Sure.. we probably need a law suit

Hi All!
Yes, it's sure beyond frustration!!
I always wonder if there can be a class-action lawsuit against uscis
for not processing the cases in order.
How can one case not be assigned a visa number when another with a later
priority date is approved???
They need to make sure atleast visa numbers are allotted in order.
Then if they pend for other reasons, that can be dealt with.
But dealing with this retrogression crap is just too much!!
Anyways my details -
EB3 India PD 6/2003 VSC->TSC (3/07)
140/485 - RD 9/2003 - LUDs 8/31, 9/3
140 AD - 5/2004
4 EADs and 3 APs so far.
Last FP (code 3) - 5/2007

!Can something be done with help of firms like Murthy or RajivKhanna!!

P.S.
I raised that problem during conference call with Ombudsman about a month ago. I mentioned that FIFO is not happening at USCIS.
I also mentioned that "current processing times" regularly published by USCIS is just plain bullshitting (many people stuck there forever, and at the same time there are people approved within 2-3 months, way ahead of time according to USCIS).
Ombudsman was very surprised to hear that information, he said that "this is not what they hear from USCIS"... I wonder where all those people live? At Mars? And working for Mars Immigration Services? They dont have a CLUE what is happening here in their country..
