Stuck in Name Check??? Let's track it

My internview was on 10/12/2005, the officer asked for RFE (my moms's tax forms for 2003), I sent the tax forms in November and never heard from them. So I emailed my Congressman and asked if he could do an inquiry for me. He emailed me back today saying

"It appears that your case is on its way back to the Vermont Service Center for reverification.

Can you please verify you address so I can make sure that the Washington Office has it correct?"

Now why would my DO send my file back to VSC. My DO is in Fairfax VA. I know this process is going to take another year or two because VSC is so slow. Has anybody been in a situation like this? Is this a name check problem? Thanks.

Check threads under VSC I-485 dealing with transferred to NY and Wash DC, people noticed recently that a lot of cases are being transferred back from local (NY, DC) to VSC, because of back logs at local offices, including cases where interview was done already. Maybe Fairfax does the same. Also when you have RFE, they tell they need 6 months to process and only then you can inquire (I also had RFE on interview).
I am under impression that cases transferred back to VSC are being approved soon after they reach VSC, so you may be close to aproval. I would wait couple months then call Natl Serv center and ask what is going on with your case, if your NC is still pending you may find out then...

Thanks so much. I will just wait as you said for a couple of months and then call or make an infopass appointment. Back to the waiting game, lol.

Namecheck nightmare

Gurus,

I have couple questions I am trying to find out. I would appreciate deeply if you can shed some light.

I received my GC in July'05. But my wife got stuck in namecheck and still nothing. She is not working and her EAD is expiring.

1. Do I need to apply for an EAD card? She is not planning to work at all. but we are planning a trip in August. Can someone explain that AOS status a little bit? Can she stay in AOS status indefeinitely until the GC without any problem?

2. Where do you send mail/email to get info from FBI? I would like to do the same.

3. I am the main applicant. Does that PD have any effect on this namecheck?

4. we are from Turkey. The retrogession does not apply to us. Does that mean in any way that we might get the namecheck cleared earlier OR once we are stuck in the namecheck, the nationality and the PD don't matter at all?

Guys,
This maybe a dumb question, but how does on find out if the case is pending or stuck in Namecheck? My 485 case is in Nebraska Service Center since Jan 04 and the case status has always been saying "Receiving 485 App and Pending" from day one. I've had 2 FPs and 1 biometrics done already in the meantime. Does a simple call to the 1-800 USCIS number tell you if your case is stuck in Namecheck?

This is a new thread, solely designed for helping out all the cases listed above. This thread is a start to build a Class Action law suit against the Corrupt USCIS organization. Please join us. We will put an end to this madness once and for all.

To all those people affected by the Immigration Laws of USCIS and it's short coming, we should stand together and fight this USCIS system that is designed to only make legal, law-abiding and tax paying people's life a living hell.

Start by reading the below mentioned link. It is easy to file a Writ of Mandamus or 1447b without ever needing a Lawyer and their expensive fees.

Join now and in 2 months you will be in better shape than you were before. And let's file a Class Action lawsuit. We need our voices to be heard and we need everyone on board. This time around we can have Rajiv S Khanna represent us and take it all the way to the Supreme Court and pass a law for treating people with legal status aliens who are getting their processing done in time and accurately. We can and will make this journey to our destination and with everyone's help and support achieve this task at hand.
