Hi All
I am also a victim of namecheck.
I got a email from my senator as well as from USCIS that I am stuck in FBI Background check.
Is FBI Background check ,namecheck?
My dates are current so I was hopeful of getting approval soon
My details are below

EB2 India
PD March 2002
I140/I485 concurrent filing June 2005
AP EAD Aug 15th 2005
FP and Biometrics Aug 22nd 2005

I think it's okay, someone just told me the EAD and AP only require some low level of security check. FBI Name check is the highest level of security check seems, pass that then get GC. sorry, I was not clear.

That's better news! But conservatively speaking, we have to prepare for the worst. So let's say:
about 14% of FBI NC cases ini in 2002 haven't been cleared;
67% of FBI NC cases ini in 2003 haven't been cleared;
91% cases initiated in 2004 haven't been cleared;
81% cases initiated in 2005 haven't been cleared.

Many people from the list got approved, and info was not updated. Some did update but later others used older versions of the table to continue.
I mentioned few times, that 'gegemon' and 'LCSilense' are approved a while ago and table does not show it for some reason. 'Steveva' left to home country and informed about this. Many others just did not come back to update (maybe left also).
From the people around me, I only know 'belle' showed up recently.
So it is possible that all 2002 and most of 2003 folks are approved!

I was wondering what´s the difference( if there´s any)between the Name Check at the Consular stage ( when we apply for the visa) and the NC to get approved the GC.-

Just curious how many of us stuck from March 2004 or before are family-based I-485 applicants?

Filed 485 on April, 2002. Ya, I mean 2002!!

It took 17 months for CIS sending name check request to FBI for my case. I got this "fact" a month ago when I talk with CIS officer in San Jose CIS center. No explaination what so ever. Amazingly, my wife's name check has been cleared by FBI in late 2002. I am the primary so we all stuck.

Lastyear, I filed name check request by myself and got FBI clearance letter in 10 days and it says "there is no records ...... and no inestigation interests in FBI....

Any speculation?.....

Can AILA help? The funny thing is I've been told that I am not the worst case in this law firm and my case are quiet common. Should I say F words to them? ;)

We regret to inform you that until the result is received the USCIS must suspend further processing on the case as well as the derivative. Thank you for your continued patience with this process."

I don't know who to believe, and what it means? Is my name check cleared or it is stuck forever.

I have a similar situation and would appreciate your views and thoughts about it:

I485 ND: 03/2004 (Concurrent filing as dependent to my Spouse) from NSC.
1st FP: 06/2004
1st EAD AD: 03/2004
2nd EAD AD: 02/2005
3rd EAD AD: 10/2005 (still valid till 10/2006)
2nd FP (code 2): 08/2005 (done)
3rd FP (code 1): 12/2005 (done)
I485 pending???

Fortunately my spouse (being the Principal applicant) got her I485 approved 03/2005 (card recd 07/2005). Finally last month (04/2006) engaged a local congressman to inquire about my pending I485. Got the response back from Congressman that my 485 is pending FBI name check. Query to FBI has been initiated by Congressman and awaiting response...

Questions:

1. Where did you get CSC email id... do u know what's the email address of
NSC? It would be of great help keeping it handy...
2. How much time did FBI take to reply back to congressman's inquiry about
name check in your case? I was told by congressman's office that FBI
takes approx 30 days to respond back to their inquiry... is that correct??
3. Is it true that FBI name check takes about 18-24 months in every case? Is
it a standard duration.... any idea??

Please refer me to the correct person/name/thread on this forum to contact for more specific questions.. Thanks again for your time...

Confused ... Need advice

Need some clarification........please help

My I-485 is still pending with out any LUD since 11/10/2005 (this is for address change), after that another one on 04/29/2006 for address change again, apart from this there is no LUD's, but my concern is we got a call from congressmen's office last week saying that our security checks were cleared and we can expect a welcome notice with in few weeks and after that our cards,again a call this week saying that "its our mistake, your application is still under process waiting security check clearance, sorry". after this we called on tuesday to VSC to findout whats going on they said everything is cleared, but when we called today they said its still pending. we got the same experience when we went to infopass first time they told its cleared and after a month its not cleared.

actually what is going on with our application, please need some advice.

I had sent an e-mail to FBI on Dec 16, 2004. No reply yet. Called the FBI no. and was told by the lady that they are replying to mails in December and asked me to wait for another 2 weeks before giving a call back.
What to do next ? Any suggestions.. Would local Congressman help here ?

I will suggest you to engage a local congressman to initiate your name check inquiry to FBI on your behalf. Infact I am facing the same problem and recently took help from congressman. FBI take congressional inquiries very seriously and reply back within approx 30 days.

Hope this information will help.

Hi Pinkie123,

Background check is different from Name check. Background check is done based on your FP by USCIS where as name check by FBI. Remember, if your stuck in Name check then your I485 wont be approved even if your PD is current. Hope this info will help.

If you have the letter from FBI of your own name check then you should take it to local CIS center in San Jose and show it to the Officer. Hope this might help... GOOD LUCK!!!
 
You can't file a name check request by yourself. Only USCIS can do this. You filed FOIPA - that's a different story and unfortunately the response to it doesn't help a bit unless you plan to file a lawsuit against USCIS/FBI

Name check status

I am wondering how we could get the name check status. I called the customer service center regarding name check status, I was told I have no way to get that information. Could we get some information if we have Infopass appointment with the local immigrant officer? Or, is it the only way to seek help from the congressman in the area? Thanks.
