im planning to petition my mom and dad once i get my citizenship, I don't work, and I think my husband wouldn't sign any affidavit of support. I have relatives that can joint sponsor.

My questions are,

How can I file affidavit of support? .... we file our taxes jointly, but what if my husband don't want to be involved, how will i do it? (I have no income)

My relative will file affidavit of support, what does she have to do?

you must file an affidavit of support since you are the sponsor - it's not a matter of choice. Your relative will be a co-sponsor.
 
i understand that, thanks for the response, im just curious on how I will do it since I need to submit my tax form (with my husband's income on it), it will show our household income, and the other half don't want to sign anything..

my confusion is really when I do sign the affidavit of support, and shows our household income, and they are sufficient enough, will they still acknowledge the co-sponsorship of my relative?

another thing, my parents will be leaving with the co-sponsor relative.

Its so much easier if its just me and its my money, but my partner don't want to be held liable if anything happen, he's just that type of guy. To him his only responsibility is me and our kids.
 
It is quite understandable that he is fearful of the obligations of sponsorship. He may be concerned about supporting just the two of you and your children especially in today's economy.

You could also get a job to help with the family finances, and then you may not need a joint sponsor.
 
Going by the language of the I-864 form, it does seem that if joint tax returns are attached, even if not meeting the income guidelines, the spouse has to sign. I may have totally misinterpreted the language however.

Refresh my memory, if a joint tax return is used on the affidavit of support, do both individuals have to sign it?

Even if OP's husband is NOT okay with OP to use the joint tax returns, there is absoulately nothing her husband can do about it nor OP has any other choice because tax returns MUST be submitted. Besides, do not forget that those jointly filed tax-returns don't belong only to her husband; rather those returns belong to both parties as they are jointly filed and have both parties' signature on it even though only his income is there since OP doesn't work.

Having said that, OP has no other choice except just to submit those jointly filed returns along with form I-864, with or without her husband being okay. She is equally responsible and entittled for those returns as her husband is.

Nevertheless, in a case like this one wherein only one person's income is used out of jointly filed income tax returns to meet the income requirement then the sponsor (the person whose income is going to be used to sponsor the immigrant) must bring W-2s or last 6 months paystubs to the interview so that adjudication officer can evaulate the income of the sponsor. In this case, OP doesn't need to worry about W-2s, paystub or anything because her income is not going to use to sponsor her parents. Besides, she doesn't have any income because she doesn't work. All she needs to do is- attach the jointly filed income tax returns along with Form I-864 in order to sponsor her parents but she must write an explanation letter along with to state that only her income she is relying upon to sponsor her parents as far as jointly filed income tax returns are concerned. And then she should also mention that she doesn't have any income because she has not been working being a housewife. Further, she must need to get co-sponsor for her parents. This will do it.
