Settlement Memorandum Sent

Just curious, what power does this man have? What has he done since his appointment?
Also, as most of action core team members and old active members know,
the origin of this lawsuit is:
having written the petition to Mr. Prakash Khatri, the Citizenship and Immigration Ombudsman at DHS last summer.
We may give him one more chance to contribute us.

do the courts have the power to give interim relief?

not sure if this was discussed already - unlike the asylee cases or other cases where the plaintiffs might be still eligible for relief when the ruling comes, in the employment based cases if the ruling takes a year or more then the actual plaintiffs might have lost their jobs in the meantime and might have gone back to their home countries (say). so the question of approving the petition doesn't arise. bcis might play this trick i.e., drag it as long as they can. should a plaintiff be unable to get same/similar job deny the petition imeediately etc (well, may be i am exaggerating a bit but imho, bcis is capable of anything/any form of cheating/lie. afterall saying that they approve 20,000 gcs per day is a blatant lie). is there any protection against this? i mean can the courts give some interim relief?

Rajiv,

USCIS had sent OMB to reveiw the 2 yrs EAD validity.
But they have said nothing for AP.
Looks like they know our lawsuit and trying to avoid our settlement points.

Here is the link where it says that
http://www.immigration-law.com/

Also something about NSC center
God know how would that work out. Looks like they are buying out time

I read the link. What is OMB.

OMB: Office of Management and Budget.

EAD: The two-year EAD has been circulating for some time, before the litigation, as the possible I-140 premium processing.

Cinta,
Thank you for the info. Also thank you for the earlier info on security checks. I read that link also.

rajum, hello man! He is two levels down from Tom Ridge, reports directly to him; same federal level as the USCIS Director (I guess same salary?). he has power, not immediate, executive but he can reform Immigration through the Congress....
More is available on his position publicly..

I believe that USCIS director mentioned to the senator committee (this was for the hearing when they asked the director if Bush's policy was implementable) that security checks take only a few minutes. This was published on the CIS website.

Hi folks,

Silent lurker here...

As regards to above comment, I was surprised to see this comment from the director's testimony...
-----------------------
In the vast majority of cases (97%), the checks take only minutes. In the event of a “hit”, however, we will
move cautiously until the issue at hand is resolved, even if that means a delay and contributing to the
backlog. Last fiscal year, we processed about six million applications for an immigration benefit.
Approximately 7% of the applications processed resulted in an initial security hit, and after further
scrutiny, 2% resulted in confirmed security or criminal threat matches.
We make no apologies for our commitment to the integrity of the immigration system and we will not cut a
single corner, if it means compromising security, to process an application more quickly.
---------------------------

If the security checks only take "minutes", why has the backlog grown so much over the last few years????

Rajiv and all core team members, thank you all again for your efforts,

Now, some one posted this link below some time back,
http://people.cs.uchicago.edu/~stefanko/BCIS/index.html#foipa

that talks about a DV Lottery VISA issues and how USCIS actually never made an attempt to check the FBI for the security while at the same time telling applicants the reason for delays is security checks. Apparently they were successful in requesting complete file under FOIA. We can clearly see that at least in these guys cases, FBI(/CIA??) didn't take much time to get back on the request.

To quote the information there

Should we start to gather such data for some cases (may be just the plaintiffs), so that we can show the court (if/when required) that the delays are purely due to administrative mis-handlng rather than actual times FBI/security checks take? Do you think it will help?

Yes. Collect the data that you can. We will go over it and see what we can use.

Edison and core team,

I gave my details for being a plaintiff. When are you guys going to let me/us know whether we can be part of plaintiffs or not?

kadamtal,
Right now, the core team is just collecting the names and other info of the potential plantiffs.
In future, depending on the progress of the case, if Rajiv decides to add more plantiffs to the case, then these names will be considered.

EAD approval for 2 years

I am wondering if anyone here has received EAD approval for 2 years. I recently heard that few are getting approval like that. I have recently applied for renew of EAD.

National embarrassment

Dear Rajiv.

The federal district court in Minnesota ruled in favor of AILF's litigation on February 12, 2004!

http://www.ailf.org/lac/021304a.htm

Judge ruled on February 12, 2004:
The American Immigration Law Foundation hails the ruling of a federal judge today, condemning the former Immigration and Naturalization Service for "widespread," "egregious" and "plainly harmful" violations of law that "constitute nothing short of a national embarrassment."

This shows justice still lives here.

I have a strong intuition that your efforts will win.

Wow. What a speed? Two month's work is done in 17 months. If I work like that I would be out of job within weeks. Since we do not have voting right, no one cares for EB petitions.
