BEC Letters

I called my lawyer just minutes before , no letteres has been recieved. If any one received letters and have it physicaly please elaborate in detail. :confused: :confused: :confused: :confused:

Guys,

I got this email from my lawyer.

The U.S. Department of Labor continues to evolve the labor certification process away from the state offices. All applications filed before 2003 will be sent to backlog reduction centers by December 31st and the balance of the applications at state offices are scheduled to be sent to the U.S. Department of Labor no later than March 31, 2005.

What effect this will have on processing times remains to be seen. We are hopeful that this will mean speedier approvals, however until we have some actual experience we are unable to tell you how the changes will affect any of the applications filed to date.

As soon as we have some experience with the backlog reduction system and the impact on waiting times, we will advise you. We are hopeful that the unification of the process at the federal level will lead to more expeditious treatment, but nothing is ever guaranteed with the Department of Labor.

Is BRC is processing cases filed before Jan 2003 or Dec 2003 ?

I got letter..but..

I got phone call from the lawyer, and I got my 45 days letter
on the first page. the new ETA case number is assigned as D-*****-*****
Alien's name, occumpation and date of acceptance for processing:Sep. **, 2002. (TWA receicved my LC application, L.O or Priority date).

it was printed on Dec 17 2004, and deadline is 01/31/2005 (45 days including weekend)

Enclosure:
1.selection of continuation option letter (withdraw or continue)

2. corrections list: (I received it because they need my company's proof the business, since my company headquter is in MD, I am working in Dallas...also the phone number in 750a is Dallas number, not MD number. they could not verify the company is real)

3. form ETA 750A&b (address is not matched in 750 A and B....don't know how it happened at the beginning...)

I received 1.2.3, but some other letters are only has selction of continuation letter. so I guess each case is different.

I guess the most important is how to reply the letter with proof of the company...need the documents from MD..sigh...not as simple as I thought..

share it with your guys since everyone wants to know what inside of letter...me too.

Lucky guy he actually got the famous letters we have been talking about all these months. Wonder when Philly DOL is going to send letters out, no news from Tomshu about letters and "lady". :(
 
Indeed applicants applied from other regions apart for Philly are lucky.
I guess 'Tomshu' may well be on vacation or has no information to share. Hope is things will turn around for us.

Promotion and LC at Philly (Ex: Analyst I to Analyst II)

With the LC at philly i've been postponing any change in my title in regards to promotion, could anyone clear few things for me.

Is there any link or website with official explanation on what can be done and what cannot be done in regards to change of Title:

Example Softwate Specialist I to Software Specialist II

Kind of situation where the employee is getting promoted.

Is this ok?
will this impact the greencard application in anyways?
Is there any official documentation available which i can share with my HR to make things clear to them.

As per the letter of the law, a labor is given to a particular post - S/w 1 or S/w 2. The 140/485 etc is based on the labor... so you know where this is leading....
Technically, a promotion in title and change in duties is the same as a 'fresh' job and requires a new labor.

In practice, however, nobody at CIS cares about your current title. As long as your salary is not less than the prevaling wage at 140/485 stage, its ok, unless you are dumb enough to poke your promotion up their noses.

Your best bet is to do nothing.

Promotion is not a problems as long as major part of your duties is same... From Speciliest I to II or Engineer to Sr. Engineer is fine.. You may only face problems when the role changes.. for example Sr. Engineer to Manager & similar.

No Need to inform anybody (DOL or USCIS).
 
Letter

I called my lawyer today and came to know that they have received one letter from BRC and she said there is some movement from BRC finally.

This is letter is for some other candidate not for me.

You mean letter from Philly BRC right? We know Dallas BRC have started sending out letters. Just wanted to make sure you talking about Philly.

Looks we are looking at santa delivering us our letter for christmas.... ;)

Can you give some general info abt the case - Like RIR/Non-RIR, Sesa received approx date, and Philly DOL received approx date? I mean abt the case for which the letter was received.

Can you please post your Priority Date and which state you applied. So we can get some idea about when to except for letters. Thanks a lot for sharing info with us.
 
I was a silent reader of this post for about 6 months. Finally i have something to share with.

My employer said he recieved a two letters for the same case which has a PD of APR 2004 in Philly SWA. One letter stated that the case moved to philly BEC and the other letter was 45 day letter. This is not my case. So far my employer has been trust worthy

I dont have any update on my case
