My lawyer almost screwed me, they'd received option letter on March 25th and *(&#@ sent me today with deadline of May 09th, My company has faxed that letter immediately. :eek:

I need to ask you guys that, fax is realiable ? or we should send both? cause in letter they indicated that either option.

Convert to RIR

gp111,

Is it possible to convert remanded case to RIR ? I heard that if your PD is before Aug 3, 2001 then you can convert it RIR.

My case detail :

PD: Aug1 ,2001 (filed as RIR)
RD: June, 2002
Remanded to state in July 2003.
I haven't heard anything from DOL after that. I am not sure whether my case is been BEC or not.

Make sure you also mail the letter (and keep proof of delivery). My RIR case has been closed!! because BEC claims that they never received the letter. My lawyer just sent a fax!!.

No question about it. Mail it in addition to fax.

Fax is fine but If I ware you I just send my certified mail & keep receipt for records.

Your Case should be with BEC now as all the SWA cases have been moved to BEC as of 04/22/05. BEC will process RIR & Non RIR in 2 seperate queues in FIFO & your case will be processed as Non RIR with PD Aug 2001. I am not aware of any procedure availabe for Non RIR to RIR conversion at BEC. My advice for you is Just hang on , you have already waited for 4 years wait for 6 more months & you will get your LC.
 
How do we make sure that BEC has successfully received letter and have not closed case, other than sent receipts etc.?

If the do not receive the 45 day response & decide to close the case, They will send one more letter to your employer/attorney to confirm that they are closing the case. It has happened to a few people on this forum ..

Unless you get this kind of letter, you are fine.

Did not find any cases certified on 5/4

I did not find any cases that are actioned yesterday (5/04). However, when I tried whether they were doing the skipped cases, I found following skipped cases were certified.

Yep, gp111 is right. I got a letter saying that they are closing my case as they have not received my letter.

substitute labor ??

Hello GP111 and Others:

Thank you for the feedback you guys are providing to this forum.

Brief about my case: Notations used below are….
XYZ = Current employer
ABC = My friend's company to use their Approved labor.


Currently, I am an employee of a corporation company XYZ in CA working on H1-B 7th yr extension visa status. My GC labor under RIR is currently with BEC Philly center. In order to get my GC fast and be secure…. I found one approved labor matching with my my skill set in company ABC(my friend co.,). I don’t want to terminate / cancel my GC process with XYZ company (current employer) until I get my GC in hand. I guess I have these below 2 options...

I. Use ABC Company’s approved labor and file only I-140 with Consular processing.

II. Use ABC Company’s approved labor and file I-140 and 485 together. If I get Labor approval with my original company drop 485 from ABC Company.

Questions I have for the aboce options:
1). Using ABC company’s approved labor Can I file only I-140 asking for Consular processing?

2). Is it a risk to file under consular processing? I guess for this I got to go to India. In worst-case scenario, if I don’t get GC under Consular processing do they cancel my H1-B visa with my XYZ (current) company and I can’t come back to US?

3). While processing of my I-140 or Consular processing if my Labor gets approved with XYZ (current) company, Can I file I-140 and 485 together? Would it be a problem due to already I am pursuing with consular processing.

YES.. But Why CP?

No.. They will not cancel your H1B unless they find any wrong doing or fraud.

You can file I-140 with XYZ but cannot have I-485 & CP at the same time. You may want to drop one for the other.

If I ware you, I file I-140/485 with Substitute LC & get my GC in next 8 months.. If something happens inbetween file another I-140/485 from XYZ

CP Will take about 6 to 7 ( 3 months for I-140, 1 month to forward your papers to NPC & Other 2 to 3 months for your Interview). Currently It take 8 months or less for I-140/485 (concurrent) in Vermont

You can file two I-140s But not two 485s or CP&485

If its still with National Processing center, not much. If already with Consulate may take a little

With CP that might be problem, with AOS You can use AC-21 if you need to
