bharatpremi, you are eligible to submit for RIR-conversion per the new "safe harbor" policy. The only caveat is that you may have to consider any resumes that come to PBEC in response to the AJB job order that was posted a few days back for your case. You do not need to engage in the supervised recruitment activity. Please review the new FAQ and consult with your attorney.

You are simply great man !! You have made my day today. I just copied the FAQ link and about to send it to my lawyer and my lawyer called me about this faq. He will go through that during this weekend and plan a strategy. Yes, I am in for RIR conversion.

You are most welcome. The FAQ is crystal clear about what you'll have to do. Your attroney should immedialtely send the email stating intention for RIR-conversion, and then wait until Feb 1, 2007 to submit the RIR-conversion package. This gives PBEC time to send any resumes to you that might have come in response to your AJB job order. If you don't get anything from PBEC by Feb 1, 2007, you are good to submit the RIR-conversion package. In case they do send something, you may have to do 2-3 weeks of follow up on those resumes and ensure they are included as part of the recruitment report.

Congrats !! My attorney and HR manager both are enjoying holidays and I am just sitting anxiously for holidays to be over so I can make them steered in for RIR coversion request.
 
Update: My attorney has sent the email to PBEC requesting my case to be converted to RIR as part of the new "held harmless" policy published on Dec 22. RIR efforts were completed before Dec 22nd so I guess within this week Attorney may send the RIR package to PBEC.

Who can attend:
The meeting is open to all who are interested in the cause of elimination of retrogression. Their families and children are welcome as well. Besides Massachusetts, people from neighboring states are welcome to attend as well. You can attend whether you are a member of Immigration Voice or not. Meeting is open to people from all races, nations & ethnicities.

Meeting Format:
The meeting will start with lunch. As most of the people will be meeting each others for the first time, it's better to socialize first before getting down to the nitty-gritty of the meeting. It's a potluck, so everybody brings a dish to share.

Spouses and children are welcome as well. There will be separate spaces for spouses to socialize and children to play during the meeting.

How to Attend:

waiting for LC. people who filed after my husband in his office got recruitment instructions(who filed june and july 2003). only difference between them and my husband is they all r EB3 NON-RIR and ours is EB2 NON-RIR. i donno what is going on.if anyone in this priority date and didn't get recruitment instruction please let us know.

TR - RIR conversion

Hello Friends,

Here is an interesting scenario, our company decided to go for RIR conversion as per the October rule. So we started working on it and package was sent on Dec18th 2006 and courier was received by DOL on 19th we received the confirmation for it. Meanwhile my job was appeared in AJB on Dec 14th but we did not receive our RI until Dec 21st, so that means according to the October rule I should be safe to assume that, RIR conversion went through smoothly. Also adding few more interesting things, there was one more ruling for “safe harbor” you can send an email to the DOL for intent to convert to RIR. So, I am confused what is going to happen to my case. I have checked the status it said RIR and INPROCESS. There fore I am anxiously waiting what is going to happen. Whether we have to wait for DOL to send us the received resumes from AJB or they just ignore them?.

Our lawyer says we would be safe either by October rule or with new safe harbor rule.

I thought of sharing this information with you guys.

My PD is July 2003/EB2 and I received RI in early Dec. Has your husband's job been posted in AJB?....He will/should have received RI ones it gets/got posted. Check with your lawyer if you see the job posted in AJB. The lawyers may be sitting on it and DOL only gives a month window of opportunity to complete recruitment when RI is sent (although the notice comes a week or two in advance).

On another note.....Has anyone here received approvals for a non-remanded, non-regional traditional case?

Reply message body is as under:


The Backlog Elimination Center has received your request to convert the case referenced in the subject line to an RIR case. Your case is being put into “hold” status pending receipt of your RIR Conversion package. You should begin recruitment and prepare the RIR conversion package summarizing the recruitment activities and results.



You must send the RIR conversion package to the appropriate BEC in hard copy, by regular mail, certified mail, or mail courier, with the subject “RIR Conversion Package – [case number]” no later than April 1st, 2007. If no package is postmarked for receipt by this date, the case will be closed. The application will not revert to the TR queue and the decision to close is not subject to appeal.



The prevailing wage determination for recruitment is: $--,--- per year. You must recruit at 100% of this prevailing wage.



If any recruitment activity had been initiated for this case and the BEC receives any resumes, they will be sent to the employer on or about February 1, 2007 to be considered as part of the RIR package.



Note that receipt of this e-mail does not necessarily indicate that your case is free of deficiencies as for some cases, the BECs may be performing only preliminary application screening sufficient to provide prevailing wage determinations to employers to assist in recruiting and preparation of the RIR conversion package. There may still be deficiencies in the application that result in the RIR not being approved, in a Notice of Findings being issued, etc.

Hi,

I have been following P-05175-83731 number that had a job posting on AJB on sept 22 2006 in MA.
This number now says certified on DOL.

A few other numbers that I'm following are from middle of Oct 06 (job postings) and they are still in process.

There is no way DOL can meet sept 2007 deadline.
 
My recruitment period ended on Jan 15th. Today our HR person let me know that they had received a letter from the BEC stating that no resumes had been received in response to my ad. We will be sending the recruitment report asap now. :)

I have PD
P-05227-04*** MA TR DEC03 EB3
and still waiting for LC. However, when I check on DOL website 3 numbers before mine there is a certified TR case.
I remember checking this case in Oct 2006 and it was certified then but I assumed it was an RIR one. Since DOL posted the type on the cases I checked it again and it is TR.

Maybe it is from another state or maybe it is EB2, that is why it was certified so long ago.
