Philadelphia Backlog Elimination Center Tracking

Every one is as anxious and frustrated as you are with what is happening to their cases. Please curb your anger and do not vent out your frustration on others. Of course any body in their right frame of mind would like to check their status to find out what is going on with their case. It is a very frustrating time for all of us, and some go through different, challenging situatations than others, so please be more supportive to each other.

Hey IndiraGandhi, Why did you change your name?

ben123,
I am applying for the 7 year extension, got a reply from PBEC, mine is missing
'Case status' too.
These are the fillied in fields in my email
ETA Case Number: T-XXXXX-XXXXX
Processing Type : TR (I don't know what this means, any clue?)
Employer Name : XXX
Alien Name : XXXX
Proirity Date : xx/xx/xxxx
Case Source : State (any clue as what this means?)
Processing Center: Philadelphia Backlog Elimination Center

Is there any one who could explain as what is Case Source and Processing Type.

Thanks
I think, Case Source means, where they got your case from...Like your case was transferred from the State directly without going to the regional offiice, or first your case was transferred to the regional office after clearing state level labor certification.
Ours was already cleared at state level and went to the region when the BEC was created and then it was transferred to the BEC, so the Case Source says "Region", if yours was still in state while BEC created, the Case Source would say "State".
I think, "Processing Type" refers to the RIR or Non RIR..
Guys, correct me if I am wrong

I wish if a senator would have suggested to process LCA at BECs within 6 months by paying a premium fee of 1000$ :) Here everything comes down to dollars and cents!! They need resources, go & get the resources, we gonna be paying!!

Good pont. They might approve this because of $$'s.
Shall we include this point in sent.doc???

Speculations, Estimates on PBEC Rate of Progress

My friend heard from her lawyer that it would take Philly BEC approximately 18 months more to get to 2003 cases (the lawyer presumably got the information from a PBEC insider). I know it's just speculation and hearsay but it's better than absolutely nothing. I'm curious whether other people have heard any estimates from their lawyers.

10/21/2005: AILA Confirms Following Details of Senate Judiciary Approvals Yesterday

According to the AILA, AILA has passed the following immigration proposals yesterday:

Impose a new $500 fee on immigrant visa petitions for the EB-1, EB-2, and EB-3 categories.
Recapture unused employment-based visas from prior years for immediate allocation of up to 90,000/year. (Estimates indicate there are only 90,000-100,000 unused numbers to be tapped.)

Exempt spouses and minor children from counting against the annual cap on employment-based immigrant visas. (Estimates are that this would lead to an annual increase of 80,000-90,000 employment-based immigrant visas.)

Allow individuals to apply for adjustment of status before an immigrant visa is deemed currently available. (Of course, approval could not occur until the visa number is available.)

Recapture approximately 300,000 unused H-1B numbers dating back to FY 1991. As a result of Senator Feinstein's amendment, 30,000 rather than 60,000 would be available annually. (In other words, effectively raising the cap from 65,000 to 95,000 for at least 10 years.)

Impose a new fee on the recaptured H-1B visas so that the fees on the original 65,000 H-1B allotment remain unchanged but the additional 30,000 available annually carry an additional $500 fee.

Impose a new $750 fee on L-1 visas. (This was part of Senator Feinstein's amendment and was necessary to offset the reduction in revenue resulting from the limitation on recaptured H-1B numbers from 60,000 to 30,000.)

We agree with the AILA that these are not final bills and we have a long way to go to make these proposals into a reality. Businesses, academic institutions, and other stakeholders should keep working with their Congressional representatives to support the Senate Judiciary bill.

------------------------------------------------

Everything is going good on retrogression side.

If the above bill is approved and comes into existence,

all the labor approved people at DBEC and PERM can file I485 and get EAD( in three months) and AC21 Portability benefits( in six months) and we all from poor PBEC wont get nothing except watching others file there I485 and waiting at PBEC for our dead labor.

Come on guys start sending letters and faxes.

bush words

i heard that he has said eveything will be up to date by the end of 2006 and this lawyer saying 18 months for 2003 ?????????
any truth in either of the words???????????

18 months is too long. By that time DBEC would be finishing the remnant of 2005 cases if the dudes over in Dallas keep their approval rate the way it is today. your attorney is probably telling you not to nag him for the next 18 months. Mine also told me, unless I am really lucky, to forget about my case for at least 6 more months.

June 2002 Regional Cali RIR case
still waiting in-line behind the piles of NJ/NY and other east coast cases which I pray they clear ASAP

Hello forum members,

Today I have sent an email to PBEC to get the 7th year proof of my LC and got the response in 2 hours with the T case number. There is no Case status column in the screenshot though.

One strange thing I noticed is my PD is entered as 9/20/2004 instead of 8/20/2004. Is there a way to correct this PD by contacting the PBEC? Can anyone experienced the same issue and if so guide me to correct.

Thanks for your time...

JustWatching: Could you please update me case information in the tracker spreadsheet? Thanks!!!

You will not see case status in the screen shot as this field has been moved to other section of this form. Anyone who is sending email for 7th year extension will NOT SEE this field anymore.

yes there is, it happened the same with me and others ... it's a data entry typo. Have your attorney email them (using the same h1b address), requesting the PD to be fixed, and they'll do it.

status definitely gone

just got my screen shot, the status is definitely gone. Guess we've overused it, and they changed the software.

Now, isn't it crazy how paranoid they can be ?! they changed the freakin' software to display a different screen just to AVOID us using it to find out the status ! it's bizarre, really.

How hard would it be for them to develop a simple email response program that would return status based on a given case number !?

I'm sure we could give them a VB program to do it for free, and in a couple of days ... their IT department is pathetic.

June 2002 Regional Cali RIR case

Your PD is Jun 02 and your lawyer said at least 6 months. My friend's is May 03, and her lawyer said approximately 18 months. These two situations do not seem inconsistent to me.

EBn

I'd say it does matter to check it when you file the LC. When I started my LC long long ago, (no pun intended), I was told that it does not matter. So I didn't bother to find out what should go there and ended up with BS+2 years i.e. EB3, even though I was eligible to go for EB2. I am now stuck with filing under EB3. Now I know that I cannot move to EB2 as my LC is eligible for EB3 only - too late!

Does it matter whether you are Eb2/EB3 during Labor Approval. ?

my point was, no one really knows how long it will take. the answers both I and your friend received were political ones. right now, it seems that PBEC is focusing on data entering thousands and thousands of SWA cases from NY and NJ. tons of these cases belongs to 2001 and 2002. unofficial news claimed that this phase will finish sometimes around March 2006. Until then, PBEC will not issue any time lines. So, we don't expect to receive any answer to your question "when will my case ...." until these SWA cases are fully entered into the system, and their corresponding 45d letters printed, mailed, processed, and mailed back by the beneficiaries. still however very few number of contractors currently working on adjudicating cases already entered into the system.

I am following this forum for quite a long time and I have seen such unofficial "timeline" many many times: and none of these timelines were met.

Data entry deadlines: Feb 2005, Summer 2005, Mid-October 2005, December 2005 and now March 2006.

Its barely November now and there are many 5/2002 applicant who haven't received 45 day letter yet (me too).

So now what ?
I guess, we already raised awareness or whatever regarding PBEC, IMHO, we should now focus on marketing this forum and yahoo group. I know many PBEC victims who either don't care or are just ignorant about such effort. So I think, we should spread word out to our colleagues and friends (whose labor is pending at Philly) about the problem. We should encourage them to join yahoo group and visit this forum regularly.

I sent email and fax letter to senators Below....

You could/should also write letters to the editors of newspapers.
