All for a wrong cause

Maybe we lost because our cause itself is wrong.
We are so enamoured by becoming a part of a place that doesnt even want us. They dont give us a second thought.

You think senators, law makers, politicians, are imbeciles? they dont know what the state of legal, employment based immigration is in this country? they dont know ? we have to "educate" them? Forgive me for saying but I believe that is pure BS.

If what happened today doesnt open our eyes, we deserve to be their hi tech coolies for 20 more years if not less.

They know everything. I am sure there will be champagne parties at sheela murthy's, rajiv khanna's offices, champagne parties at all the blood sucking L1 and H1b employer's offices. You think if 100 sp500 companies wanted this reform, it wouldnt have been passed today?

They want our condition to continue. They get more business. They get to retain high quality workers for 40% discount, year after year. they stand to get paid year after year filing complicated extensions for us. GET IT PALS... WE ARE THE CASH COWS. AND THEY HAVE YOU BY THE D**K, MILKING YOU. AND ITS NOT PLEASURABLE."

Its smoke and mirrors. and it has you and your wives fooled that you can become a part of this nation ... if you wait just one more year. And before you know it, youve been waiting 8 yrs, each of those years thinking 'I will get the magic green card next year'

And then your employer lays you off. And then guess what? you are a sub-par employee begging for a job in the market where your skills have got outdated..

What do you do? Stay here. work harder. Make yourselves indespensible. And, SAVE. SAVE EVERYTHING, save every penny. dont give these white slave drivers one single iota from us.

Senator Cornyn

I received a USPS mail from senator Cornyn today. He is fully supportive of the S.1932 bill and the section 8001. I will try to type the entire letter out and post it here later today..

But meanwhile I called Senator Cornyn's office @ Tel: 202-224-2934
and told the person that answered the call that this section was dropped in the House yesterday during reconciliation and if the senator can bring it up in the senate today to include it..He said he will pass the message on to the senator..

Guys if you have sometime please call Sen. Cornyn/Sen Arlen Specter and do the same.. May be they are not completely aware that this specific section is dropped.. But if many of us call they might try to raise the issue in the senate for inclusion..
 
I agree that we should not invest here anything till our future is certain in this country. We should invest all our money back in our home country, who knows after two years they would say that no more green cards and you cannot take any money from here, so do it from now on. Dont buy any houses either for the same reason. I was loyal to this country so far, but now I am skeptical.
 
I agree 100% with what you wrote.
But we must keep on trying and trying hard. There are a lot of lawmakers who still do not know the difference between H1 and EB visas. We must spend some time during the next month for this cause. We cannot go worse than what we are now. So, let's move on ...

I think it all about sucking our blood. I was stack in Labor for years. Then created PERM. Got labor. Then wait for 485. Do you think these guys don't know about all this shit. I think they all know. Why they will give you GC so that you can get social security, medicare.....bla, bla. There will nothing.....

The idea is suck your blood by company's as well as your money for social security and medicare. Because if you don't have GC don't get it. Also generate tax dollar for them so that they write check for their citizen

WHAT IS THE USE OF GIVING THE VISA NUMBERS ,ALL OF US WILL BE ELIGIBLE TO GET A DIFF JOB.SO THE GOVT WILL HAVE AN INCREASE OF JOBLESS PEOPLE,BECA THEY CANT PAY THE WAGES THEY PAY AS US PERSON,THEN THE EMPLOYER SHOULD BE AFRAID OF EMPLOYEE THIS IS NOT GOING TO HAPPEN. :mad:
 
Great effort guys,
it seems we have lost this round.
I think we were asked to much from them , these desi companies want to see us in this positions for ever , Look at what's going on , now a day's there is no salary increases even in permanent positions ( where there is no difference between H1 and GC ).
I have been with one big company for almost 6 years now ( big corporation ) ,
even though I have GC I'am still drawing almost same salary even after working
for more than 6 years with the same company , every year I get raise which is 1/4 of the annual inflation rate .
So it is not only with the H1B guys even with GC ( atleast with me ) it been like this for long.

I have put moderate effort during this whole process of faxing and making phone calls.
I have watched this form ever since it was created, I learnt a lot about immigration
process form this form and really appretiate the contribution of many folks

I think we should keep this process going .

The flaw with that argument is that comprehensive immigration is mired in controversy over illegal immigration. To make us stand in line while they finish their discussion about people who have not followed the laws DEFIES all logic. This is what we must convince our lawmakers in the days to come. Very true. We should try and present our case well for the next bill. There was too much stuff in the bill that made it difficult to go thru. Also this bill required only the consent of republicans. Most democrats had to vote against the Budjet bill anyway, so a few could easily blackmail the reconciliation process.
The administration repeatedly said that they only support guest worker programme with no automatic path to citizenship. After listening to some of the testimony made by the represntatives of the admin, they r not likely to take a position on our issues(legal immigrants). They may support increasing the H1-B's. I doubt they will go beyound that. This leaves us to fight for ourselves.

Lets do a more thorough post mortem and plan better for the next bill. I believe we will have more members now as more and more people will join us as BRC's flush out their Q's.

"The Senate is scheduled to take up the conference report today, December 19, but Senate Minority Leader Harry Reid (D-NV) threatened on Sunday night to hold up all remaining Senate business in protest of the Republican leadership's attempt to attach Alaska drilling provisions to the defense appropriations bill. We will keep you updated on the budget reconciliation bill's progress in the Senate. If it passes without the provisions for H-1B blackout and retrogression relief, we will begin looking for new options to secure such relief in the new year".

It says "If it passes without the provisions.....", so there is still hope!
It is not over until it's over!

A new course of action?

As an act of defiance, we as a community could also do the following..

Here is the logic. They dont want to give us residency. So we wont demand it either. Not a single one of us should file a GC application henceforth. those who are stuck waiting for labor/gc etc should tell their employers they are not interested in gc anymore.

we get 6 yrs of h1b each time. we need to utilize our time well instead of begging for residency. earlier residency process used to take 2-3 yrs which was reasonable. now it will take 6-8 yrs. which means you will be stuck for 8 yrs on average of your life waiting for something which may not even happen...

friends, we only live ONCE. ONCE! WE DONT GET 2 LIVES.
If we have self respect, we should can this whole process. We should sell our services to the highest bidder.
Say, you find a job paying you 80k. Every 2 yrs, look for a bigger, better job. keep looking. maybe youll get another one paying 100k 2 yrs from now...

2 more yrs go.. look for your next one. make 120k. Keep hopping. your experience and skills will grow 6 fold with this approach. your demand will increase that much. So will your bank balance.

think of it. staying with the same employer at 80k for 6 yrs = 480k . with 4% increments, you get about 10-20 k more at max.

with the hopping scheme, you earn 600k

agreed things can go wrong, but they can go wrong either way. you can get laid off after 5 yrs at the same company and end up with nothing..

this land and its employers are not loyal to us.. they keep breaking every promise they make. so WHY ARE WE LOYAL TO THEM??? WHYYYY!!!

WAKE UP FRIENDS. You have the power. the demand is yours.

Agreed our efforts the last several weeks did not work this time. However it sure must have educated a lots of senators/congressmen about this issue. And this has helped us to come together for the first time.

And when this issue is taken up in the comp immigration reform act, (http://thomas.loc.gov/cgi-bin/query/z?c109:S.1438:) , note that S1438 has similar provision not exactly same, the senators and congressmen will be much more educated about this issue. So this entire effort has served as a strong primer.

We need to do the following, the provisions in 8001 & 8002 were the best/strong and directly focussed at retrogression. We need to find out the real force behind Arlen Specter that helped him draft this. Whoever has helped , has a strong understanding. I did not even see this specific provisions in the comp reform act. For eg. filing 485 before it becomes current is not there.
If we find the that source/force and synergize with that it will be effective. AILA has said that they will seek for the same benefits next year. We should have them play for us. I think the next round has to be proper and professional lobbying with corporates/capitalism behind us.

I feel the reason direct calling did not work this time, is because the senators did not see a clear benefit in acting on this although they knew there were lots of people who wanted this. A professional lobbyist will put things into perspective.

I think if we put in another 8 weeks of effort we can win this!!!
 
From previous thread, it seems that a microsoft lobbist convince Sen. Spector to include sec. 8001. Correct me if I am wrong.

Let's take this loss as an foundation for our success. Sincerely I am not able to work today at my office. I have been waiting for some good new about eb retro since last 2 months and this is what I get today.
Let's gear up together and try to educate these white collar idiots who does not know how much we are contributing this country . All they are interested is in Votes and Money and that is the reason why they are bent on Illegal Immigrants now that elections are coming near. I feel ashamed of my self standing in line to get a GC after getting so much education and an educated person is given preference.
I think they are getting narrow on immigrants by passing that DUI law. I feel that all people should be treated equally .
 
why the bill failed ?

I am very disturbed by the fact that Desieccan told us 2 days back . I could not stop myself thinking how his employer came to know abt the outcome of conference report b4 2 days and how numbersusa came to know abt this result before a week time . is that means all our efforts did not even make slight effect ? May be because the staff members who repeatedly says we will convey the message to senator did they really convey the message or just ignore ? Only couple of people got lucky enough to meet or speak to congressman /senator personally but that may not be sufficient enough to expose 400k families behind them .

we need to get answers for our questions from the source before making next attempt .

Immigration Reforms Are On Its Way In February

Hello Everyone,

I was very sad after I heard that things are not in our favor. It is very unfortunate that we in the immigration community are not getting what we deserve. We are immigrants that does not mean that we take what we get. The war is not over. We have lost one bill. Although it is big loss for us, I don't think that we have lost the battle. Everyone please note that things are slowly cooking in Washington for the comprehensive immigration reforms.

We did our efforts, however; the fact is that all the efforts were made at very last moment at each and every stage. We need a efforts to be made from day one and from all of them.

Here is the game plan for February when Senate return and takes comprehensive immigration reforms.

1. (January 4 2006 to January 15 2006) Format a letter detailing the pain that legal immigrants have to face because of retrogression. (We al ready have that ready since few people were working on that)
2. (January 10 2006 to January 15 2006) Start sending those letters to the media. (Idea is to increase the awareness)
3. (January 15, 2006 to January 29 2006) Meet each of the congressman and congresswomen in your area and request them to solve the retrogression problem. Currently they will be available since they are enjoying the vacation.
4. (From January 20th ) Start sending letters to the senators and House of representatives asking them to support.
5. Get in touch with Arlen Spector and ask him to reintroduce the same thing that he did in S1932 again in the compreensive immigration bill introduce by Ed Kennedy, John.

The comprehensive immigration bill is the last bill that will save our ship. After that there are no other bill that are pending and also people in washington will get busy with election.
 
I think it is a good idea. Several suggestions regarding the timeline.

First, we need to send our stories to media as soon as possible. We need the debate over legal immigration well-known before the bill. lamar said he would like a public hearing before taking any action. If the media get more attention, we might get more support.

Second, we need meet these congressman as soon as possible. Otherwise, chances are little for them to be convinced since anti-immigration people will meet them too.

Third, not only Sen. Spector. We need anyone who can bring such an amendment to the senator/house. If more congressman cosponsor the potential amendment, the survival chance will increase.

If we say that our Desi companies and Desi immigration attorneys don't care about us and probably benefit from us not getting green card, then why blame the lawmakers? This is part of the politics, things don't often get the attention/merit they deserve.... And often it's not because someone has some ill intentions, but because confusion and lack of "elbow grease" (That's a captial city word: the politicians have to offer few things to win few things.). As others have pointed out, section 8001 was at an disadvantage because of 3 reasons:

1) It was tied to a much bigger bill that attracted a lot of oppose because of other sections in the bill that had nothing to do with immigration.

2) It was confused with the concept that it will increase either H-1B visa or illegal immigration.

3) Unfortunately, the bill was given a lower priority because the lawmakers had to settle their differences on bigger issues like ANWR, deficit reduction, food stamps, etc. I honestly believe that many lawmakers supported the section 8001 but they had to let it go because of negotiations.

If we have an Immigration bill which will have several sections, then EB relief will and should be a section by itself. There will be other sections in there I am sure many lawmakers will oppose, but I feel it will be easier for us to convince that the EB relief section will not increase H-1B or illegal immigration and how it will benefit us.

Please accept my sincere thanks for giving excellent support to Employment based immigration community. Your sympathy, perfact analysis, and quick updates are highly appreciated and same kind of help expected in future.

I observed that Employment based immigration community became very upset due to conference report of S 1932 without immigration package. As you know, the community is cream brain from all over the world and highly contributing to the US economy and their next generation is going to contribute in much higher way.

Thousands of members did resonably good job to communicate to lawmakers. It is hard to understand for me what are the factors which went against? Senate has rejected Senator Byrd's amendment with 85 vs 14. Is there only handful of republican congressman has black mailed pro-immigrant lawmakers? Your insight will be highly appreciated for our further line of action.

The Comprehensive Immigration Bill - S1438 introduced in the Senate is only slightly beneficial to EB-3 Category and is a major disaster for EB-1 and EB-2 Categories.

This is mainly because the number of green cards stays the same at 140,000 and the percentage for EB-1 and EB-2 visas are reduced from 28.1% to 10%. These numbers are then provided to the unskilled workers. There is no change to say one visa per family as was present in S1932.

So if we need relief, we will need to campaign for changes to this bill and not pass it as is.
 
Nobody!!! wants you to have a Green Card

Though there may be 100s of sympathisers but when it comes to reality may be other than your family nobody in the world wants you to have a green Card
1) Your Employer . He'll never ever want that to happen. My boss was more happy to hear the news of my Labor being sent to the Backlog Center, than he was on the birth of his child. He stopped just a step short of distributing sweets on the Labor News.
3) Your Lawyer: This is the 3rd time I have filed my Labor. 1st one went in garbage because I changed my employer, second one is pending in BEC and the work in on for 3rd one. Why would the lawyer want me to get the GC when I am a regular source of income
4) The lawmakers : I have atleast 7 approvals for myself and for my wife. I pay them every damn year to live in this country and will pay to US consulate for stamping. Why will they want to stop that source of income for this country?
5) Your neighborhood: I don't have to say about this one , you guys know it.
6) Your friends : Only you can tell how many will be really happy to see you getting a Green Card
