Please clarify

HI

I have BS + 10 yrs and Lawers have applied in RIR

Should this mean BS+5yrs or right candidate for MS+0 for 3option letter

Please clarify if any body in this situation.

That exactly what happenned with me, even though i have ms + 5 years, bfore they applied for labor, they put in Ms + 0 years, now i get a 3 option letter.

For people whose Rd is < feb1st 2003 and for whose case avm says it is still rcvd, means your lawyer gor a 3 option letter, please check with ur lawyer.

I have copies of all forms , I dont see anywhere it is indicated except that all your experiece till current is indicated cronologically. But i suspect this may be on attached job advt submitted (which copy i dont have)

find out how they applied, bs+3 yrs or ms+0.
if ms+0 or bs+2 yrs, then watch out..
i dont want to scare anyone, may be i was just unlucky as usual.
you may even get if it is ms+0.
i wast mentioning the general criteria dol is using these days.

Got a 3 option letter from DOL, if we want to readvertise, can we just do on the internet or advertisement in paper is a must?? carlson memo doesnt specify the mode of the advertisement. it only says 1 day ad. it doesnt tell the medium.

Do any of you guys ever did this or have any info on this?

AVM today says California RIR process dates are "OCT '02 to FEB '03 " .. I wonder when thay will finish the lagging cases & concentrate only on One Month at a time !

Standard 3 options, 1 with draw the application.2, readvertise.3. put it back in non-rir queue.
 
3-option letter

I think it is good to advertise in a local (community) newspaper as its reach will be limited and therefore fewer resumes. On the internet you might get much more and therefore more work and more justification.

Also another thing to consider is that if another person in your company has gotten the same letter within the past 6 months and his job requirements are the same, then you can reuse the recruitment effort details done for his case. It will save you some time.
 
As of July 28, 2004, it is expected that an Interim Rule will shortly be published in the Federal Register establishing that Employment Authorization Documents (EADs) will be issued for a period of time exceeding one year in some cases. USCIS recognizes that, because the processing of I-485s and other underlying applications often takes longer than the maximum of one year allowed for the validity of the EAD under present regulations, it is a drain on its resources to process renewals for EADs every year.

Although we do not have the published rule as of today, it appears that the Interim Rule will not set a maximum for how long the EAD will be valid. The USCIS will have discretion to determine the validity period of the EAD. So, for example, some local USCIS offices may only grant the EAD for 6 months based on that office's I-485 estimated processing time, while another USCIS office may be able to grant the EAD for 2 years. The USCIS will consider the following factors in determining the timeframe for the validity of the EAD :

3 Options Letter

I got 3 option letter on 5rd Jan 2004, replied before 5th mar 2004, nothing happend after that. DOL RD 03/09/2002 (031, 095-314xx). Do you guys have any info what will happen to these cases?

Question about labor substitution

Folks,

I believe I might get a pre-approved labor certification from a company I am planning to join in the San Francisco bay area.

Could someone tell me what the risks are in a labor substitution? Also, does it stop me from concurrently applying for I-140 and 485?

Any input will be highly appreciated.
