Philadelphia Backlog Elimination Center Tracking

Surprising to see this lots of differences in standards in just two BECs..
I think there will be multiple sets of rules that might be applied to select and approve the applications within each BEC..established by different group of workers.

Offcourse BECs can afford to be inefficient in all ways and still survive since their customers are the most vulnerable 'immigrant' community.

Given up on PBEC

Folks,

I have given up on PBEC. There is an upcoming position in our company which requires MS + 3 yrs or BS + 5 yrs and they are willing to sponsor me for this job. Previously, I filed under EB3/RIR/VA/July-02. Now, it will be EB2/Jan-06.

Any comments?
 
If it makes a good difference financially i would suggest take it.Any way there is a lot of lobbying going on to remove the PD and you may get lucky if that happens with a faster PERM labor.

Again thats losing a good PD.

I wouldn't hesitate, the old filing can keep its course while you apply for the the new one. Those are two different positions so it should be ok ... you can always go back to the older job if it comes through quicker ...
 
Given up on PBEC

These are two different jobs. My lawyer tells me that we can keep both live, and then choose the one approved first along with the retrogresstion consideration. He tells me that the PD on the old application will still stay the same. Does that sound right?

Looks like DBEC is following its own rules like clearing all the REGIONAL-RIR's irrespective of the PD and gettting back to the other categories.

I agree, they've definitely decided to do all Regional before SWA, because, if you think about it, it is easier for them to do so. Think about it, cases from Regional had already been approved at the State level, therefore the BEC officers just have to quickly review and approve them, as opposed to State cases, which need to go through the entire review process, whatever that means.

The problem with that is that they're reproducing EXACTLY what was happening before the BEC's ! Before the BEC's, some states were faster than others, or had fewer cases, and therefore were approving cases faster. The very own REASON for creating the BEC's was to create a single queue, regardless of state, etc ... and that's exactly what's NOT happening at the BEC's.

I dont have a case number, 45 day letter. Can you guys point to me how to get a screen shot of LC for my upcoming 7th year extension? I sent an email to the phily Backlog center ID requesting my screen shot. I dont have any reply whatsoever from last month or so.

Yes, whoseever LC gets certified they get into line and if the present proposal gets through, then whoever gets their LC certified can apply I140 and I485 together irrespective of whether a Immigrant Visa is available or not. And, then the processing of the application happens w.r.t the PDs. I believe that this is a very good provision for all of us, irrespective of whether
we are in PBEC or DBEC.

And, yes, there are provision to recapture 90,000 Visas from previous years and since there is no $ amount associated with that, I don't see that going through and getting passed in the Congress. So, PBEC or for that matter DBEC people need not worry too much about that.

WE NEED TO FIGHT TO GET OUT OF THIS BEC HOLE and that's it. PERIOD. And, we ask for everyone's support. There are few people here who are taking initiative, PLEASE HELP THEM AND HELP YOURSELF. CALL, WRITE, AND GET HEARD.

WE ARE LEGALLY HERE AND THERE ARE LAWS THAT GIVES US A WAY FOR LEGAL IMMIGRATION. SO, LETS GET TOGETHER AND FIGHT FOR THE INTENT OF THESE EXISTING LAWS.

VGANS - What is really wanted from the group who is fighting for the retrogression is a bit of transparency and fairness in their fight. Why this group does not have any agenda to address the issue of enforcing true FIFO system in the whole GC process? When you talk about making priority dates current, no one wants the visa numbers being taken away by the people (PERM filers or may be DBEC approved guys) who started their GC process later than some unfortunates like us?

Why don't you people have some sympatnhy on us (who are suffering from PBEC onslaught) and spare this thread from whatever your personal agenda. I checked history of ----, ------ (removed names) and many others who suddenly started posting desperately about visa numbers and it seems fishy.
Some of them are all over the board with topics ranging from I140, Labor, DBEC, 485, I140, H1 etc. Most of such people are clearly associated with some law firm.

It also sounds conspiracy that their awareness effort has not a single note about BEC delay.

Imagine,
who is affected by visa retrogression and not by BEC delay ? Nobody, except lawyers (and recent DBEC applicants whose labors were cleared after Sept. 31, but they are very few)

Why in the world we give damn about increasing H1 numbers ? Then who are these people who are advocating increase in H1 numbers ? I would rather advice any newcomer to stay away and go for Australia instead of face US immigration beauracracy for life time.

Just search for posts by these people who are supporting visa awareness, they never posted on PBEC thread and suddenly they started making calls to senetors !!!

They are over smart. They tactfully combined H1 cap with retrogression issue in single bill. If you support retrogression, you are supporting H1 cap increase. Choice is yours. Our biggest problem is dumb PBEC, need to shout against it. WE NEED JUSTICE.
