Stuck in Name Check??? Let's track it

Joining the club

Got results from senator about my name check status. As I feared, I'm stuck and joining the club here.

Great news :mad: . I'm feeling so freakin pissed at the FBI staffer who staffs the name check dept. and someone in govt. who is responsible for (under)funding this dept.

Well looking at the fellow name check stuck folks, it's probably gonna be a long wait. In the meantime I'll spend time researching how to (somehow magically) expediate it.

The info. I gave was got from several different threads at different forums (non-english forum). So it is hard to point it out. However, someone provided the instruction of how to file lawsuit by yourself as follows:

) read the writ of mandamus articles on immigrationportal to get yourself
familiar with the procedures: http://www.immigrationportal.com/showthread.php?t=194681&highlight=writ+mandamus

2) set up a pacer account at http://pacer.psc.uscourts.gov/ so you can have access to all the court documents of other cases.

3) go to the web page of the federal district court where you live, and log
into the electronic filing system using your pacer account.

4) search for cases that name Emilio Gonzalez (USCIS director) as a party.

5) identify complaints that best match your case, use MS Word legal pleading
template to draft your complaint based on the examples

6) file your complaint with the court ($400 filing fee), hire a process server
to serve copies and summons to all named respondent (about $100).

7) sit back, relax, and wait. you can use the pacer account to monitor
progress of your case. the government must answer your complaint within 60
days.
they typically will resolve your case before the deadline.

However, Lawyers do not encourage people who have applied for I485 and are stuck for less than 2 years to file the lawsuit, since if USCIS decide to go to court to fight against you, then it is likely you will lose the case (if stuck for less than 2 years). So far, most lawsuits I have seen were filed by people who have been stuck with name check for more than 2 years. Only one is less than 2 years.

The links you provided are very informative, esp. the ones about bringing a lawsuit against fbi/uscis.

But why is the recommendation of waiting for 2 years before filing Writ of Mandamus?? Do they really need 2 years to process a Name check?? Do you know of anyone who filed WoM after a relatively shorter time (say 1 year) and got his name check expeidated??

You inputs as well as other guru inputs appreciated.

Some lawyer recommended 2 years. I think it is probably because if it is more than 2 years since you filed I485, then even if USCIS goes to court to fight against you, most likely you will win. Otherwise, if USCIS does not go to court, then it's fine. If USCIS goes to the court, then you may or may not win (depending on how long have you been waiting). People are afraid that USCIS will choose some of cases where name check has been pending for short time and fight in the court - if this happens and USCIS wins, then it is not good for people who are stuck with name check.

I have seen only one case that got approval within 2 years, but I also did not see any case that has failed. Because he filed the lawsuit immediatly after his PD is current, it is not clear to me whether his case is approved because of lawsuit or because it's time to process his case. The reason is that not many people who have been stucked with name check for less than 2 years filed lawsuit so far. 99% cases I saw are stuck with name check for at least 2 years.

Hi Waitingclear,
Thanks for your information regarding WOM. I am in similar situation and I am stuck in Name check since Feb 8, 2005 so close to 1 and half year. Do you think I should wait for another 3-4 months and can file WOM? I am worried about retrogression in oct.

Stupid USCIS never updated my NC with their system even if FBI cleared it two years ago. What shall I do? :( :mad:

First, your PD should be current. Second, you should show that you have exhausted all possible ways to make name check cleared. I am currently collecting evidence of the second one - my lawyer sent AILA inquiry for me just now. If my name check has not been cleared within 3 month, I think I will file lawsuit.

Talk to some congressmans/senators. They cannot push FBI, but they can push USCIS. I contacted one congressman before - the one who handled my case says that she could not push FBI to finish name check, but she could push USCIS. As I remember, name check will expire after some time (several years), so you should do it ASAP.

I contacted one congressman before - the one who handled my case says that she could not push FBI to finish name check, but she could push USCIS. As I remember, name check will expire after some time (several years), so you should do it ASAP.

thanks, will try to get hold of congressman and senator. Of course I am thinking about getting USCIS director involved, at least I have to complaint about the red and tape system within the USCIS... wish me luck.

You really do not have to wait to file a lawsuit. 2 years wait is not a hard and fast rule.

Look at this thread:

There are a lot of people who filed lawsuit after 1 year. Look for posts by user named Xu - He/She filed WoM after 1 year of wait and the name check got cleared. Additionally no one had to face a defeat after filing WoM.

Anyway, even if you prepare for WoM - it will take you 1-2 months to prepare the application. By that time u would have waited enuff and your case would be just ripe for WoM.

I-485 pending since October 2002

My employment based application is pending since Oct 2002. I have recently sent a letter to the Ombudsman. Any idea how long it takes for him to respond. I don't know how to find out the Name check status. Please help.

From other posts - the reply generally comes within 45 days. Although be assured, ombudsman wont do anything useful for your case.

But good that you did it. If you are thinking of filing WoM, this will provide ammo for your case.

Since yours case has been pending for 3 years - it is high time that you file WoM.

does it make sense if I write letters both to congressman, senator, USCIS director and deputy director? Won't it create a redundancy? Or maybe they call me 'CRAZY'?
 
Should be fine - I only know that you cannot do AILA inquiry (through lawyer) and congressional inquiry together. I am not sure if it is useful to mail to USCIS director. You can contact several congressmans and senators at the same time. If one would like to help you, then it would be good - at least, the officer in the congressman office I contacted claimed that she can push USCIS. Tell them that your name check has been cleared, your PD is current, and you have been waiting for more than 2 years.

any idea how to do AILA thru lawyer?
 
I did my I485 through a lawyer, so I can do AILA through her. Since I have tried to contact 1 congressman and cannot get name check done, my lawyer offered to do AILA inquiry for me. I dont know how effective AILA inquiry is.
