It looks like it will take few more months to sent out those letters. God knows when they are gonna start processing :mad: , Cause it is wired that three of my collegues applied, and one guy got the letter whoce application PD is in Oct, and Myself and one more guy whose PD is in Aug and June resp., did not received letter :confused:
So if they are going to process applications with PD dates, then it looks like unless they finished all letters they will not start processing, i think GP111 may have input on this.....but we are totally frastrated :eek:

Thanks Raj. Looks like, end of the week they get tired and reduce the number of approvals.
 
When I asked about filing with perm ..this is the response I got form my Lawer.

PHP:
The risk is that, if we file a PERM application, for the same position with the same requirements, then the DOL will cancel the old application- and if the new one is not approved, you are out of time and will have to leave for one year before returning in H status.

My question is:

Is it worth taking the risk and what kind of response we are getting from Perm?

Any ideas please share....

are they ever going to look at skipped cases

gosh are they ever going to look at skipped cases ?? is anyone here whose case has been skipped ? :(. i thought it would be finally over when they start looking at 4/11 cases now i am not sure how long are they going to sit on it.

I read in Murthy's weekly newsletter that PERM cases have been mostly rejected and the decision was mostly automated. It listed down several reasons for this. Read for details:

Nope, its not worth taking the risk
There is some word called "IDENTICAL" in the PERM applications filing(I mean re-filing). Please take a look at this link http://www.murthy.com/news/n_idefil.html

According to this, The risk is real high in re-filing.

I had gone through the same senariyo and gave up to re-file in PERM.

Any Guru's can correct me if I am wrong

At last I saw the light.... Labor is approved

Hello Fellow Victims of DOL.

I have finally, after 38 months of wait been given the approval on my labor application. My PD is Feb2002 and RD is Mar2003.

Now I must move to another major hurdle.... yes I140 & I485

I have some questions for my friends in this group who have already crossed this milestone.

Here is the thing:

1. I can file my 140 and 485 concurrently as I qualify for EB2 besides my PD is so far back that California is current for Feb2002.
2. I can also file for consular processing.

Can someone please guide me whether I should go for consular or adjustment of status.... I am thinking consular because it will bring the misery to an end much more quickly however I am not married yet and may get married in the next few months under consular processing can I get my spouses name added to the list?

I have still not heard any approval on my case yet... Is there anyone out there whose RD is same as mine and has already heard of the case having been approved.
People who filed way after me, must have started getting approvals from BEC...
the recorded message still says that my case has been received on March 27 2003... nothing more...
any clues how I can find out what is going on?

You can add your spouse's name in CP on the day you go for your Interview also. Anyway the I-140 will take atlest few months & by that time if you are married you can file CP for both your & your wife at the same time.

If you are getting married in next few months, why not go for I-140/485 concurrent filing ( your spouse will enjoy the benifit of EAD) also California I-485 is SUPER FAST now a days !

Your answer gives an impression that I can file 140 and then wait to decide whether or not I want to go CP or 485... but from what I understand I have to know at the time of filing 140 whether I want to go CP or 485 and file accordingly....

Can I file my 140 now (to get into the line) and then file 485 or CP(till I make a decision) after a few days and still enjoy the benefits of concurrent filing...?
Do you know what is the processing time for CP these days.... looks like by California times... I would be better off filing 485 instead of CP. is that true?

Yes, You have option to file I-140 now & decide which way (CP or I-485) to go later.. You have to specify one in I-140 application BUT you can always change after I-140 approval.

You may not get benifits of seperate filing ( more then month) of I-140/485.. If I ware you (& getting married in few months for sure) I would file for Concurrent Filing Today. IF marriage is not planned, apply for I-140 today.

can u tell me ur case no . i am trying to find out what the hell they are doing with skipped cases ? ?? mine was on 4/11 it seems urs was march 2003. i was wondering if it was skipped and now certified or something else ..

Not till end of Summer 2005(per their statement when they would be supposedly done with their data entry).Nothing sure till they actually do something.

I can understand your frustration,nothing much we can do except if you know/want to contact INS big wigs ...
