Under what cirmstances an Earlier PD can be utilized for substitution Labor
 
How can one file two I-140, ie. one 140 gets into trouble, file it via another? is that requires pay-stubs from employer right? how can one get it from both?

I had similar case, but i elected to stick with current LC due to same reason GP111 specified.

You can file two I-140s but not I-485...
Filing I-140 does not need paystubs from Sponsering Employer. Pay Stubs are proof of current Job & legal status.. You can submit pay stubs of current employers pay stubs with future employers I-140 if RFE comes..

Aliens original PD can be used with Labor Substitution if
1) LC has been certified but I-140 has not been filed/rejected for any reason.
2) I-140 has been withdrawn
In this case you will submit proof of original LC PD when you file I-140 with Substitute LC.

SECONDLY,
In some cases (if you have a great Attorney like Rajiv !) Original PD can be used even if someone has already used that LC( For example, it ways AAA's LC, he left the company, BBB used his LC to as SUB.. Now AAA wants to use PD). Here you have to prove the HARDSHIP or similar for not using the LC & using PD. .. this has limited chances of approval.

Labor Substitue

Gurus,

I have a question about labor substitute. I have been with company XXX for 5 years now. I didn't have any experience when I joined company XXX. (Right after my Masters). My company has approved labor which has MS + 1year exp. All other requirment in Labor matches with mine at the time this labor application was applied. Is there any way I can use my experience with company XXX to file labor substitute ?

Appreciate any help.
 
I called SFDOL they said all cases that received after end of April 2003 will be sent to BEC. But I heard many different date, someone said May 2003 and someone said March 2003... Anyone know the actual date?

By looking at the case # of this thread, why my wife case # only have 6 digit and it start with 154xxx, anyone know why?

The case number you have is SWA Case Number. What the case moved to Regional ? What was the RD ? If your receive date at SF DOL was May-2003 & beyond you can get BEC Case Number information by sending email to Dallas BEC. If it was eatlier try to look for it in to flcdatacenter.com

You are one of the Lucky ones.. You will not get 45 day letter but "APPROVAL" from SF DOL in few days..

Do you know if the 20 hours per week can be counted for 2 years exp.? In my job description, it says 2 years exp. as a user or computer technician, and in 750A, we entered "2 years" under exp. I had 2 years exp. of 20 hours per week in the university.
I had 5 years exp. in computer training outside U.S, but I only entered the trainer title, did not mention the training is through the computer-based. Can I use these 5 years exp. to support my 2 years exp. requirement? or combine both exp.?

Yes, you are right. Just got RFE regarding the previous employment exp.
It says:
The beneficiary did not submit exp. letter/s. The petitioner is requested to provide evidence to establish that the beneficiary possesses the 2 years of exp. listed onn the Form ETA 750.... Provide a letter from previous employer including duty, title, dates of employment/exp. and number of hours worked per week.
My attorney said today he will review all the documentation of mine and get back to me this week to see how to respond the RFE.
Before I get the word from my attorney, I'd like to get your inputs and suggestions on this matter since you have expertise on these issue and are helpful on this forum. This is why many of us on this forum said you could be a lawyer.
What is the chance of getting appoval on this case after responding RFE? Do you think I should submit 20 hours exp. plus 5 years full-time exp. outside U.S to satisfy it. Have you met the similar situation like me?
Please give me some insights.
