite, let alone adjudicate, cases pending at TSC. But it is a good thing they sent an inquiry to TSC anyway. You should definitely keep track and ask for a response.
Is my visa number is still subject retrogression? ( I mean once the primary is approved, dont they have to adjudicate mine?). Basically can they say 'yours is not current'?
Yes, it is.
Finally what do I do now to expedite my adjudication?
There is no real way to do that, unfortunately... all we are trying is writing, calling, to every people even marginally concerned. Ultimately, there is WOM (you can search it in the forums here).
But if everything is clear with your case, then hopefully you may hear good news by the end of the fiscal year (CIS does not want to waste numbers).
