Send this suggestion to PBEC.They may like it also.We should do something that will be helpful for all of us.If all members of this forum send a letter with this suggestion to PBEC they may consider it.

Also, why don't they still have a case status web site? I understand that they have not completed data entry yet but that's OK (well, it is not ok but what can I say). For those people, the status might just say not in the system yet or whatever. What are they waiting for? The problem I think is that, as has been mentioned before, they have skipped a lot of 2001 and early 2002 cases and they still are not able to process FIFO and they don't want this to be out in the open.

I have applied for my GReen Card (Labor) in Dec 2002 from New York. Could you tell me what is currently being processed in PBEC and approx. when I can get the letter to my employer. :confused:

No one knows except PBEC. Ask you lawyer to enquire directly.

Refile LC thru PERM

I have a pending LC in the Philly BEC, with a PD of 12/03. I would like to know if I can refile my labor through PERM and retain my priority date. Can 2 cases be filed at the same time? One pending at the BEC and another via PERM?

Yes...I thought about it but that would be my option if I have to change my employer or this area that I don't see that in near future.

Between owning 3 mil properties doesn't mean that I have that kind of money in my pocket (mostly it's been financed by banks) and I can't cash out equity until I sell them.

No - we have not heard of any approvals over the last week.
I guess PBEC has gone into hibernation again.
They make a few approvals and then they have a software glitch for a few weeks.

Since Dec 2002 I am trying to find it out, but no success. Please let me know if you find something out. I am worried and confused too.

BTW, they have huge backlog in "investor visa" even though

Its really pitiful if you have invested 1Mill and they you are in a backlog of 10 years.

I think looking at the current sorry state of US immigration, they might have to reduce H1s instead of increasing it.

Just spoke to these guys at PBEC...

Atleast one thing they do for sure is pick up the phone...!!

As usual they have no answer to any questions... 'Why this long delay while Dallas is processing 2003 cases..he says all of a sudden we got some 180k cases and we are stuck there..partial data entry is done. Pls email or fax Stephen Stefanco with your concerns..(or who ever he is)...'

I think one Monday morning we shud go to this office and meet the big boss in person...Thay are so cold-blooded and indifferent....

If Someone else can pls call up this office who can communicate well and not show our temper to know what is happening inside...

Refiling under PERM

I just saw an article on www.murthy.com on this.
Main points are :

1. This is more or less a grey area where no clear rules have been laid out. There have been cases where original priority dates are maintained. You should proceed with a lot of caution and an experienced lawyer.

2. There could be a guideline laid down in future with a short or no notice, which completely blocks the possibility of retaining original PD. This could hole you up. Its risky.

God knows what this partial data entry is... and they will again play foot ball/soccer with those same files next yr for full data entry and if they find any time left they will decide our cases maybe...??!!

Such a dumb idea to do partial data entry and then again full data entry...
they have worse than pigeon-brains...

BTW...who is this guy...is he appointed by DOL or he managed to get the contract data entry job...

I called them yesterday and one "lady" answered it. I asked the same question" why this long delay while Dallas is processing 2003 cases" Her answer is " I don't know, I am not in Dallas". What a idiot!!
 
How to interpret Status from H1B7YR e-mail response

I think PBEC is now being consistent on not revealing the STATUS field in their Pending Case Screen Snapshot from H1B7YR e-mail address. I noticed that following fields are empty in my case:

- Occupation Title
- Occupation Code
- Prevailing Wage

Does anyone have any idea that at what stage these fields are filled (if ever!!). Correlating the fields' data entry might help to reveal the Case Status!! Thanks Guys
 
He is the director of PBEC, the only reason of this messy delay. His extension is x507 and you can find his email address from google.

Lets put aside questions on how to figure out case status from missing fileds, or which email to send to check case status, and quit cracking jokes about DOL. PBEC is not moving. We need to see movement. No matter in what order they work, one approved case is one less case in the queue. DBEC has been crunching out approvals everyday. While PBEC's production has been so pathetic. We have to shout!.

I will fax the complaint to this Stephen Stefanko guy PLUS faxing to all the senators in the previous list.

I also asked my lawyer for an update. Will keep you posted when I hear anything.

From the tracker on Oct 24th i noticed that PBEC with ETA P-04286XXXXXX. I have my previous employer filed in PA which was in Regional - RIR-EB3 and I had a screenshot from the past with ETA P-04274XXXXXXX with PD of Dec 03. does PBEC take and approve (or reject) per PD, case type or ETA case number? They had a 45 day letter in Feb 05.
