Guys, can I suggest something. I think you should contact Rep. Zoe Lofgren (D-CA). She was a chairman of the committee on immigration and she did a ton of stuff to help employment-based immigrants affected by the July 2007 visa bulletin fiasco. Let me know if I can help with anything too.

I think rather than dashing the hopes of so many people, what could be argued is those notified should be granted the visas but on a delayed schedule. Just add 10,000 to the number of people allowed in each year over a five year period and take 20% of those mistakenly granted visas in each of those 5 years. It was DoS's error, not ours.

It would make the US look not so cruel in the world's eyes. That they can take responsibility for their errors, not just let other countries' citizens suffer for their mistakes.
 
I'm so happy someone posted this thread. I have been trying to figure out what to do in order to make my voice heard. Because no what they did is not fair. Telling people they got selected,giving them case number and instructions for then taking this away from them for no other reason than a technical problem. No this is unfair.
The fact they are responsible for what happened can't be put on us.
If they want to respect what they preach the lottery should be done again but only for the people who lost. and yes maybe it means that this year more visa would be given but that's what would be for me the most fair thing to do.

And also...the website was down all next week. They knew what was going on way before yesterday night. Releasing a statement on friday afternoon when all the official offices close?? Way to avoid phonecalls until Monday.

I'm not giving up and I am going to call and ask everyone around me to call the senator of NY where I live.
The chance that this could be turn around is small but it still exist and I believe in it.
 
It has happened in the USA that a winning ticket was misprinted, actually last month it happened to a couple who thought they won, but the newspaper had misprinted the correct numbers....No way they will get a dime...just read the small print.

Good luck getting a Congressman/woman to sponsor a bill like that...In todays economy over here in the USA they have enough on their hands and not really interested in foreigners making a lot of noise.

E2 visa holders have no path to a GC and hardly any Congressman/woman is doing a thing even though there are petitions online that have been signed by hundreds of thousands....do you really think that if all 22,000 would sign that would do more than the E2 visa petition?

I understand that all winners are upset...I would be upset to, but to me it is now time to move on and look forward to july 15th and perhaps they will win again.

My child had just started to be a professional athelete and than a 18 yr old driver ruined the career...did we whine, yes we were very sad and upset but life goes on and now our child almost finished University and starting another career...that is the American way...you get down and get up and get stronger from things that you face in life....on top of that "life is not always fair".

if you can't live that way, you probably don't belong in the USA since American's don't like cry babies and whiners and will move you aside in a second since most of them had to deal with a lot of issues themself.

and I totally understand what you are saying for the way America works and believe me I live here and I know how it is..
but you also forget that they fight for their rights.
What as been done is creatign a huge scandal internationally because it puts America in a very ugly position.
I am not whining as you said. absolutely not. I'm just ready to make my voice heard and try to change this because what they did was unfair and outrageous.

Thanks. Just get people to explain the situation and notify Congressmen in the format of post #5 above. Post #5 also has the e-mail links to all Congressmen. I think any Congressman that suggests a law to resolve this year's mess will look like a hero because this DV situation embarrassed the US all over the world in newspapers.

How about the dreams and hopes of milions that saw on May 1st that they were not selected in a flawed process? Do you think about those people? You are all subjective in this problem and think only about yourself (and that is the human nature - everybody for themself).

There was no hope for the rest at all with faulty selection process. If they never had found out the glitch that would have been unfair too. At this point there's no fair solution to problem for both.

Yes it is madness. We are aliens and first of all US do not want alien immigrants in the country. This lottery helps to keep illegal immigration at bay or at least 50thousand lesser per yr.

No one will cancel the lottery. Just calm down. It is normal that people feel mad but everyone will wait for july 15th.

My name is XXXX and I am writing to you with regards to the US Diversity Visa Lottery 2012. As you may know, the Diversity Visa Lottery is congressionally-mandated green card lottery organized by the US Department of State on an annual basis, and makes available 50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States. This year alone, around 16.000.000 individuals submitted their applications.

To be selected for the DV lottery is a life-altering opportunity for so many people around the world, so there was no end to my happiness to find out I was amongst the lucky few when the results were published on the DV lottery web site on May 1 2011.
As trivial as it may sound, it was one of the best days of my life, as USA and everything it represents finally seemed within a reach.

Therefore, I believe you will understand the dissatisfaction I am writing to express, with the act of the US Department of State declaring the results void and announcing new selection process. Their explanation provided states a programming error has caused more selectees amongst applications submitted in the first two days.

This situation is unfair for the unlucky 22.000 DV selectees, a number provided on the Department of state web site. Two weeks after the results were announced; the officers of the Kentucky Consular Center responding to e-mails and phone calls maintained urging the applicants to send their forms for processing as soon as possible, even though they must have suspected something is wrong with the results. Sending the documents only to find out the results are cancelled caused a great emotional distress for many applicants.

The Department of State has not provided a valid elaborated explanation about the supposedly not random results. For that matter, every year when the results are announced there are allegations of selectees coming from some preferred date. Last year there were allegations that there are more selectees amongst those who submitted application in the last days, and this year the same is about the first two days. You would agree, however, that it is entirely possible that 90% applied during the first 2 days to avoid any risks, hence these results.

From this perspective, it seems that all winners were subjected to a cruel practical joke pulled by the Department of State. Without providing thorough explanation, it seems like that Department of State gave in to conspiracy theorists, who threatened to scandalize the program because of perceived unfairness in selecting winners. Many of the applicants took steps towards processing. For many of the participants in countries with low incomes even these steps are a considerable monetary loss.

Senator/Congressman, having said this, I am asking your help for the following:

1. To look in the case of the DV 2012 results and have the responsible institutions examine the selection process and the alleged computer programming error, and if such an error may have happened with the DV lotteries in the previous years.

2. Urge the corresponding agency to explain to the public what has happened. The drawing for the DV lottery takes place before the results are published, and the agency has the time to verify the accuracy of the results. This year it apparently didn’t happen, and the whole situation caused a lot of emotional pain and disappointment around the world.

Even if the results are not as random as required by law, we like to ask you to look into the possibility of still processing the winners from this invalidated round for green card following the same policies. These results are not by mistake or any violation on the side of the applicants. On the contrary, I am sure all of the selectees submitted their applications in a legitimate way hoping for the best. Rather than dashing the hopes and prayers of so many people around the world, the US Government can demonstrate the fairness it is known for and find a way to make exemption for these people.

My, my, my what about persons who are already in the USA on other visa categories, who are contributing in a positive and cannot get a GC? How would this make them feel to see persons petitioning on the basis of a computer error?. What make these petitioners BETTER than them? They have no LEGAL basis to petition!!!!

We need a lawyer's input in the house...
 
This letter is stupid. Nobody has the right to immigrate to the US unless is a citizen. Thinking having such rights over a lottery game? How lame is that?? Probably it doesnt bother winners as much losing thousands of dollars paying visa fees and then getting denied their GC as having their NL revoked. Why not petitioning then? It really shows that US government can do whatever they want with selected ppl why different now?
I'm just wondering about the ones who also applied early but didnt get to check their status. They wont be in the next draw (if there is at all after this madness) because their CN will be pulled out.
