Stuck in Name Check??? Let's track it

Good news!

My name check was finally approved. This is my timeline, in case it helps anyone.

---I-485 Filed - Feb 04
---Name Check filed March 04.
---CIS interview Jan 05, where I learned about the pending name check.
---Sent FOIPA request Feb 05. Got a "no records" response within a couple of weeks.
---Sent certified letters to Hardy, Cannon. Mar 05, and again a couple months later.
---Contacted Congresswoman April 05. While her office claimed they couldn't do anything to expedite the case, they did give me a case status (pending) very quickly, and gave me an update every 6 months. They were also the ones who informed me I was apporved.

It was around this time that the visa numbers in my category were used up, and later retrogression came, so I didn't do anything for over a year, knowing there was another bottleneck even if name check clears. The last visa bulletin was very close to my PD, which prompted me to:

--- Jun 19th 06, faxed a letter to both my state senators.
--- Jun 22nd 06, heard from Congresswoman's office that check had cleared.

Was it a coincidence? who knows.. I've read about a few such "coincidences" before, so I doubt it. I sent a "thank you" letter just in case.

name check got cleared after 2 years

Message from Sen's office:

A review of the Federal Bureau of Investigation's (FBI's) Name Check Program database concerning this individual revealed that a request was received from the United States Citizenship and Immigration Services on May 24, 2004. This submission was processed and finalized on June 21, 2006. The results were forwarded to the USCIS Headquarters, Washington, D.C
 
Does anyone know how much time the USCIS HQ takes after FBI says that the name check has been cleared.I received a letter from FBI that says that my namecheck was FINALIZED and results sent back to the USCIS HQ on the 29 May 2006.But when I contacted my service center to check if the y can djudicate my pending I-485, they have replied back saying that their records still indicate that the FBI name check has not cleared and that the HQ is reponsible for updating the name check status. IT has been over 3 weeks since FBI has sent them the results. This whole system is so damn screwed up. CIS blames the FBI for the delays and now that FBI has cleared the checks, I dont know what I will have to do to get CIS to look at the results.

Does anyone know how much time CIS HQ takes to update the status saying that the namecheck has cleared once FBi sens the results over??

I sent letters to congress person and senators in my area. I think only one of them really tried to push USCIS, all the others were just querying status.

3 months I guess. They are slow, don't you know :)
 
NC cleared after 20 Months and I-485 approved

Guys,

I have posted this in the main page but figured that I should share this with all NC victims especially. Thank you all for sharing your experience. It's been the greatest relief reading this thread while stucking in NC.

FYI, I got the magical emails today, for my whole family.

NIW
VSC
I-140 submitted 6/2004
I-485 submitted 8/2004
FP 3/31/2005
I-140 RFE 4/2005
RFE answered 5/2005
I-140 approved 6/2005
Got to know stuck in Name check 9/2005
Then Visa # retrogression
Called VSC in 2/2006 inquired NC status, answer was still not cleared
Inforpass 05/2006 regarding NC, answer still not cleared
Visa become current 06/2006, but did not hope for anything because of NC Pending
Today checked on-line status showed "Card ordered" for me and my wife, "approval notice sent" for my son.

I can't express how relieved I am, especially because I have changed job (under different service center), and my FP is just about to expire. Actually I changed my job last June, but my family stayed at the old address for a year. After I got to know my NC still pending in May we decided to give up the hope for near future approval and moved out our old home early this month. I feel that the information regarding NC are not accurate even when it is directly from the mouth of the CIS staff. I don't believe that my NC got cleared this very month after pending for almost 2 years. I guess the CIS staff probably didn't know if it was cleared but just gave an easy answer when I ask them.

I didn't do anything to expedite my NC other than two inquiries. So I believe no matther how slow it is the system is still working. Keep you hope guys. You'll get you turn sooner or later.

Now here is a question: I did notify the customer service center my address change in the end of May, but havn't got any confirmation letter. Now one month has passed, will they send the approvals to my old address or new address? if they sent them to my old address, it's very possible that it will bounce back to CIS since I have notified the Post Office my address change. In that case,will I be in trouble since they will find out my job change? Is there anything I can do to avoid this situation? Thanks a lot for sharing your experience and opinions.

How do I check if NC Initiated

My Name matches one of the biggest frauds of India in recent time... :)

I am pretty sure I will get stuck in Name Check because of that though the age difference between that guy and me is 10 years (approx). How do I find out if my Name Check has been Initiated or not?

Hi Guys
I saw on Cspan (house of rep) channel today (7/27) an amendement moved by congress man from NY Jerrold Nadler (D) for apprpriations discussions.
He mentioned excatly the things which all folks here stuck in Name check want to highlight. Including plight of people waiting for 2-4 years to get name check completed. As per him more than 130,000 name checks are pending with FBI and only 12 people work on it. Unfortunately the amendment was defeated. However some one from Congress said this is fee based process and FBI is simplly not chargin enough and it has been asked to submit a report by august n how it is going to tackle Name check back logs.
Folks from NY should appreciate the congress mans effort by sending him emails and asking him to continue to do whatever to get all legal aspirants justice.

Hope some thing good comes out for all of us.

How to apply for a name check

Howdy,
I read something in the news yesterday on how US counterterrorism branches secretly have been tracing all transactions between major world banks. They are suposed to have complete detailed information on all transactions they need to know of. As soon as I read this I got this revelation that I got in the namecheck by sending money to my grandma in Russia via Western Union. I mean, according to the popular stereotype, you get stuck if you have an arabic name. Mine is a tipical Russian, so it was a surprise for me to find out I was stuck too. I appologize to all muslim/arabic readers here for bringing up the issue of ethnic gender. So anyway, I think if FBI is doing this vast data mining, they probably have access to the banking data as well, and I think they must have gotten their hands on Western Union data too, because those guys pump billions of dollars abroad every year. So I think as soon as they see a Western Union record with your name on it, going out of US you become eligible for a NC. ;) WHat do you guys think?

I do not think so. My name is also typical Russian, I never have sent any money through any bank.... never ever any criminal issues in any country... not even a single ticket in my life... but I was still stuck in NC for long time. And I know other people from Russia also stuck for 3 years...
