Stuck in Name Check??? Let's track it

I was stuck with name check when I was applying for citizenship, I sent out my application on Oct 03, fingerprint on Jan 04, interviewed on Apr 04, was told that my case is waiting for FBI's response, then fingerprint again on Apr 05, almost 15 months after my first fingerprint. This week(JUL 05) I got the notice to take oath. That's why I guess my name check time is from Oct03 to Jul 05.

I sent letter to our Senator on Jun 05 ask for expedit my case for personal reason, they forward my letter to INS and the INS returned the letter through them said that they will give me an answer before Aug 05. I don't know if this letter helps.

I emailed FBINNCP on May 05, so I won't get email reply until the end of this year.

I think it is not a good idea to track I485 and citzenship cases at one place. If you look at subforums tree, this is supposed to be Immigration Visas (Green Cards)>I-485 Issues>General I-485 and Related Issues

Whatever happened with MD_Germantown is unrelated to the subject and makes it less clear what is going on with name checks for I485.

MD_Germantown should post his/her experience in subforum for citizenship.
 
dima, so i assume by saying MD_Germantown's case doesn't apply here, you mean FBI treats "natualization name check" and "485 name check" differently?
i have been reading around the internet about fbi name check back long. seems like FBI promised to clear all the back log in august 2005. does that apply to all categories or just citizens?

belle, where did you find the information. I appreciate if you can provide a few links.

My 485 RD was in June 2004. I don't know when my name check request was initiated. I emailed and faxed FBI in May 2005 for requesting the name check status, no reply yet. Got the FOIA reply in 2 weeks and I'm clean, of course.

How to check the status of the namecheck

Please anybody respond .....

how do we know whether my namecheck is cleared or pending. How to check the status of my namecheck

Only way is send email to FBI and wait for 4 or 5 moths. Will get reply for your mail about the status. Search this forum there hundreds of posts on this issue.
 
Still pending, what should I do?

I am responding to your email dated January 30, 2005, concerning your
name check status for immigration purposes.

A review of the FBI's Name Check Program database revealed that a
request from the U.S. Citizenship and Immigration Services (USCIS) for you
was received on July 10, 2003, and it is currently is a pending status.
Due to increased national security concerns, in December 2002 to early
2003, the USCIS submitted an additional 2.7 million name checks for
processing to the FBI. Although 99.8% of these cases have been finalized,
our efforts to complete the remaining requests continue. This has
delayed processing of other requests. You may be assured that the
immigration authorities will be notified at the earliest possible date upon
completion of this case.

Surprisingly even I have read about this backlog clearance thing.
Its mentioned on this forum somwhere......
One just has to look very hard. but no substantial proof to it.Unless we can quote the FBI website.........
 
Yes i have read about this in this forum. you can do a text search with FBI name check, read all the links.

but look at all the people that got cleared recently, we have hope!!!

I did talk to a congressman office liason yesterday. He said FBI hoped to clear most backlog by the end of August. My name check is still pending. Obviously this is not the case.
 
I hope it is true

I hope FBI at least try to clear most backlog by the end of Aug. However, when I call the name check main line this morning (202-324-3625), the lady told me she is not aware of any of the backlog reduction effort.

I intend to believe anything good. However, life is life.

Don't be pessimistic LCSilence, it is just the start of August now. There're 26 more days to go. :)

You guys are overly optimistic

There are some points to consider in the namecheck

If you have a "HIT" (you are confused with something else), it may take lots of time to clear. Because it will require actually finding a piece of paper, retrieving it from one of the 400-500 FBI offices worldwide and examining it. And there can be many and many papers like that for one case.

And think about that, what are they going to do if this specific piece of paper can not be found or is accidentally destroyed? Guess what, they can seat on it for an infinitely long time...3,4,8 + years. You name it, they'll drag it.

And you still think "They have 26 days" to clear all this mess?

It is even problematic even to sue them. Think, for example, my name is "Ffdsjfdsjdf". Now let us say, they have a piece of paper, that 15 years ago they spotted somewhere great terrorist, whose name starts with "Ffdsjdf....". That is all info they have in the computer. Then it turns out, the specific piece of paper with exact name and DOB is accidentally shredded. What the lawsuit is going to do then? I think it will lead to them administratively closing the case or outright deny it. What do they think they do????

They will sit on it until applicant goes away by itself.
 
totally agree

The bottom line is, "national security" is the paramount priority, nobody in the bureaucratic system wants to take any risk; common sense and sanity are thrown out of window. Individual’s right especially non-citizen’s right undoubtfully suffers the most. Ultimately the society will pay the price.

It seems you are against law suit action. The only bright side is: it seems everybody from 2002 or earlier are cleared.
