I had sent the RFE response too on 4 Nov. But I dont know how long its gonna take from here. I am thinking of going for premium service becz I cant wait any more. Does any one know how long on an average takes for approval after RFE response? And how long it takes for approval in premium service?
Ur inputs will be very helpful.

Did anyone get the H1 approval after replying the RFE notice? I got the RFE on 2nd Nov and my employer replied back on 7th Nov but no progress after that.

Finally got my H1 approval on Nov 17th, after 6 months. So after RFE docs were received by INS , it took about 3.5 weeks. All the best to you guys. Hope you get your H1s soon too.

"Your I129 PETITION FOR A NONIMMIGRANT WORKER was received on August 3, 2005. We mailed you a receipt with information about processing. It is taking between 120 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

what does it mean?

It means they haven't touched ur application after receiving it. As soon there is a progress it'll be shown online. The USCIS is very sloppy. They don't have any pattern of processing the applications. No FIFO kind of stuff.

My H1B filing date is July 12th.
The uscis website still says
"Your I129 PETITION FOR A NONIMMIGRANT WORKER was received on July 12, 2005. We mailed you a receipt with information about processing. It is taking between 90 and 150 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

The last updated date shows as 09-13-2005. Doesn't this mean that the file was viewed/opened on that date. I am wondering what is holding them from giving a decision.........if they don't have enough info they must put RFE right.
Can someone throw light on this...thanks in advance.

You are right. If your LUD was 09/13/05 it might have been opened or viewed for some reasons. Since you did not get any RFE, do not worry. You will get your approval soon. Keep your fingers crossed.

2 H1B applications - URGENT!!!

Hello everyone,
I am in a unique situation and need your urgent advice!
I have done my masters in Chemical engineering in the US. My OPT is already over. I have about 1 year of experience in computers and based on that I got a job in a software company(Company1).
Company1 has applied for my H1 and I have got RFE on how my education is
related to the job. Though my employer is confident that H1 will get approved, I am extremely worried about it.

Recently, I got another job in company2 which is also a software company but the position requires chemical engineering experience. Company2 is also willing to sponsor my H1. I feel that chances of getting approval from company2 H1 are good as they have employed several people with similar backgrounds as mine.

My question is can I apply for another H1 from Company2 while my H1 fom Company1 is pending? As I mentioned, my OPT is already over and I am staying in the US only because my H1 from Company1 is pending.

I would really appreciate any help. The lawyers are not giving me straight answers.

We have the same situation...but my received date is may 3,2005 then last updated date is november 22, 2005.Finally they were able to see my application, I just hope we can get our approval soon.Coz it's been almost 6 months of waiting.
 
Thanks rg140 for the response.... What i do not understand is how come they open my file on sep 13, 2005 and then not do anything with it more than 75 days. Is there something wrong with my file. If anyone has a LUD on sep without getting approval or RFE please reply so that i know there are people in the same boat.

pykisly_77: I think you are doing alright since LUD is Nov 22 which means you will get an approval soon. Anyways keep me posted.
 
USCIS received REF reply on Spet. 21 , I've not heard any thing after that.

any idea how much time uscis take to update case after REF documents received.

Hi Sonalik,

I too got an REF on 28th and immediately sent the docs. Hope it will be approved this time with out any problems. Usually it takes 4weeks to get approved. Hope for the best.

now it's been 9 week i sent reply to REF and not heard any thing from USCIS.
so kinda worry what's going on.
normally most of the applicant got response withing 8 week after REF....

any way hoping for quick response, keep update about your case.

I applied for a new H1B on June 23rd and received an rfe sometime back. My status was updated today. The status says that the primilinary processing is complete. Does anybody how long it takes for a case like this to get approval ?

On December 5, 2005, we received your response to our request for
evidence or information. It is taking between 90 and 150 days for us to
process this kind of case. However because preliminary processing was
complete, the remaining processing time will be less than the maximum stated
in this message.

Can you please tell me when did you receive the RFE?

I think it will take 3-4 weeks from the data they received your RFE response.
