As of today total Processing time for I-140 & I-485 is almost same for both EB-2 & EB-3. While Visa avlibility date for EB-2 is Current & April-02 for EB-3

Even though her case moved to Philly with a date 4 months AFTER me ,she got the 45 days letter first.
Now,i guess we have to wait for Mr.Bush to finish talking with the presidents of Mexico and Canada,March 28 PERM,April 30 last day to ship the cases ,and hopefully May 1st first approved case from BEC.
I applied for my GC April 2001.Still hoping

1. Assuming my Labor (Fed) gets cleared at the BEC (whenever that happens). Once that happens...i know i can file I-140 and cannot file I-485. Am trying to find out when can I file I-485 ? based on the current scenario....

gp111 said:What is your PD ?? If you ware born in IN/CH/PH, you may be affected by EB-3 retrogression. SO when your LC gets certified, check if Visa Number is available for your PD ( As of today its available for PDs of April, 01, 2002 & earlier,.. Its moving 1 month forward each month)..
If your Visa number available for your PD, You can file I-140 & I-485 concurrently.
If not available, You can file I-140 & wait for Visa Number to be available for your PD for I-485 filing.
FOR Example,
Say your PD is August 2002. When you get your LC, if Current Visa Bulitin says EB-3 Availability if for Sept 01,2002 THEN you can file I-140 & I-485 alltogather. BUT IF Bulitin says August 01, 2002 (or earlier), You may file I-140 .. Wait till bulitin date changes past your PD & then file I-485.

Your Labor is Valid as long as the new company does not withdraw it. Are they gonna close down the office ? If they keep one of the office (small office/one department...) then you may continue the LC process & Get 9th year extension

Company name does not matter as long as they can provide proof of merger/buy out ..
If I ware you, I also file a Fresh Labor (PERM) from new location & wait for which one comes first.

My lawyer and employer got a letter stating above. My case details. My lawyer responded to this letter stating that response to 45 days letter was Fex Ex on 01/07/2005 with documentation.
