search "fbi name check" in google, the second hit is the fbi name check wiki site. Guys, update this site so that it could become a central place for the information about FBI name check, including how to sue USCIS.

1. YES you have to apply for EAD if you plan to work only; if not - do not do anything, pending I-485 gives you valid status in US. If you want to travel you have to apply for AP (advanced parole) or use valid visa such as H-1 or H-4.
2. FBI do not respond to emails anymore (and faxes), only way to find out is to ask congressman/senator. Or, if you are lucky and your case is with local office, make infopass and ask.
3. PD has no effect on NC, of course if your NC is cleared and PD not current - no approval..
4. I had my PD always current and still was stuck in NC for 2.5 years....cleared maybe just cause my kid was turning 21...

My family based I-485 application has been stuck in namecheck since March '04. I have contacted both the ombudsman and my local congressman. My question is that if they don't help, what other options are left?

What does this mean?

Following up on my earlier post, I just recieved a letter from my local congressman stating that the FBI informed them that their name check program received a request for my name check on September 29th '05 from USCIS. The thing that I don't get it that my I-485 reciept date is Feb 23 '04.
My interview was on August 9 '05 and at that time the officer told me that my case is pending due to CIA security check. So why would they send the request after that?

Why would they wait that long to send the request? Can you guys help me understand this?

maybe it was 2nd request, in my case after interview in June 2005 they requested name check one more time in July 2005, while 1st was still pending...

Here is what local congressman's office told me:

"What USCIS says about your case is not necessarily what is really
happening. The infomation we gave you from our office on your case
is guarantted that is is what really happening. We confirm our infomation
thru 23 federal agencies.".

When USCIS says "your case is pending on the name check" could
mean simply... "your name check is not cleared yet because of
some reasons. We do not know whever that reason is. It's probably
FBI.". I personally think it's a flat lie.

Finallly aproval letter

Hi all members,

I just want to thank this forum. it was so useful to get my file approved.
After, I wen to the interview I had my second fingerprints taken, the office congratulated me and told me I was going to receive my cgreen card in 2 months. Nothing happened for 8 Months. I called immigration several months. It was time wasted it. I found this forum, and I went to Immigration with INFOPASS< i talked to an officer, she told me my file had been sent to records managment. She told me seh was going to call me to let me know what was the problem. In the meantime I sent a letter to ombudsman, the sent me a letter back ,a and thye told me it would take them 45 days to let me know about my case. I created also a portfolio at wwww.uscis.gov.
Finally, I received today an e-mail informing me tha they had sent me and aproval letter.I lost my $ since, I just sent my application to renew my EAD<

Finally I received my magic 485 approval emails after getting stuck in Name for 1 Year, following are my case details:
EB2 Category
Labor Priority Date: 08-18-2001
I-140 Petition Filed: 12-11-2002
I-485 Filed-after140approval:07-05-2003
I-485 Approval: 04-24-2006

I went for first fingerprinting in Dec-2004 and then after few months reading other posts and calling BCIS found that my case is stuck in Name-Check, after one year saw some change on LUD(last-updated-date of case) and called up again this time received a response that they are waiting for visa availability so their was some relief. Once my priority date was current I saw changes in my LUD and then in 2 months after priority date got 485 approval emails.

Another friend of mine found that his name-check was also cleared in almost one year (so some hope there) BUT now he is waiting for priority date.

Good luck to all - this forum has been very helpful.
 
I guess whoever got approvals are those cases from one of the Service Centers, right? Did anyone have any luck of getting approval from CIS local office after the PD became current? How long did it take to get approved after that?

I know she still will be covered by some 'child protection act', but congressman for some reason decided it is good reason and he contacted Baltimore office and they then sent FP notice to all of us... recently I was there, on March 16th, trying to find out NC status but lady officer was not willing to give me any info on that...and today approval letters came dated March 21st.

Hi compass! I am glad you finaly got your GC, I am new here in this forum and I have a some questions on your case, that is because my wife is doing her AOS in Baltimore MD(since Agust 2004, she went to USCIS for her interview, and told her, that have to wait for her fingerprints check out by the FBI), in first place you say that you contact your congressman so he could help you with your fingerprints;- Can anybody, even if you are not a USC ask for help to the congressman?,-if that is so, how can I get in touch with him? -do you have his telephone# or address in the which I can write a letter?, mi wife is been in the US for 11 years, I had to leave voluntary and wait until she gets her GC, our kids are here with me and have not seen her mom in the last 3 years, our only hope is a miracle from GOD. Thanks, I hope, I could get an answer.

I was frustrated while waiting for my security check to complete. But when i saw this forum i came to know i'm not the only one. I've applied for AOS last march and had my interview done last july. Since then uscis has been telling me that my name check is pending. I mailed for FOIP and got letter frm hardy that no records were found. I wish to know when was my name check initiated, but could not find the contact add.
