Philadelphia Backlog Elimination Center Tracking

Is country of citizenship OR country of birth the key to determine if one falls under regression, as in my case these two are different. I am hoping it is the country of birth that is the determinant.

Right now EB2 is current, however one of the reasons is that DOL has been stagnant for the last couple years.

....PD is very important for certain people and you have to always assess the situation yourself.
 
case status code

some folks summarized the code from the response from Icarus on Dallas board. Suppose 2 centers share same status code.

1 missing is final review.

a) Certified - Certified waiting for Stamping and may be Enroute
b) RIR - 45 day reply recieved under Process
c)Data Review - 45 day reply not yet recieved
d) State - Case recievd from state
e) Regional -case recieved from RO office
f) Overridden - Check intially failed but manually overridden

Thanks fogman for clearing the fog. I think I am going to risk losing my PD (03.2004) at BEC and instead prepare to file under PERM. The probability of EB2 retrogression for the country of my birth (England) is I assume, quite low. In my case, this is a risk worth taking.

The move to PERM is individual and one should talk to a qualified lawyer before taking the irreversible step, assuming forfeiture of PD is required. One does not want to make an already bad situation worse!

You need to wait, i received after 15-20 days after sending email...

You received 45 day letter back in June?

Not bad. With SWA PD 10/29/2002, do you feel lucky? Many people with Priority date way ahead of you have received nothing yet.

Labor Approved!!

Guys:

Just received an email from my lawyer that my labor has been approved! :)Could not believe it since my PD was later than many on this board. Have not seen the approval in hand. May not even see it until few weeks until they apply for 140/485 for me, my lawyer told me.
Labor was approved on August 1st and received on August 10th, 2005 (Today).
My details are part of my signature.

It is quite possible that your case was put into "certified" category by a processing analyst and it may now be sitting on the Certifying Officer's desk for "Final Review". I encourage you to be hopeful!!!

thanks for the encouragement mvinays! everything is possible with bec as you may know by now. i remember from past info posted a while ago that "final review" only means recommended (not certified). it's up to the CO to then either deny, certify or issue NOF. who knows how many people are stuck at this phase? well, maybe i am pessimistic given how long i have been waiting or all the things i have seen dol/bec put us through...

when did u receive your 45 day letter..

Congratulations! Finally a RIR case after April, 2001 is certified! Now, crossing your fingers and wish the best from Oct. 1. At least, you don't have to wait here any more, and maybe you can have 3-year H1B extension instead of one-year. Good luck!

mine is also same case. so what i concluded is because we dont have the 45-day letter and we dont have the D- or the P- number, they are taking time or they wont even reply to us...
If you have to really apply for the 7th/8th yr extension, then the letter which your lawyer got when the application(LC) went from state to federal should suffice....

File 485 as EB2 and see what happens, i think it costs only 200.00$!!
worth trying, talk to your lawyer for more info, get second opiniion from rajiv or murthy...
