Guys, I agree that PBEC should be our primary focus. I am doing my best to raise awareness about PBEC as recommended by the gurus in this forum. But we should not be unaware of what is coming ...thats my theory atleast.

You are right, but ....

Mockery,

You have repeated this sentiment many times before and I do agree that visa retrgression and/or unavailability is not our immidiate concern. PBEC backlog is.
But here is the thing. We know visa retrogression is a problem. We are doing what we can for PBEC backlog. While there is only so much we can do by faxing and mailing our concerns in every possible way, it does not hurt, to start paving the way for our future, coz for all you know, one day our labor might just be approved !

Guys , please continue to fax and snail mail the hell out of the people listed in this forum. as far as visa retrogression goes, we hope we have to deal with that sooner than later.

I have to say that I 100% agree with Mockery at this matter, especially at this point of time. Today I finally make up my mind and followed Mockery's links and did something which I hope will be helpful to all of us.

Your frustraction is very right on its place. But even though USCIS approves this, the other guys are in queue and retrogression will not end up in days. It will still be there before you get your labor approved. Be positive.

The issue of retrogression, if resolved soon, many who have their prioririty dates are earlier than 2002/2003 and still at PBEC will definitely suffer. The moment more visa numbers are recaptured, they will be taken away by later PERM filers and people from DBEC who got their labors approved before PBEC guys.

Just it is frustration... No fairness I am seeing in this whole system.

Why in the world you keep sending for screenshot? And you are surprised you don't get a reply? I hope they have a way to track the e-mail addresses that are abusing the system.
 
I have started to appreciate what Mockery has been saying all along...
It is very likely that the visa numbers would again become current or progress substantially.but without labor all that is bull**** . All perm guys would again start using up the numbers..We should concertrate on the PBEC and not worry about the visa numbers....Each year they come up with some visa numbers one way or the other.....The labor dept. is the one really got us by the short and curly....

This is all the results of lawyers'/employers' lobbying efforts. What happened to the provision to allow I-485 to be filed, even if visa numbers are not available if I-140 has been approved? It looks like that this has been conveniently dropped. CompeteAmerica is an oraginzation of top corporate firms and hospitals and research insititutions. They would not like portability of employees at all.
 
I don't think this particular proposal is fair to people with older cases stuck at BECs, especially those at PBEC. Frankly, I think it's sensible not to focus on proposals like that.

Hope all the 2001 cases get cleared. There should not be many 2001 cases left. I am MD too. PD = Sept/2001. RIR. EB2

We need to stress this in our letter to senators.


The worst of the two BECs is the Philadelphia Backlog Elimination Center (PBEC). While the Dallas BEC is proceeding with regular approvals and with approvals as far as application date of August-2003, the PBEC seems to care less. PBEC has not even finished partial data entry for more than half of the applications and have been randomly approving some applications with absolutely NO regard to FIFO (first-in-first-out), which the DOL had promised during the inception of the BECs

PBEC or/and Retrogression??

There have been a lot of arguments about whether we should spend more efforts on trying to do something about PBEC backlog or Retrogression? Different people have different vested interests (and that is not a bad thing) and hence different opinions.
Here's my take. I think its fair to rougly categorise people who are stuck at PBEC into two groups : People with priority date between 2001 and Middle of 2002 (lets say June,2002) and people with priority date later than that. People belonging to the first half would definitely be concerned about retrogression as they generally hope that their LCs should be cleared within a year (I'm talking about hope not what actually happens) and then they would have to face the retrogression demon. The latter half might be more worried about expediting PBEC without worrying about retrogression as that is something that they don't see affecting them right now.
So, there's nothing wrong if a group of people thinks visa retrogression is a high priority (including me) too. After all, the final aim for all of us is a green card and all of us see the coming obstacles in a different way depending on our approach to things in life and our position in the queue. If I have to do something, I would see which present or future obstacle is on the platter right now for discussion. If I think that some new bill is talking about retrogression and releasing more visa numbers is going to help my case, I would go voice my support for it. Doing that is not going to adversely affect my PBEC case as they are not mutually exclusive items. Also, I think people who want PBEC to expedite the process are looking for additional resources to be allocated which means additional funding. This characteristic does not compete with the release of new visa numbers. This is not to discourage people from raising awarenes about PBEC but if you are someone who is in the PBEC queue and expects to see an approval in another year, you cannot ignore visa retrogression.
 
I also had read about the propsed rule of being able to file 485 even if visa numbers not available. immediately i thot that wud be great because then atleast the spouses can get ead and 140 portability thing can be used. but then i read carefully the proposed text-it says that ppl who have pending 140's will be able to file for 485 with ofcourse extra fees, but what about ppl who got labor cleared in last month or two and filed for 140 alone(since 485 can't be filed) and who have gotten 140 approved also. this is the case for me. my PD of feb2002 approved in sep2005, 140 filed in sep 2005, 140 approval came in oct 2005. Now even if this new proposed rule comes into affect,will i be able to atleast file 485 or not?????

Supposing your labor PD is 2004. There are people who get their LCA approved in one month in PERM and can apply for GC. By the time your LCA is approved, if all the GC numbers are finished, will it be not a concern for you? While we may worry about GC and retrogression, what Mockery says is that put more efforts on LCA and I feel it is justified. Sorry to disagree with you.

I agree with u. Can't imagine hanging and holding onto the same job in limbo. Very stressful up and down cycles you have to face year in, year out. My case is still further behind you. I am still freas tobe seasoned before placing in the oven to bake

The amount of cases currently being processed is sufficient to use all available numbers in many categories. The level of demand in the Employment categories is expected to be far in excess of the annual limits, and once established, cut-off date movements are likely to be slow.

Just wanted you to know ,a-plicants from atlanta have got 45 day letters.I got mine In may 2005.

And my PD id june 2004
