Labor was approved on August 1st and received on August 10th, 2005 (Today).
My details are part of my signature.

Good luck to all.

dcmetro22042 Congratulations!!!! I am very happy for you. File 140-485 ASAP!!!

It is now confirmed that Philly is currently processing ALL REGIONAL NON-RIR cases. Your LC case dates are very similar to mine. It raises my hope! :)

Thanks for the warm wishes Orissa. I agree with you. Do feel lucky. I sincerely wish for everyone on this board to get the labor approval and GC as soon as possible. We all have been working hard to earn the status.
And thanks to Aprl2002 for wishes and regular updates on this thread.

Dont worry! Your PD is 2001. By Oct'05 PD will be close to Jun 2002. Do not take any risk. Just wait few months!.

Now you can submit I-140.

Congratulation!!!

Thanks Cherrygums & mvinays. mvinays, you can't be far behind since we have been neck-to-neck with everything, except that mine was non-RIR and yours was RIR.
I am too hoping that my lawyer files 140/485 soon. Knowing them, maybe by 15th of next month! Not the fastest lawyers out there!

I have been an active member long time ago and became a silent watcher after that. I recently got the screen shot of my case for 7th year approval. But I noticed few errors as follows

Case Source: State (It should be regional, because my case has been sent from Atlanta US DOL)
Rate of Pay: $ 57.45 / Yearly (!!!!!)
Prevailing Wage: $ 57.45 / Yearly (!!!!)

I am bit concerned about the case source because it seems like BEC giving first preference to cases which has been forwarded from regional dol. Is there any way I can make them to correct this mistakes?

My case RIR, PD 07/09/2003, GA, ATL DOL, Philly BEC.

CONGRATS ! All the best for your I 140/485. Cheers !

Looks like the BPC are WELL aware of the visa number availability and have clear instructions on what to do!!

They know that even though they clear LC for non-rir cases, it doesn't matter, as we can't apply for 485!! that's why they are working on later EB3 cases , when they have EB2-RIR cases from 2001/2002, with 45 day letters responded back to them in DEC'04/Jan 2005.

I bet if next week, we hear that the visa numbers are current for EB3 and unavailable for EB2(god forbid though), these BPC, will stop working on non-rir EB3 and suddenly start approving EB2/RIR cases even from 2004!!

Anyboby with me on this?? I bet again, everyone is LOL!!

dcmetro have you check your case status lately by sending email to Philly BEC? If so, please let me what email address you sent to.

Thank you

Congrats, Dcmetro

Csrini,

I don't think Philly are sophisticated enough to discriminate against EB2. They just put priority to TR queue, which most of us can’t never understand. I really think EB2 and EB3 will come out approximately same time, other things are equal. The only thing make difference would be TR/RIR, and maybe Regional/State.

Also, for your next concern. If you qualifies to EB2, you can choose freely file as EB2 and/or EB3 during I-140. Actually some attorney suggests filing 2 I-140 concurrently.

i'm done

i'm done ,
i've tryng to give alternatives to the good folks of this thread.
PERM, H1b1 extension, EB2/EB3 are in my opinion matters related to a unique purpose , wich is LC and permanent resident
PERM worked for me, suggest than we are "killing" the forum talking about that matters is simply bizarre.
rude comments as yours certainly will kill the forum
i'm leaving and good luck for all of you
special thanks to Juntha for his good advices

Let me give one suggestion, why don't you people open 5 new thread

- How to convert RIR cases to PERM
- Help me choose "stay put" to RIR or file PERM
- What is PERM
- What is retrogression
- What is EB2 and EB3, how can I switch from either

PERM has nothing to do with PBEC, I just don't get it, why people discuss that here and clobber PBEC discussion.

PERM is complex, it can't be decided or implemented just by someone's suggestion on the forum. So talk to your employer and lawyer and stop killing this thread.

data help

Can anyone repost some old information that I saw somewhere here [i forgot the thread].
The information i am looking for is the # of cases [RIR and TR] pending for each month from Apr'01 to dec'04.
So far I can remember for RIR cases after Apr'01 and May'01 is done then there are not that many cases left. I just want to me more certain.

Thanks,
rim

PD: Apr'03 [FL]
RD: Sept'03 [ATL DOL]
no 45 day letter.
