Analysts phone numbers!!!!

I was going thru the chicago DOL thread and i am shocked to see that those guys have the analysts phone numbers and also they know the analyst who is processing their case and also they get to talk to them!!! I was shocked to see that!!!

Can we talk to the analysts here in SF DOL too?

Finally, after so many months of confusion I find a place where people are really knowledgable!
I wonder if someone could be so kind to answer my questions. I am sure some of you are in the same boat as I am.

My lawer filed a regular labor certification application (non-RIR) with the EDD (Sacramento) in August 2001 (8/24/2001) and
I have the case number. Am I right that this date is called Priority Date (PD)?

1. When I called the phone number in Sacramento (915) 4643400 I spoke to the operator
who was able to look up my case number. She told me that processing of my application is 2 years away.
Is that true? Could someone confirm with a similar application date?

2. Could somebody, please, explain at what point in time San Francisco office becomes relevant?
When I called the automated system for the Reginal office it was not able to locate neither by my case number,
nor by employer's phone number. What's the catch?

Attorney Murthy : The USCIS has stated that an LC filed over 1 year prior, based on evidence of its filing date, may be sufficient to file and obtain an H1B 7th-year extension with a different employer. Again, there are no regulations on this issue, just the government policy position. We have written about this on MurthyDotCom since we have filed such cases successfully at our law firm.

>> For last 2 years SESA (CA state office at Sacra.)was processing Non-RIR applications filed in late April so it may take few more years unless goverment grants some support to backlog reduction program , which has been proposed recently. In worst case it may take 2 years.

Another way out may be PERM program which is planned for syummer 2004 which can certify labor very fast. But PERM has history of getting postponed and not many companies currently qualify for it.

>> Your case will reach SFO DOL when it has been worked on by SESA and SESA finds no issues with the application. In case of regular application SESA will ask your employer to conduct some interviews of candidates and SESA will monitor that process. After this round of interviews etc SESA can forward your application to DOL.

It is (415) 975-4617, Press 1 and 1 to get to the case number entry prompt.

You can get your case number through your attorney or HR specialist.

Two of my freind's case status is as follows -

DOL rec: Sept 19th 2002
DOT : 32
Auto remanded : Jun 30th 2003
Returned to DOL after remand : Dec 30th 2003

DOL rec: Sept 24th 2002
DOT : 32
Auto remanded : July 9th 2003
Returned to DOL after remand : Jan 8th 2004

Will keep you posted of further updates.
 
DOL Status Changed

My case status has been changed to Received after Remand.
I think it is good news and now Iam waiting for DOL to act on my case. ___________________________________________________
Dot: 999-151-051; Rd: Oct 2,2002; Remanded July 14.2003, Returned after remand Jan 10,2004.

Based on the recent trend you should be looking towards your LC approval within 15 days or max 3 weeks. I think it is now time for you to start collecting documents for the I140 & 485 viz Birth certificates, experience letters, immunization records, passport photograps etc. It is better to apply for the next stage faster because I suspect the Q in I140 & 485 will now get clogged very fast. So better start collecting the documents now, so that you are ready to go to the next stage when your labor comes through.

Just checked the AVM.
My case status has changed to "Returned By state after a Remand"
My company has 2 other cases which were "returned by state after a remand" on Dec 6th. They are still in that same status.

I am posting the same reply form VSC forum here below:

Individual lawyers work different way. Some of them ask to fill-up drafts of all these forms. Some give a questionnare and they do the rest.

1. I-140
2. I-485
3. I-765
4. I-131
5. G-325
6. I-693 (For Medical. Need original colored - Download version can NOT be used).
7. Copy of latest Visa in Passport
8. Copy of I-94 (of last travel) and/or one on I-797 (if you extend H1-B here)
9. DOB (Non-availability Cert, 2#s Affidavits OR original DOB, if you have)
10. Experience Letters (From Companies on Letter Head OR Affidavits from co-workers)
11. Photos (8 Copies - Specifically taken for Immigration)
12. I-134
13. Marriage Cert
14. Employment letter - Lawyer will take care of it from ur employer.
15. W2(last 2) and Paystubs(last 6) - Only safer of not getting NOF/RFE on ability to pay (Upto individual lawyers)

For the medicals, you need to have the "yellow card" i.e. record of immunizations. You can start working on this at an early date. If not, you need to have a certifcate from a Doctor, that you are immune to certain diseases mentioned in the "yellow card". Otherwise you need to take the immunizations mentioned there. You can get this card by paying a $7 fee in the local county immunization clinic.

Another area is the Birth certificate. If you have one, and the same is not it English, then you need to get it translated to English and notarized. If you do not have any, then two affidavits from parents & relatives are required, accompanied by a letter from the Government, that your birth records were not found.

The third area is the experience certificate. You will need to prove that you have the relevant experience for the job. Get it from your previous employers or from your previous colleagues in their current workplace letterhead. Try to get as much a detailed letter, describing the nature of your duties, as possible.

Guys, when posting your updates, please also post whether the case was autoremanded or remanded by employer. I am sure there are a lot of people on this thread whose nerves would be soothed, if they came to know of any "remanded by employer" cases being returned to DOL or being approved by DOL.

Auto Remanded : June 26 2003
DOL Approval : Jan 9 2004
RIR MS + 2 yrs Exp.

Thanks to everyone for the valuable information on this forum. I am planning to go out of the Country for a few weeks. Should I just apply for I140 or wait and apply for (140&485)?
 
Congragulations Praveen,

If you have all the docs ready, u should apply for both 140 & 485. Do not be hasty in applying, if u do not have all the docs. I think, if your H1B is valid, u should be able to leave and enter the country, even when your 485 is pending. Filing in seriel, is also a good alternative. It will give you some boost in the 140 Q but might have some impact in 485. But, u are better off following your Attorney's advise.
