Wow. What a speed? Two month's work is done in 17 months. If I work like that I would be out of job within weeks. Since we do not have voting right, no one cares for EB petitions.

09/27/02 04/01/01 - it took them just 18 days to process 2.5 months applications

11/15/02 08/01/01
11/01/02 06/17/01 it took them just 15 days to process 1.5 months applications in this period

11/15/02 08/01/01
01/01/04 09/06/01 - it took more than 1 year to process 35 days of application received in this period. If the INS Director says 97% applications passes security check ,why this much delay .Whether USCIS is accountable to give correct information or not.If they process application in a range ,why can't they give the range.Why new cases are taken before old cases.Etc etc etc

I'm looking at the data and for some months, the RD actually went backwards! Is this possible and logical? How does the USCIS manage to turn back time. How does one use the posted processing dates if they are random?! Ah, the wonders buraeucracy.

They will have an answer for this. May be they will say we approved them and again checked their backgroud for security.

OK, here is the past CSC I-485 processing dates. I got most of these from http://www.fragomen.com. Looks like they fell into deep coma starting from the beginning of last year, with only 1 short awakening:

Maybe I am missing something, but your data doesn't seem to correspond to the government data posted HERE. (where is is saying that they are processing 01/31/2002 as of 03/04/2004)

OOPS! Never mind - I am looking at Vermont data. :(

one year for Aug 2001 cases

These dates show that for entire 2003 (Jan to Dec), they could not finish just Aug 2001 cases. One month of cases in one year. With that speed, they would have taken 20 years to clear backlog.

This is a strong proof of wrong priorities and manpower being used for cases other than EB 485, with no justification. This has nothing to do with security checks, but is a clear case of an in-efficient government department who cares nothing about legal, tax paying highy educated professionals.

This data should be used against USCIS.

My apology if this fact has been pointed out earlier in the discussion forums or not. I would like myself and everyone to get Rajiv’s opinion about this seemingly misrepresentation of the facts. As if I am not mistaken, we (all immigration beneficiaries) are USCIS’s customers and are entitled to fair and accurate representation of facts. Any false representation is against the law.

Here is my point. On Feb 2, 2004, USCIS claims that “Today, and each business day, USCIS will: ” … “ issue 20,000 green cards;” Please see last paragraph in this link:

32 days later, they say that “Major volumes of pending cases at the end of January 2004 include: 1,984,710 I-130 relative petitions; 1,236,226 I-485 permanent resident adjustments; 639,198 I-90 Green Card renewals/replacements; and 306,059 I-765 employment authorizations.” Please see last paragraph in this link:

Even if we add 1,236,226 I-485 and 639,198 I-90 Green Card renewals/replacements, the total # of green cards are 1,875,424. With a rate of 20,000 green cards the entire backlog should be cleared by end of 94 days from Jan 31, 2004 i.e. May 5, 2004.

Rajiv, unless I am missing anything here, we all know that is not going to happen. In fact, USCIS is nowhere near to this magic number. Can we use this false representation or advertisement in support of the lawsuit?

Not directly. The focus is on delays, so far. We could mention something like this in passing.

Green card is issued for future employements and not current. Then why the applicant's job status at the time of 485 adjustment (say after 2-3 years of filing ) matters at all?

USCIS must consider applicant's status at the time of "6 months after filing 485" and not "the present one". If applicant was legally employeed that time and met all requirements, then USCIS must grant the applicant and his/her family all the immigration benefits and lawful PR status.

If USCIS agrees to this, then most of the applicants can sleep peacefully right now. It won't matter much if backlog is reduced quickly or not and whether one works in hi-tech company or a small grocery store to support his family in this shaky job market. Let USCIS sit on the case for 4-5 years and keep doing repeatitive checks. Who cares?

We do care! We care about the process itself, the GC, the RFEs, the Security checks, the whole immigration process.

That is what the lawsuit asks for - 485 decision in 6 months, no RFE afterwards unless it's security related.
