Hello Everyone,

I was very sad after I heard that things are not in our favor. It is very unfortunate that we in the immigration community are not getting what we deserve. We are immigrants that does not mean that we take what we get. The war is not over. We have lost one bill. Although it is big loss for us, I don't think that we have lost the battle. Everyone please note that things are slowly cooking in Washington for the comprehensive immigration reforms.

We did our efforts, however; the fact is that all the efforts were made at very last moment at each and every stage. We need a efforts to be made from day one and from all of them.

Here is the game plan for February when Senate return and takes comprehensive immigration reforms.

1. (January 4 2006 to January 15 2006) Format a letter detailing the pain that legal immigrants have to face because of retrogression. (We al ready have that ready since few people were working on that)
2. (January 10 2006 to January 15 2006) Start sending those letters to the media. (Idea is to increase the awareness)
3. (January 15, 2006 to January 29 2006) Meet each of the congressman and congresswomen in your area and request them to solve the retrogression problem. Currently they will be available since they are enjoying the vacation.
4. (From January 20th ) Start sending letters to the senators and House of representatives asking them to support.
5. Get in touch with Arlen Spector and ask him to reintroduce the same thing that he did in S1932 again in the compreensive immigration bill introduce by Ed Kennedy, John.

The comprehensive immigration bill is the last bill that will save our ship. After that there are no other bill that are pending and also people in washington will get busy with election.

This time we need to concentrate only on
EB Retrogression related issues

  1. excluding family members from visa counting
  2. Filing 485 with labor approval
  3. removal of visa percentage based on country or increase of percentage based on country population
  4. etc

We should not stress on H1 numbers increase etc
 
If you read carefully the section we have to fight for is section 1001 Under Title X of S 1438. It gives provision to recapture lost EB visas from 2001 onwards, but the percentages alloted for EB1 and EB2 has dropped to 10%!! There is also increase in the limit of per country quota I think, from 7 to 10%(needs more research). Overall there is a heavy preference for EB3, This is under the title of backlog reduction. I wonder when was this written up? Before retrogression in EB1 and EB2 for India and CHina, may be they dont care about us, as the rest of the world is not retrogressed for EB1 and EB2. This bill is a disaster for EB1 and EB2. I agree with GC Bronco
 
I agree with Popoye that we definitely need to be in touch with the force that convinced Senator Specter. This will add more momentum to the effort.

And when this issue is taken up in the comp immigration reform act, (http://thomas.loc.gov/cgi-bin/query/z?c109:S.1438:) , note that S1438 has similar provision not exactly same, the senators and congressmen will be much more educated about this issue. So this entire effort has served as a strong primer.

We need to do the following, the provisions in 8001 & 8002 were the best/strong and directly focussed at retrogression. We need to find out the real force behind Arlen Specter that helped him draft this. Whoever has helped , has a strong understanding. I did not even see this specific provisions in the comp reform act. For eg. filing 485 before it becomes current is not there.
If we find the that source/force and synergize with that it will be effective. AILA has said that they will seek for the same benefits next year. We should have them play for us. I think the next round has to be proper and professional lobbying with corporates/capitalism behind us.

I feel the reason direct calling did not work this time, is because the senators did not see a clear benefit in acting on this although they knew there were lots of people who wanted this. A professional lobbyist will put things into perspective.

I think if we put in another 8 weeks of effort we can win this!!!
 
Comprehensive immigration is maily dealing with illegal immigration reform which might face lot of rejection in hoth house and senate.The chance of passing of that bill is very slim.I think we should push for a seperate bill dealing with legal immigration reform.

And then your employer lays you off. And then guess what? you are a sub-par employee begging for a job in the market where your skills have got outdated..

What do you do? Stay here. work harder. Make yourselves indespensible. And, SAVE. SAVE EVERYTHING, save every penny. dont give these white slave drivers one single iota from us.

I am glad to see that more and more people are seeing through all this and coming to terms with REALITY. I do not hold anything against the law makers and this country because they are doing what they have to in order to secure their own future. Life is all about survival of the fittest and the US is doing everything to ensure that they remain this way. US foreign policy is centered around this principle and so is its domestic policies. Lets not complain They have a right to do so. Cheap techincal labor and revenue generated from legal immigrants who do not qualify for any benefits yet pay equal taxes is a big part of this startegy. We are the cheap techincal labor and we will be exploited. We cannot say anything because we are here on our own accord. That to is a fair statement. No one forced us to be here. Now onto what bugs me about us immigrants ....

The only problem I have is with people who continue to live in some dream land thinking that the lawmakers are looking out for immigrants, that the US has no biased policy against tech workers. It is a very naive view of life and can only lead to disappointment. I encourage everyong to wake up from this unrealistic dream. We are on our own, we have to do whats best for us. Try to get help from lawmakers but do not expect it. Demand fair treatment but know that you will be treated like crap. Watch out for yourselves and do not take things for granted. No one is concered about our plight. Things will only change when there is something in it for the lawmakers and for the US in general. So lets try to ride our luck till we can :)

black_logs I totally agree with you and feel the same. What I fail to understand is why would our cause be affected just because it is added to some bill that is widely debated.

When senate defeated the Byrd's amendment by 85-14(I am not sure if this is exact) and we just had one senator who voted against us in the group of 20. So this would mean we had 19 votes out of the total size of 23 in the committee. We also had Mr. Specter on our side and we all know he has good influence on both sides.

What I personally feel is that there is something that we are missing. There is some objection from some group and this may be the employer(they want us to stick with them for yrs), the attorney's(they want us to file as many times as possible just to fill their pockets).

If there is anyone on ourside then it is ppl like us who are afffected by retro.

1) Your Employer . He'll never ever want that to happen. My boss was more happy to hear the news of my Labor being sent to the Backlog Center, than he was on the birth of his child. He stopped just a step short of distributing sweets on the Labor News.
3) Your Lawyer: This is the 3rd time I have filed my Labor. 1st one went in garbage because I changed my employer, second one is pending in BEC and the work in on for 3rd one. Why would the lawyer want me to get the GC when I am a regular source of income
4) The lawmakers : I have atleast 7 approvals for myself and for my wife. I pay them every damn year to live in this country and will pay to US consulate for stamping. Why will they want to stop that source of income for this country?
5) Your neighborhood: I don't have to say about this one , you guys know it.
6) Your friends : Only you can tell how many will be really happy to see you getting a Green Card

WE SHOULD LET THEM KNOW THAT IF THEY DONT CONCENTRATE ON LEGAL IMM ,THEN THEY WILL BE FORCED TO BE ILEGAL IMM GRANTS

Can we discuss this under S.1438- Immigration Reform Act of 2005 (Feb 2006) thread .The title of this thread may be misleading to the newcomers. Also, the Immigration Reform Bill is a totally different bill.

and told the person that answered the call that this section was dropped in the House yesterday during reconciliation and if the senator can bring it up in the senate today to include it..He said he will pass the message on to the senator..

Guys if you have sometime please call Sen. Cornyn/Sen Arlen Specter and do the same.. May be they are not completely aware that this specific section is dropped.. But if many of us call they might try to raise the issue in the senate for inclusion..
are you sure that is there any possibility to include section 8001 again in final bill if senators show their support strongly ?

I called and faxed senator cornyn's office .. I told them to ask the senator to bring this up in the senate today. This seems to be sen. cornyn's favorite topic..(S.1932 + section 8001 visa recapture). He seems to be a stauch supporter of this along with sen. Arlen Specter.. So they need no convincing..they only have to know that it is dropped for them to bring it up today.. I believe if everyone calls their office to make them aware of this, it might still have an impact.. After all, the Byrd amendment was defeated with overwhelming majority in the senate under the leadership of sen.Arlen Specter... So please do you part again !

Educate them??? They already know!!! Anybody here think that a Senator doesn't know the difference between an Illegal Mexican and a H1b worker with Master Degree and labor pending in f...ing PBEC, worked 3 years in a company earning 50% less than other americans counterparts? or even worst like many of people here with Phd who have to give part of the salary to their employers only because the employer is doing a "f.... favor?

I agree 100% with another person in this forum who wrote: "my boss was happier with the creation of the backlog centers than when he had his first child..."

For my part, I will wait 2 1/2 more years (sucking low tuition costs that my wife is paying at the university, only good thing in this nightmare) , and if there are no labor approved by this time, I will go back to my country.

Many of the people in this forum thinks that there is no future in their home country, but the problem is that in this moment there is no future in USA unless the immigration laws for LEGAL immigrants improves!

I am EB3 Rest of the world.

I totally second that.

We need to have almost like an AD campaign -- EB Retrogression.

Spousal concerns can wait. Tying this with H1 in any form is risky.

The campaign should just be about folks being able to file 485 ( even if there is no increase in Visa Numbers )
 
why not support something like Hagel's bill (refer to an old link in Oh's website) introduced in late october?

This is mainly because the number of green cards stays the same at 140,000 and the percentage for EB-1 and EB-2 visas are reduced from 28.1% to 10%. These numbers are then provided to the unskilled workers. There is no change to say one visa per family as was present in S1932.

So if we need relief, we will need to campaign for changes to this bill and not pass it as is.

My lawyer told me three weeks ago that he would'nt place a bet that the new law would make it.
We were a bunch of amateurs working with all our heart but we need to understand how the system works.
 
MCCain/Kennedy bill S 1033 was better, 290K EB visas, 20,20,25% each for 1,2,3 categories. It is better than this comprehensive immi reform bill. The related House bill is HR 2330. In the senate it was referred to COmmittee of Judiciary and in the House it was referred to the committee on 21st century competitiveness.

Let me explain one thing to those who dont know, which I felt on reading some posts as to how did this fail. The problem here is Tancredo R CO, and his 90 member republican team in house. If Dems are against a bill brought by republicans, then this group has a lot of bargaining power because they can hold the entire rpublican party to Ransom and get their anti immigration agenda through. On the other hand if there is a bill which the Dems would support, this group wont be an issue to pass in the House.
 
Hagels bill number is S 1918. Read twice in the Senate and referred to Committe on Judiciary on 10/25/2005. The Section 202 of this bill reads "Aliens who have earned an advanced degree in science, technology, engineering, or math and have been working in a related field in the United States under a nonimmigrant visa during the 3-year period preceding their application for an immigrant visa under"
