california_gc,
csc_pawn is talking about working part time on nights and weekends. I think it is Ok to work part time on EAD, and stick to H1 on the full time, it is a problem only if you shift full time jobs when 140 is not approved.
What's the worst that could happen if 140 is denied, he/she would leave the part time job and would still keep the full time job on H1.

Exactly!
It is my understanding that you can have a second job as long as you keep your full time job (8 hr/day) with the employer you filed I140.

I could actually apply to be contractor in CSC!! so I can process my own case :D

LUD for I-140 is 01/11/2005

One of my friends in my company has filed I-140 and I-485 cuncurrently under EB2 at CSC. His RD for I-140 and I-485 is Nov 10, 2004, and he has completed his FP during last week of Dec 2004. LUD for his I-140 is changed to-day ( 01/11/2005 ). He has not even updated anything with CSC like Change of Address (AR-11). What does it mean? Thanks

I got the EAD card today, but it is valid only for one year. I heard USCIS improved the process to give 2 years EAD card? Or they think under current progress, one year is enough to clear GC process?

Yes and USICS received it on 12/28. No updates after that.

OK thanks for the update.
I followed your discussion with Unitednation and he seems confident that your company should be OK for ability to pay.

NCFolk,
Have you got your FP done? I remember you had issue of PD indicated in your FP notice as your RD, have you got a chance to check that with your Lawyer?

The issue of PD in my FP notice as my RD is still pending but I am less worry about it since I saw some post showing there are some cases similar but the real PD was not affected.

Just give you the update of my case status:

FP is done on 12/29/04. I-485 LUD was changed on 1/11/05 saying the FP result is received and the case processing is resumed.
EAD was approved on 1/13/05.

Hi NCFolk,

>>EAD was approved on 1/13/05.[/QUOTE]

Can you tell me your RD or ND date on I-485?

I did my FP 12/30/04 and LUD was changed on 1/12/05.

Still not received AP/EAD.

Thanks,

NCfolk,
Have you receieved your EAD physically or it it was just the approval email that you've recieved. Also Could you please tell us your RD again Thanks.

wait140485,
What is your RD?

Update

Hi All,

Just check my status and learned that my EAD is approved. Case status states "On January 14, 2005, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready."

wait140485,
What is your RD?

Smk04,
I received the email first and 3 days later the card arrived by mail.

EB3 Subs Labor I-140 RFE

EB3 - Subs. labor (original labor file in 2001/early 2002)

I-140/485/765 applied together.
RD - 11/24/04
ND - 11/30/04

No priority Date appears on any of the receipt notices

RFE issued on 1/10/05
LUD 1/11/05

Lawyer says PD will be date of I-140 ? if that is the case then why the case was picked within 45 days ? do not know the effect of retrogression. ?

Whether PD is origianl labour date or I-140 date is in hot debat and no conclusion yet.

Your RFE is on I-140 or I-485? I believe it's I-140, which is not affected by retrogression. Only I-485 does if there is.

Joshi:

I am in the same boat as yours. But No RFE yet.
Wrt your priority date, it will be the priority date of the substitute LC. If that PD is prior to Jan 2002, your case is not affected by EB3 retogression.

good luck!
