One more Hurdle in Our Path !

It keeps on coming, isn't it ?

RETROGRESSION OF THE EMPLOYMENT-BASED THIRD PREFERENCE “OTHER WORKER” CATEGORY FOR JUNE
As mentioned in the Visa Bulletin announcing the May cut-off dates, demand for visa numbers in the Employment Other Worker category has remained extremely high despite the imposition of a cut-off date. As a result, it has been necessary to retrogress the June cut-off date in an attempt to hold number use within the annual limit. It is likely that the limit will be reached sometime during June, and the category would immediately become “unavailable”.
VISA AVAILABILITY DURING THE REMAINDER OF FY-2005

Employment-based: During the past month there has been a significant increase in the amount of numbers being used by Citizenship and Immigration Service (CIS) offices for adjustment of status applicants. This level of demand has significantly depleted the supply of Employment-based numbers available under the annual limit. Recent discussions with CIS have made it clear that their backlog reduction efforts will sustain or increase the current level of demand. Therefore, continued visa availability in the Employment-based categories cannot be guaranteed during the final quarter of FY-2005. If demand continues at the current rate, it will be necessary to oversubscribe many or all of the Employment categories on a Worldwide basis. Such oversubscription could result in the establishment of cut-off dates, retrogression of already established dates, or some categories becoming “unavailable”.

Hi:

I just checked the AVM (got updated today), it does says that all of the RIR applications received between APR-11 to APR-28 will be processed in SF office. All of the Non-RIR applications transferred to BEC's including APR-2003. From MAY-03 onwards including RIR and Non-RIR applications will be processed in BEC's.

Hi GP:

Do you know approximately how many cases belongs to RIR and NON-RIR out of 1050 cases. Your input is always a great help for the people (like me).

Thanks

I was checking the status of the skipped cases over the weekend, and found the following cases certified. There is no known pattern of when they are going back to check the skipped cases.

I am sorry, but searching for that post is difficult, so gp111, can you please post the number of cases in SF DOL for Apr-2003 again? Of course, if you have been tracking, then also how many of the Apr-2003 are processed and how many are pending.

Raj, if you have the stats, please post them.

Thanks, guys! You have no idea how many blessings you are getting for doing this :)

Hi All,

This is my 1st post/reply on this thread.

As per the AVM it says that they will continue to process RIR cases received at DOL from 04/11 to 04/28. And as per the excel sheet there is at least one case received on April 30, 2003. So I wanted to confirm whether we have a correct info in excel sheet or not. Also there were many new case numbers were missing I am not sure if they were non-RIR and got approved till 12th May 2005.

Also I want to confirm that 04/28 is inclusive as it has almost 106 cases.
Thanks

No.. SF DOL has not assigned Case Numbers in sequence. Here are the number of cases received by SF DOL in end of march & April 2003.

My estimate is that there are about 730/740 cases left to process between 4/11 and 4/23 (the date of my case) and also including skipped cases .... so if they process about 20 per week it will still take approx 9 months to get to my case. It doesn't seem fair that cases from 5/03 which were sent to the BEC are getting processed now and those at SFO DOL still have so long to wait!

Approx cases for the rest of April ...

4/24 - 70
4/25 - 14
4/26 - 1
4/28 - 115

Looks like we posted at the same time but yours got there first! Guess I need to learn to type faster. There is a little difference between our numbers but I think yours are probably more accurate than mine.

Yes, I agree with you. While I am happy for the ones on or after 5/03 that are getting approved, I am miffed that the 4/03 cases are being pushed so far. Why couldn't they just have taken all the backlog, or start from the current processing date? They just had to go from a random point in the future, making us suffer in the process.

Just not fair. But life's never fair, is it? On a brighter side, if we have waited for so long, what's a few months more?
